Suspending the validity and adjusting the application period of Decree No. 46/2026/ND-CP dated 26 January 2026 of the Government detailing and guiding the implementation of certain articles and measures for organization and implementation of the Law on Food Safety and Resolution No. 66.13/2026/NQ-CP dated 27 January 2026 of the Government on food product declaration and registration
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Promulgation of Legal Normative Documents No. 64/2025/QH15, as amended and supplemented by Law No. 87/2025/QH15;
At the proposal of the Ministers of Health, Agriculture and Environment, Industry and Trade, and Justice;
The Government hereby promulgates this Resolution on suspension of validity and adjustment of the application period of Decree No. 46/2026/ND-CP dated 26 January 2026 and Resolution No. 66.13/2026/NQ-CP dated 27 January 2026.
Article 1. Suspension of validity and adjustment of the application period of documents
1. The application of Decree No. 46/2026/ND-CP dated 26 January 2026 of the Government detailing and guiding the implementation of certain articles and measures for organization and implementation of the Law on Food Safety and Resolution No. 66.13/2026/NQ-CP dated 27 January 2026 of the Government on food product declaration and registration is suspended until the end of 15 April 2026.
2. Decree No. 46/2026/ND-CP dated 26 January 2026 of the Government detailing and guiding the implementation of certain articles and measures for organization and implementation of the Law on Food Safety and Resolution No. 66.13/2026/NQ-CP dated 27 January 2026 of the Government on food product declaration and registration shall resume effect from 16 April 2026.
Article 2. Application of legal normative documents during the suspension period
During the suspension period prescribed in Article 1 of this Resolution, Decree No. 15/2018/ND-CP dated 02 February 2018 of the Government detailing the implementation of certain articles of the Law on Food Safety and documents regulating and guiding the implementation of such Decree shall continue to remain effective.
Article 3. Effect and implementation responsibility
1. This Resolution takes effect from 04 February 2026.
2. Before 16 April 2026, the Ministries of Health, Agriculture and Environment, Industry and Trade, Finance, relevant ministries and agencies, and People’s Committees at all levels shall be responsible for ensuring all necessary conditions for implementation of Decree No. 46/2026/ND-CP dated 26 January 2026 of the Government and Resolution No. 66.13/2026/NQ-CP dated 27 January 2026 of the Government on food product declaration and registration.
