Bottled / Canned Coffee Import Procedure in Vietnam: HS, Food Safety, VAT and Labeling 2026

F&B · NON-ALCOHOLIC BEVERAGE / RTD COFFEE

BOTTLED / CANNED COFFEE IMPORT PROCEDURE IN VIETNAM

Bottled or canned coffee looks straightforward, but three issues routinely change the compliance route: misclassifying coffee-based vs milk-based beverages, missing import food-safety control, and applying the wrong VAT treatment when total sugar exceeds 5 g/100 mL.

A latte, milk coffee or coffee-flavoured milk SKU may follow a different HS and veterinary route from black RTD coffee even though “coffee” appears on the Invoice. The correct sequence is formula → product identity → HS → food safety → tax → labeling/nutrition.

Operational reference for import-export businesses · Updated through 11 Sep 2026.

1. QUICK SUMMARY & SCOPE

PRODUCT GROUP
Ready-to-drink coffee beverage

Black coffee, milk coffee, RTD latte/cappuccino and coffee-flavoured drinks in bottles/cans/cartons, non-alcoholic and ready for immediate consumption.

REFERENCE HS
2202.99.40 · competing 2202.99.10 / .50 / .90

2202.99.40 covers coffee-based/flavoured drinks; a flavoured UHT milk-based drink requires review under 2202.99.10.

SPECIALIZED CONTROL
Self-declaration + import food-safety inspection

Circular 28/2026 places 2202.99.10/.40/.50/.90 in the MoIT state food-safety inspection list; Article 13 Decree 15 exemptions must still be reviewed, together with reduced/normal/tight inspection methods.

MARKET CIRCULATION
Label + nutrition + total sugar

From 1 Jan 2026, new imported food labels within Circular 29/2023 scope must comply with nutrition-label rules; total sugar g/100 mL is a key control point.

TAX
Main MFN 20% · VAT depends on sugar threshold

2202.99.40 reference MFN 20%, ordinary 30%. TCVN soft drinks with sugar >5 g/100 mL are excluded from the 2-point VAT reduction in 2026.

KEY BLOCKER
Coffee-based or milk-based? · sugar >5 g/100 mL?

These facts can change HS, animal-origin quarantine review, VAT and the excise-tax roadmap.

Scope: non-alcoholic bottled/canned/carton coffee beverages that are ready to drink and imported for commercial circulation in Vietnam. Roasted beans, instant powder, coffee extract/concentrate requiring dilution, health supplements, alcoholic drinks and special nutritional products are not automatically covered.
Warning: “coffee latte”, “milk coffee” or “café au lait” does not determine HS by itself. Review coffee/extract %, milk/cream %, creamer type, UHT/retort/sterilization, ready-to-drink status and the legal product identity shown on the label.

2. KEY TERMS & WHY THE PROCEDURE MATTERS

RTD
Ready-to-drink

A beverage intended for immediate consumption without dilution. This is an important boundary between Chapter 22 beverages and extracts/concentrates or premixes elsewhere.

COFFEE-BASED
Coffee-based beverage

Coffee or coffee flavour is the defining character of the beverage; 2202.99.40 is the main reference branch where the facts support it.

UHT MILK-BASED
Flavoured UHT milk-based drink

Where the product is substantively a flavoured sterilized/UHT milk-based drink, review 2202.99.10 even where coffee provides the flavour.

FOOD SAFETY
Import food-safety control

Covers self-declaration, import inspection method, testing basis and conditions for market circulation.

TOTAL SUGAR
Total sugar g/100 mL

Decree 360/2025 refers to TCVN 12828:2019 and defines the sugar amount as total sugar shown on the label. TCVN 12828 includes coffee beverages but excludes milk and dairy products.

C/O
Proof of origin

Used to review FTA preference after final HS is locked. It does not replace self-declaration, food-safety inspection or product technical evidence.

