GOVERNMENT No. 74/2018/ND-CP Hanoi, 15 May 2018 DECREE Amending and supplementing a number of articles of Decree No. 132/2008/ND-CP dated 31 December 2008 providing detailed implementation of a number of articles of the Law on Product and Goods Quality. Key translated provisions for import-export operations: Article 1 amends and supplements Decree No. 132/2008/ND-CP. Article 3 is amended to provide rules for identifying potentially unsafe products and goods, also referred to as Group 2 products/goods. Such identification is based on the capability of causing unsafety and state management requirements in each period. Risk may arise from chemical, physical or biological nature; structure and operating principles; or transportation, storage, preservation and use. Sectoral ministries identify Group 2 goods and HS codes and coordinate with the Ministry of Science and Technology in developing corresponding national technical regulations and management measures. For imported Group 2 goods, state quality inspection is conducted through review of the importer’s conformity declaration. Conformity declaration may be based on self-assessment results, results of registered/recognized certification or inspection bodies, or results of designated certification/inspection bodies depending on the applicable national technical regulation. For certain imported Group 2 goods, the importer must register state quality inspection and submit supporting documents such as contract, packing list, bill of lading, invoice, import declaration, quality certificate/test result, certificate of origin if any, product photos or description, label/supplementary label, and CFS if any. The inspection authority confirms registration within 01 working day in relevant cases so that the importer may submit the confirmed registration to customs for clearance. Post-clearance conformity documents must be submitted within the prescribed period, commonly 15 working days depending on the applicable measure. The Decree also provides exemptions from import quality inspection for certain non-commercial, temporary import, transit, bonded warehouse, processing/export-production and special-purpose cases; and provides a reduced inspection mechanism for stable repeated imports after 03 consecutive compliant importations. The Decree adds rules on barcode management, responsibilities of organizations using barcodes, procedures for barcode certificate issuance/reissuance, and confirmation of foreign barcode use or barcode authorization. Articles 2 and 3 provide effect and implementation. The Decree took effect on 01 July 2018. The list of appendices includes 19 forms covering import quality inspection registration, receipt of inspection dossier, inspection result notification, designation of conformity assessment bodies, barcode registration and confirmation, and National Quality Award registration.
