IMPORT PROCEDURE GUIDE FOR PERSONNEL LIFTING PLATFORMS
Personnel lifting platforms carry compliance risks around their function of lifting people, lifting mechanism, rated load, working height, battery/accumulator, new/used condition and post-clearance occupational safety obligations. Wrong HS classification, generic goods names such as “lifting platform”, confusion with self-propelled aerial work platforms or goods lift tables, missing QCVN 20:2015/BLĐTBXH files, unprepared technical safety inspection, inconsistent C/O (Certificate of Origin), or missing battery documents may trigger customs checks, additional documents, loss of C/O preference, DEM/DET and delayed operation. This guide provides an E2E review map before ETA, including HS code, duties, specialized policy, dossier set, customs workflow and pre-arrival risk controls.
QUICK FACTS
| Item | Quick review content |
|---|---|
| Product | Personnel lifting platform used to elevate people to an elevated work position; may be scissor type, mast type, articulated/telescopic platform or fixed/mobile platform. It is not automatically the same as a self-propelled aerial work platform or a suspended working platform used in construction. |
| Key HS | Common reference code: 8428.90.90 – other lifting/handling machinery, other. If the equipment is a self-propelled vehicle with cabin/boom or travelling as the principal function, review 8427 or another code based on actual documents. |
| Reference tax | For 8428.90.90: reference MFN duty 0%, reference ordinary duty 5% if applicable, VAT usually 10%, special preferential duty with valid C/O if FTA conditions are met. |
| Key policy | Review QCVN 20:2015/BLĐTBXH, QTKĐ:12-2016/BLĐTBXH, Circular 01/2021/TT-BLĐTBXH, Circular 36/2019/TT-BLĐTBXH, technical safety inspection and post-clearance use declaration. |
| Technical file | Catalogue/datasheet, model, serial, rated load, permitted occupants, working height, power source/battery/accumulator, hydraulic/electrical drawings, manual, certificate/test report and nameplate photos. |
| Warning | Customs clearance does not mean the equipment is legally ready for operation. Before use, review conformity, technical safety inspection, use declaration and operator training requirements based on the actual dossier. |
SCOPE OF APPLICATION
This guide applies to platforms used to lift people to elevated work positions, normally including a work platform, guardrails/protection parts, lifting mechanism, control system and safety devices. New, used, refurbished, sample, warranty, project, EPE/FDI or factory imports may trigger different customs regimes and post-clearance safety obligations.
- Do not combine this with self-propelled aerial work platforms where travelling is the principal feature.
- Do not combine this with goods lift tables, dock levelers or platforms designed only to lift materials.
- If lithium battery, accumulator, charger, wireless remote, spare parts or outriggers are included, review transport and specialized dossiers separately.
- If technical information is incomplete: Review is required based on catalogue, datasheet, model and actual import purpose.
CLASSIFICATION & TECHNICAL IDENTIFICATION
Identification must rely on catalogue, datasheet, nameplate, structure, lifting mechanism, personnel-lifting purpose, rated load, permitted occupants, working height, drive type and goods condition. Generic descriptions may lead to wrong HS, wrong group-2 policy, wrong QCVN/TCVN, wrong inspection dossier and labeling errors.