Why this matters: the same “coffee milk drink” wording can conceal a coffee-based beverage, a flavoured UHT milk-based drink, or even a concentrate/premix. Total sugar is also a tax-control datum, not merely a marketing value.
Key reminder: VAT cannot be fixed at 8% or 10% merely from HS 2202. Determine whether the product is a “soft drink under TCVN” and whether total sugar exceeds 5 g/100 mL.

3. PRODUCT CLASSIFICATION & DETAILED IDENTIFICATION

Before HS or regulatory analysis, lock at least: quantified formula, coffee/extract %, milk/cream %, non-dairy creamer, total sugar g/100 mL, sweeteners/additives, UHT/retort/sterilization process, RTD vs concentrate form, package, claims and target user.

DETAILED PRODUCT CLASSIFICATION

Product/scenario What to check Example Evidence Potential policy Dossier to reconcile Application note
Black coffee / coffee RTD Coffee defines the product; ready to drink; not concentrate Black coffee can, RTD cold brew Formula, coffee extract %, process, label, photos Review 2202.99.40; self-declaration; import FS; nutrition/label; VAT by sugar Spec, test, self-declaration, FS result, label, C/O Do not move to Chapter 21 if the imported article is already an RTD beverage.
Milk coffee that remains coffee-based Contains milk/creamer but coffee remains defining; not substantively a flavoured UHT milk-based drink Vietnamese milk coffee RTD, latte RTD Full formula %, coffee/milk ratio, process, product name, label May remain 2202.99.40; animal-origin ingredients require separate veterinary-scope review where relevant Formula, dairy docs, FS, self-declaration, label Do not use milk percentage alone; classify from the overall product identity and legal description.
Coffee-flavoured UHT milk-based drink Milk is the product base; UHT/sterilized; coffee is flavour/character Coffee-flavoured UHT milk drink Milk %, fat/protein, UHT process, formula, label Review 2202.99.10; food safety; review terrestrial AQ/establishment/Health Certificate under Circular 01/2026 where in scope. If also within the liquid-milk QCVN scope, note that Circular 09/2026/QCVN 28 is suspended until 1 Dec 2026 by Decision 2130/QĐ-BCT. Formula, process, VHC/HC if applicable, FS, label This is the key competing branch against 2202.99.40. TCVN 12828:2019 on soft drinks does not apply to milk and dairy products, so the >5 g/100mL sugary-soft-drink rule must not be mechanically transferred to a genuinely milk-based product.
Other non-aerated RTD beverage Coffee is not the defining character; still a ready-to-drink beverage Mixed cereal drink with coffee note Formula, technical description, label Review 2202.99.50 or 2202.99.90 as appropriate; FS Full formula, catalogue, test, label Do not use .50/.90 where the dossier clearly supports coffee-based identity.
Coffee concentrate / syrup requiring dilution Not ready to drink; requires dilution/reconstitution; high extract/solid content Coffee concentrate, coffee syrup Directions, Brix/solids, formula, process Do not default to 22.02; review 21.01/21.06 or another heading Spec, intended use, process, label Use form and intended consumption as key evidence.
Coffee powder / premix Powder/beans rather than liquid RTD beverage Instant coffee mix, roasted coffee Physical form, ingredients, process Review Chapters 09/21; different duty and regulatory treatment Formula, spec, label Do not use 2202.99.40 simply because the name includes coffee.
Special-claim product Health-support claim, meaningful added actives or positioning for special users Functional coffee drink Formula, claim, dosage, target user May require registered declaration or another special regime instead of ordinary self-declaration Formula, claim dossier, test Regulatory classification should be locked before purchase and artwork approval.

4. HS CODE – TAX – C/O

HS classification must follow the product’s actual character and form of use. For bottled/canned RTD coffee, 2202.99.40 is the main reference where coffee/coffee flavour defines the beverage, but 2202.99.10 milk-based UHT drinks, .50/.90 residual beverages and Chapter 09/21 concentrates/powders must first be excluded.

HS BRANCH
2202.99.40 ↔ .10 ↔ .50/.90 ↔ 21.01

Lock using formula, coffee/milk identity, process and ready-to-drink status.

