Decree 13/2022/ND-CP amends and supplements selected provisions of Decree 132/2008/ND-CP, Decree 74/2018/ND-CP and Decree 86/2012/ND-CP. For import-export and logistics operations, it is relevant to quality inspection dossiers, non-commercial imports, traceability, and codes/barcodes procedures.

Validity note reviewed on 29 April 2026: The Government portal records Decree 13/2022/ND-CP as effective from 15 March 2022. However, Decree 37/2026/ND-CP provides that several clauses of Decree 13/2022/ND-CP ceased to be effective from 23 January 2026, and that the entire Decree 13/2022/ND-CP ceases to be effective from 1 July 2026. Businesses should cross-check Decree 37/2026/ND-CP and sector-specific regulations before applying this document to actual customs or compliance dossiers.

KEY POINTS TO NOTE

1. Imported goods potentially relevant to quality inspection exemption: The Decree amends Point k and Point p Clause 7 Article 7 of Decree 132/2008/ND-CP. Businesses should review import purpose, product group, applicable technical regulations and decisions/guidance issued by line ministries.
2. Traceability: The Decree adds Article 19dd on responsibilities of the Ministry of Science and Technology, line ministries and provincial People’s Committees regarding product and goods traceability.
3. Codes and barcodes: It annuls Forms No. 15, 16, 17 and 18 and replaces Forms No. 12 and 14 in the Appendix issued together with Decree 74/2018/ND-CP.
4. Impact of Decree 37/2026/ND-CP: From 23 January 2026, several provisions on traceability and management assignment in Decree 13/2022/ND-CP should no longer be used as standalone grounds. From 1 July 2026, businesses should shift review to Decree 37/2026/ND-CP and new sector-specific documents.

  • Non-commercial imports: goods not imported for sale or commercial business purposes; quality inspection exemption depends on decisions/guidance of the relevant line ministry.
  • Traceability: ability to identify and track the origin and movement of products or goods through the supply chain.
  • Codes and barcodes: identification system for goods, organizations and locations, commonly connected to GS1 standards.
  • GLN: Global Location Number used to identify physical locations, digital locations, legal entities or functional entities.
  • GTIN-8/EAN-8: 8-digit Global Trade Item Number for certain products under GS1 standards.

NOTES FOR IMPORT-EXPORT / LOGISTICS APPLICATION

  • Do not conclude quality inspection exemption based solely on the product’s commercial name or a generic purpose stated on the invoice.
  • For sample goods, non-commercial goods or manufacturing materials, standardize evidence of import purpose before ETA.
  • Customs declarations should be consistent across HS code, Vietnamese goods description, model, technical specifications, import purpose and specialized documents.
  • For shipments with ETA after 23 January 2026, and especially after 1 July 2026, review Decree 37/2026/ND-CP instead of relying only on Decree 13/2022/ND-CP.
  • If line-ministry guidance is not clear, record legal risk and seek clarification from the specialized inspection authority or the customs branch handling the shipment.