| Checkpoint | Documents to review | Risk if incorrectly described | Suggested goods description |
|---|---|---|---|
| Type of personnel platform | Catalogue, machine photos, datasheet, manual | Confusion with aerial work platform, goods lift table or suspended platform; wrong HS/QCVN | Scissor-type/hydraulic personnel lifting platform for elevated work, model… |
| Travelling mechanism | Catalogue, operating video, manual | If self-propelled, HS/policy may differ | Mobile elevating work platform / stationary personnel lifting platform |
| Rated load, occupants and height | Load chart, nameplate, certificate | Wrong inspection basis and safety risk | Safe working load … kg, rated occupants … persons, working height … m |
| Power source | Datasheet, battery/motor specification | Battery/charger may trigger transport or safety documents | Electric/hydraulic/battery-powered personnel lifting platform |
| Goods condition | Invoice, serial, year of manufacture, actual photos | Used/refurbished goods may trigger used machinery policy | New 100% / used year…, serial…, manufacturing year… |
| Accessories | Packing list, accessory list | Remote, battery, charger, outriggers or spare parts may alter the dossier | Complete with control box, charger, outriggers, spare parts as per packing list |
HS CODE – DUTY – C/O
HS code must be determined by the principal function, lifting mechanism, travelling mechanism and personnel-lifting purpose. 8428.90.90 is a common reference for many personnel lifting platforms, but it must not be applied mechanically to self-propelled aerial work platforms, forklifts, goods lift tables or construction hoists. C/O must be checked together with HS because wrong form, origin criteria, goods description or HS may deny special preferential duty.
| Reference HS code | Application condition | Risk if incorrect | Documents to review |
|---|---|---|---|
| 8428.90.90 | Personnel lifting platform where lifting is the principal function and travelling is auxiliary or absent | Confusion with self-propelled aerial work platform or goods lift table; wrong HS, C/O, duty and group-2 policy | Catalogue, datasheet, machine photos, lifting/travelling mechanism, model/serial |
| 8427.10.xx / 8427.20.xx | Only if the equipment is a self-propelled works truck/vehicle fitted with lifting equipment and travelling is a principal feature | Declaring a vehicle-like unit under 8428 may trigger HS query | Chassis/cabin, drive system, steering, power source |
| 8428.10.xx | Only if the equipment is technically a lift/elevator, not a dedicated personnel work platform | Confusion with lift/elevator affects QCVN and inspection route | Installation drawing, guide rail, control system, intended use |
| Other 8428 lines | If actual goods are goods lift table, dock leveler, conveyor or warehouse equipment | Generic “lifting platform” may confuse lifting persons and lifting goods | Technical drawing, load purpose, guardrail, safety devices |
REFERENCE TAX TABLE
| Code/scenario | Reference ordinary duty | Reference MFN duty | VAT | FTA preference with valid C/O | Application note |
|---|---|---|---|---|---|
| 8428.90.90 – other personnel lifting platform | 5% reference if ordinary tariff applies | 0% | 10% | May be 0% under many FTAs if C/O is valid | Check tariff at declaration date; this table is not a binding classification ruling |
| Self-propelled or different configuration | By final HS after classification | By final HS | By VAT policy at declaration date | According to the relevant C/O and FTA tariff | Separate personnel platform from aerial work vehicle, forklift and construction hoist |
APPLICABLE SPECIALIZED POLICY
| Goods scenario | Possible policy | Documents to check | Authority / processing channel if identifiable | Recommended timing | Risk note |

FAQ
| Question | Short answer |
|---|---|
| Does importing a personnel lifting platform require a permit? | Do not treat it as a generic permit. Key controls are HS, Circular 01/Circular 36/QCVN20, conformity, inspection and use declaration after clearance. |
| Is import state quality inspection required? | If correctly under Section II of Circular 01/2021, many cases are not subject to import quality inspection, but conformity, inspection and use declaration remain. |
| Which HS is commonly used? | Common reference is 8428.90.90; self-propelled/boom platforms require review under 8427/8428 by actual dossier. |
| Is inspection required before use? | Likely yes if it falls under QTKĐ:12-2016/BLĐTBXH. Do not operate before inspection. |
| Can used equipment be imported? | Used machinery policy under Decision 18/2019 and amendments may apply; review year of manufacture and quality. |
| Is Vietnamese labeling required? | If circulated, handed over or used in Vietnam, control the nameplate and Vietnamese label. |
| Can C/O reduce duty? | Potentially if form, HS, description, origin and direct transport meet FTA rules. With MFN 0%, C/O still supports origin records. |
| What if invoice model differs from catalogue? | Correct the document or prepare a technical explanation before ETA; model mismatch weakens HS and inspection basis. |