CLASSIFICATION BASIS
Product character + Chapter 22

Do not classify from the word coffee on the Invoice alone.

MFN / ORDINARY
2202.99.40: 20% / 30%

2202.99.10: 30%/45%; .50: 30%/45%; .90: 20%/30% as current reference rates.

VAT
8% or 10% depending on 2026 case

Base VAT is 10% where 0%/5% do not apply; review 8% reduction under Decree 174 for 2026. A TCVN 12828:2019 soft drink with total sugar >5 g/100mL is excluded from the 2-point reduction → 10%.

C/O / FTA
By origin + final HS

Form E/D does not automatically mean 0%; verify the 2026 schedule and PSR.

LOCK BEFORE DECLARATION
HS + total sugar + dairy branch

These three items should be fixed before landed-cost calculation, C/O and label issuance.

5. DOSSIER & PREPARATION

Use a “one source of truth – multiple procedures” approach. SKU name, formula %, coffee/milk identity, total sugar g/100 mL, UHT/retort process, manufacturer, origin, package and claims must align across HS, self-declaration, import FS, test report, nutrition label, C/O and Customs.

01
Commercial dossier

Invoice, Packing List, B/L/AWB, Contract/PO and C/O where preference is claimed; avoid generic “coffee drink” descriptions where a more precise identity is available.

02
Technical / specialized dossier

Full formula %, coffee/extract %, milk/cream %, total sugar g/100mL, additives, process, package, shelf life, COA/test, artwork; veterinary documents if a dairy branch is triggered.

03
Registration & reconciliation dossier

Self-declaration/test; import FS file; original/Vietnamese label + nutrition; C/O; Customs file; terrestrial AQ/VHC where the dairy-product scope actually applies.

Dossier principle: create one master data sheet per SKU and lock coffee %, milk %, total sugar g/100 mL, manufacturer, origin, UHT/sterilization and serving form before the supplier issues label/C/O drafts.

7. PROCESSING TIME, FEES & RISK COSTS

OPERATIONAL TIMELINE

Step/operation Sourced processing time Conditions Fees Logistics risk
Lock formula/HS/sugar before PO-shipment Variable; no fixed statutory period Full formula %, sugar g/100mL, process, label draft Testing/specification cost where needed Wrong coffee-based ↔ milk-based branch can change HS, AQ, C/O and landed cost.
Self-declaration Complete before market circulation; Decree 15 self-declaration is not an approval-wait process like registered declaration Product falls under self-declaration Testing/dossier service costs where applicable; no single state fee asserted without current basis Formula/test/label mismatch creates post-market risk.
Import FS – reduced method According to Decree 15 eligibility; processing depends on the applicable reduced-control mechanism and file Meets reduced-inspection criteria Current inspection/testing costs if any Do not assume reduced control without qualifying evidence.
Import FS – normal 3 working days from receipt of dossier under Decree 15 procedure Normal inspection method Current inspection/testing costs Inconsistent dossier can trigger supplementation and storage delay.
Import FS – tightened 7 working days from receipt of dossier under Decree 15 procedure Tightened method; sampling/testing Testing may apply Sampling/test can increase storage/DEM/DET.
Dairy terrestrial AQ – if triggered Under current Circular 01/2026 framework; do not add to every coffee SKU Milk-based/product scope actually subject to AQ Quarantine/testing fees by case Country/establishment/VHC gaps can block shipment.
Customs – tax – clearance Depends on Green/Yellow/Red channel and specialized-control result HS, C/O, FS, AQ if any and taxes complete Import duty, VAT; excise according to effective roadmap if applicable Wrong HS/total sugar/product identity can change VAT. For a TCVN 12828 coffee beverage with sugar >5 g/100mL, no 2-point VAT reduction applies in 2026. The 8% excise rate starts only on 1 Jan 2027.
Supplementary label & circulation Before circulation; new labels imported from 1 Jan 2026 must comply with Circular 29/2023 where in scope Food-safety/customs obligations completed Artwork/label-control costs Nutrition/sugar/allergen errors create post-market exposure.
Post-clearance records Through the SKU/document lifecycle under current rules Product continues on market Internal compliance costs Formula, sugar, supplier, origin or label changes require reassessment.
Timeline principle: run formula/HS, testing, self-declaration, labeling and draft C/O in parallel as early as possible. Do not add terrestrial AQ to every milk coffee; trigger it only where the actual product/ingredient scope requires it. Decree 15 provides 3/7-working-day normal/tight inspection milestones, but supplementation and laboratory time can lengthen total lead time.

