Personnel lifting platforms carry compliance risks around their function of lifting people, lifting mechanism, rated load, working height, battery/accumulator, new/used condition and post-clearance occupational safety obligations. SCOPE OF APPLICATION

This guide applies to platforms used to lift people to elevated work positions, normally including a work platform, guardrails/protection parts, lifting mechanism, control system and safety devices. New, used, refurbished, sample, warranty, project, EPE/FDI or factory imports may trigger different customs regimes and post-clearance safety obligations.

  • Do not combine this with self-propelled aerial work platforms where travelling is the principal feature.
  • Do not combine this with goods lift tables, dock levelers or platforms designed only to lift materials.
  • If lithium battery, accumulator, charger, wireless remote, spare parts or outriggers are included, review transport and specialized dossiers separately.
  • If technical information is incomplete: Review is required based on catalogue, datasheet, model and actual import purpose.

Identification must rely on catalogue, datasheet, nameplate, structure, lifting mechanism, personnel-lifting purpose, rated load, permitted occupants, working height, drive type and goods condition. Generic descriptions may lead to wrong HS, wrong group-2 policy, wrong QCVN/TCVN, wrong inspection dossier and labeling errors.

HS CODE – DUTY – C/O

HS code must be determined by the principal function, lifting mechanism, travelling mechanism and personnel-lifting purpose. 8428.90.90 is a common reference for many personnel lifting platforms, but it must not be applied mechanically to self-propelled aerial work platforms, forklifts, goods lift tables or construction hoists. C/O must be checked together with HS because wrong form, origin criteria, goods description or HS may deny special preferential duty.

Is import state quality inspection required? If correctly under Section II of Circular 01/2021, many cases are not subject to import quality inspection, but conformity, inspection and use declaration remain.
