Import procedures for shredded squid / seafood snack into Vietnam: HS, food safety, duty, C/O and labels

GUIDE TO IMPORT PROCEDURES FOR SHREDDED SQUID / SEAFOOD SNACK INTO VIETNAM

Shredded squid / seafood snack is easy to misclassify because the same trade name may mean simply dried squid cut into strips, ready-to-eat grilled/seasoned squid, or a flour/starch-based snack containing only a small amount of seafood. Those configurations may fall in Chapter 03, Chapter 16, or outside Chapter 16.

For a food preparation containing more than 20% by weight in total of the ingredients covered by Chapter 16, Chapter 16 Note 2 applies; where squid is the Chapter 16 component that predominates by weight, 1605.54 is normally the first branch to review. Squid does not need to exceed 50% of the total product.

1. QUICK SUMMARY & SCOPE

PRODUCT
Ready-to-eat shredded squid snack

Typically shredded squid that has been grilled/dried again, seasoned and retail packed; distinguish it from merely cut dried squid and starch-based seafood snacks.

HS TO REVIEW
1605.54.xx ↔ 0307.49.xx ↔ Ch.19/21

If total Chapter 16 ingredients exceed 20% by weight and squid predominates among those Chapter 16 components, review 1605.54.10/.90. Merely dried/cut squid: 0307.49.21/.29. Otherwise classify by actual product nature.

SPECIALIZED
Food safety; AQ by actual condition

Ambient dried/heat-treated squid snack still requires food-safety review. Circular 03/2026 limits ordinary aquatic-product quarantine to live/fresh/chilled/frozen products.

MARKET
Self-declaration + label + nutrition

Processed prepacked food normally follows Decree 15/2018 self-declaration unless another registration or exemption route applies.

DUTY
1605.54: MFN 25% · ordinary 37.5%

For prepared squid under 1605.54, reference MFN is 25% and ordinary duty 37.5%; VAT must follow the final product/process.

STOP POINT
% squid · recipe · process · pack · C/O

Without percentage formula and process flow, Chapter 16 cannot be safely locked. Airtight retail packaging also separates .10 from .90.

Scope: Applies to shredded squid/seafood snack for human consumption. Starch/flour crackers or extruded snacks with small seafood content require a separate classification review.
Warning: Chapter 16 Note 2 applies when listed Chapter 16 ingredients total more than 20% by weight. For mixtures, the Chapter 16 heading follows the component(s) that predominate by weight. It does not apply to stuffed products of 19.02 or preparations of 21.03/21.04. The trade name “seafood snack” alone is not enough.

2. KEY TERMS & WHY THEY MATTER

HS
Tariff classification

Classification follows ingredients, seafood percentage, condition and processing—not the invoice nickname.

>20%
Chapter 16 threshold to test

Chapter 16 Note 2 applies when listed Chapter 16 ingredients total more than 20% by weight; for mixtures, the heading follows the component(s) that predominate by weight, subject to 19.02/21.03/21.04 exceptions.

FSI
Imported food-safety inspection

Check the applicable inspection method, exemptions/reductions and competent authority under the current regime.

SELF-DECL.
Product self-declaration

Common route for processed prepacked food under Decree 15/2018 unless product registration applies.

AQ
Aquatic quarantine

Circular 03/2026 ordinary product scope is live/fresh/chilled/frozen; ambient dried/heat-treated snack is not automatically covered.

C/O
Origin evidence

May materially reduce import duty, but only if the final HS and the agreement-specific PSR are satisfied.

Why this matters: One “shredded squid snack” may contain 70% squid; another may be a starch snack with 8% squid powder. They cannot share a classification memo.
Key point: Obtain a percentage formula, not just an ordered ingredient list. The percentage of Chapter 16 ingredients can change the chapter classification.

3. DETAILED PRODUCT IDENTIFICATION & CLASSIFICATION

Before locking HS, collect the percentage recipe, squid/seafood species, full process flow, heat treatment, final moisture, additives/seasoning and packaging specification.