8. PRACTICAL E2E WORKFLOW

STEP 01
Identify product/data

Lock formula %, coffee/extract %, milk/cream %, sugar g/100mL, additives, RTD/concentrate form, process, package and claims.

STEP 02
Finalize HS/tax/C/O

Exclude 2202.99.40 ↔ 2202.99.10 ↔ .50/.90 ↔ Chapters 09/21; then calculate MFN/ordinary/VAT and review FTA.

STEP 03
Review policy & specialized controls

Use Circular 28/2026 + Decree 15 for FS; Circular 29/2023 for nutrition; Decree 360/2025 + TCVN 12828:2019 for sugary-beverage identification; Circular 01/2026 if dairy veterinary scope is triggered. Record the current suspensions of Circular 09/QCVN milk and Circular 11 traceability.

STEP 04
Complete product/registration file

Prepare suitable testing, self-declaration, import FS dossier and nutrition label; add VHC/AQ only if genuinely required.

STEP 05
Lock documents pre-ETA

Cross-check Invoice – PL – B/L/AWB – C/O – formula/spec – self-declaration – test – original/VN label – sugar value.

STEP 06
File Customs/handle channel

Declare HS from actual dossier and support coffee-based vs milk-based identity, RTD status, total sugar and C/O.

STEP 07
Complete controls/tax/clearance

Finish import FS, terrestrial AQ if any, import duty/VAT and Customs channel; control storage/free time.

STEP 08
Circulation/records/post-clearance

Apply correct supplementary label; retain formula/test/self-declaration/FS/C/O/declaration; reassess recipe/sugar/claim/supplier changes.

Before ETA: lock at least six items before the shipment moves: coffee %, milk %, total sugar g/100 mL, RTD/concentrate status, UHT/retort process and HS branch. These are the data supplier documents, C/O and labels need to follow.
Main blockers: Invoice says coffee drink but formula is actually UHT milk drink; no total-sugar value per 100mL; defaulting to 8% VAT; self-declaration/test from an old formula revision; nutrition label not updated for 2026; animal-origin dairy present but veterinary scope not reviewed.

9. FAQ – FREQUENTLY ASKED QUESTIONS

1. Is bottled/canned coffee always 2202.99.40?

No. 2202.99.40 is the main reference where the product is a coffee-based/flavoured RTD beverage. A flavoured UHT milk-based product may be 2202.99.10, while concentrates/powders follow other headings.

2. Can canned latte still be 2202.99.40?

Possibly. “Latte” alone does not determine HS. Review full formula, coffee/milk ratio, process, product identity and label to exclude 2202.99.10.

3. When should 2202.99.10 be reviewed?

Where the dossier shows a flavoured UHT milk-based drink, with milk as the product base and coffee providing flavour/character rather than defining a coffee beverage.

4. Does canned coffee require self-declaration?

Ordinary processed prepacked coffee beverage generally follows Decree 15 self-declaration unless its formula/claim places it in a registered-declaration or special category.

5. Is every shipment inspected the same way for food safety?

No. Circular 28/2026 places the relevant 2202 lines in the state-inspection list, but reduced/normal/tight methods and exemptions depend on Decree 15 conditions.

6. Is VAT 8% or 10% in 2026?

Do not answer from the product name alone. Base VAT is 10% where 0%/5% do not apply; Decree 174 allows a 2-point reduction for eligible goods. A TCVN 12828:2019 soft drink with total sugar >5 g/100mL is excluded from that reduction in 2026 → 10%. TCVN 12828 excludes milk/dairy, so a true milk-based drink requires separate analysis.

7. Does a >5 g/100mL sugary drink already pay 8% excise tax in 2026?

No. Law 66/2025 and Decree 360/2025 identify TCVN 12828:2019 soft drinks with total sugar >5 g/100mL, but the rate schedule begins at 8% from 1 Jan 2027 and 10% from 1 Jan 2028. In 2026 the key operational consequence is exclusion from the 2-point VAT reduction under Decree 174.

8. Does a coffee milk drink require terrestrial animal quarantine?

The name alone is insufficient. If it is a flavoured UHT milk-based drink or the formula/product falls within Circular 01/2026 scope, review country/establishment, Veterinary/Health Certificate and terrestrial AQ. If it falls within the liquid-milk QCVN scope, note that Circular 09/2026 is suspended until 1 Dec 2026 under Decision 2130/QĐ-BCT and recheck status for shipments near/after that date.

9. What changed for food labels in 2026?

From 1 Jan 2026, new imported food labels within Circular 29/2023 scope must comply with nutrition-content/value requirements. Added-sugar beverages need particular control of sugar information where applicable.

10. Does China Form E guarantee 0% import duty?

No. Final HS, the 2026 ACFTA tariff line, PSR, origin, transport and document validity must all be checked. A valid C/O does not replace food-safety compliance.

11. Is bottled coffee concentrate handled like RTD coffee?

Not automatically. If dilution/reconstitution is required, 21.01/21.06 or another heading may compete. Reclassify before applying 2202.99.40 tax/policy.

12. What should be obtained from the supplier before ETA?

Full formula %, coffee/milk ratio, total sugar g/100mL, additives, UHT/retort flow, product spec, COA/test, original label + nutrition panel, manufacturer/origin and draft C/O. If a dairy branch may trigger AQ, also review establishment and VHC/Health Certificate.

10. OUTPUTS & POST-CLEARANCE OBLIGATIONS

01
Product/classification file

Formula %, coffee/milk identity, RTD status, process, sugar g/100mL, package and HS-branch memo.

02
Shipment file

Invoice, PL, B/L/AWB, Contract/PO, origin, lot/qty/package and C/O aligned.

03
Specialized file

Self-declaration/test, import FS; terrestrial AQ/VHC/establishment only where the actual dairy branch triggers it.

04
Customs & tax

Declaration, HS rationale, MFN/ordinary duty, 8/10 VAT logic, C/O/FTA and tax documents.

05
Label & circulation

Original/VN label, nutrition facts, total sugar, allergens, origin, importer, storage and dates.

CHECK
Records & change management

Manage recipe revision, sugar level, supplier, manufacturer, origin, process, claims and artwork.

Target output: each SKU should produce one consistent chain: formula → product identity → HS → food safety → sugar/VAT → C/O → label → Customs. Landed cost should be finalized only after this chain is locked.
Change management: a change in milk %, creamer type, coffee extract %, sugar, sweetener, UHT/retort, manufacturer, origin or claims can change HS, VAT, excise roadmap, veterinary treatment, testing and labeling. Do not reuse old compliance files after a formula revision without reassessment.

11. TGIMEX SOLUTIONS

For bottled/canned coffee, the hard part is locking coffee-based vs milk-based + total sugar + food-safety route before shipment so all documents follow one logic.

01
Pre-ETA review

Lock formula, HS branch, sugar/VAT, FTA, food-safety route and dairy-quarantine trigger before supplier documents are issued.

02
Compliance dossier control

Cross-check self-declaration, testing, nutrition label, formula, manufacturer, C/O and VHC/AQ where applicable.

03
Operations/logistics & clearance

Plan food-safety inspection, Customs, tax, storage/free time and delivery by SKU/shipment.