Product/situation What to verify Example Evidence Potential policy Documents Application note
Simply dried shredded squid Only dried + mechanically cut/shredded; no material seasoning/cooking Dried shredded squid ingredient Species, process, ingredients Food safety; retail declaration/label if applicable Spec/process/label May remain under 0307.49.xx.
Ready-to-eat seasoned shredded squid Total Chapter 16 ingredients >20%; squid predominates by weight among Chapter 16 components; grilled/re-dried/seasoned Seasoned shredded squid snack % recipe, process, heat Food safety, self-declaration, label/nutrition Recipe/process/test/label Review 1605.54.10/.90.
Mixed seafood shredded snack Squid + fish/surimi/shrimp or multiple Ch.16 ingredients Mixed seafood snack % formula by ingredient Food safety, declaration, label Recipe/species/process If Chapter 16 applies, select the heading corresponding to the Chapter 16 component(s) that predominate by weight.
Starch/flour snack not drawn into Chapter 16 by Note 2 Cracker/chip/extruded structure; seafood minor Seafood cracker/snack Full formula + process Food safety, declaration, label Recipe/process/photos Do not automatically use 1605.54. If Note 2 does not draw the product into Chapter 16, classify by actual nature; Chapters 19/21 are only possible branches and 19.02/21.03/21.04 exceptions must be checked.
Airtight retail pack Hermetically/airtight packed for direct retail Vacuum/retort/sealed pouch Packing spec/artwork HS sub-branch + food safety Pack/label Only test .10 vs .90 after 1605.54 is confirmed.

4. HS CODE – DUTY – C/O

For processed squid snack where total Chapter 16 ingredients exceed 20% by weight and squid predominates among those Chapter 16 components, review 1605.54 first. Merely dried/shredded squid and products not drawn into Chapter 16 by Note 2 require different branches.

MAIN
1605.54.10 / .90

Prepared or preserved cuttlefish/squid. .10 is for airtight retail containers; .90 is other.

CH.03
0307.49.21 / .29

Review where the goods remain simply dried/salted/brined squid and shredding/cutting does not create a Chapter 16 preparation.

OUTSIDE CH.16
Chapter 19/21 may arise

If Note 2 does not draw the product into Chapter 16, or a 19.02/21.03/21.04 exception applies, determine the heading from formula, process and product form. Chapters 19/21 are only possible branches; do not guess an 8-digit code.

MFN / ORD.
1605.54 = 25% / 37.5%

Rates shown for the main branch only; re-calculate if classification changes.

VAT
Processed snack: normally 10% → 8% if eligible

Where it is another processed product, standard VAT is 10% and 8% through 31 Dec 2026 if eligible under Decree 174/2025. Merely preliminarily processed goods require separate Decree 181/2025 review.

FTA
Strong preferences on 1605.54

ATIGA, ACFTA, AJCEP/VJEPA and CPTPP may reach 0%; EVFTA/UKVFTA are 3.1% in 2026 for this branch, subject to origin rules.

Do not publish a single HS in metadata for all “shredded squid / seafood snack” products.

5. DOCUMENT SET & PREPARATION

For seafood snacks, manage one recipe = one document version. The formula used for HS must match the self-declaration, test report, artwork and imported goods.

01
Commercial documents

Invoice, packing list, B/L-AWB, contract/PO, packing specification, SKU/lot and sufficiently specific description.

02
Technical / specialized documents

Full % formula, species/raw materials, process flow, heat treatment, additives, COA/test, label and food-safety dossier. If the goods are not processed, prepackaged food excluded by Article 14(1) of Decree 15/2018, also review exporting-country/territory, recognized-establishment and exporting-authority food-safety-certificate conditions.

03
Registration & cross-check

Self-declaration where applicable, nutrition/label file, C/O and pre-ETA reconciliation checklist.

Preparation rule: Avoid invoice wording that says only “seafood snack”. Use an operationally meaningful description such as seasoned shredded squid snack / prepared squid snack together with SKU and pack.

7. PROCESSING TIME, FEES & RISK COST

No single timeline or fee fits every seafood snack shipment. Timing depends on self-declaration readiness, inspection method, sampling, classification clarity and customs channel.

Stage Main action Management milestone Fee/cost Delay risk
Pre-ETA Lock % formula, process, HS, VAT, C/O, label Before shipment/ETA where possible Testing/advisory if needed Wrong chapter or missing compliance file.

8. PRACTICAL E2E WORKFLOW

STEP 01
Identify product data

Collect % recipe, species, process, heat treatment, moisture, pack, artwork and end use.

STEP 02
Lock HS/duty/C/O branch

Test Chapter 16 threshold; split 1605.54 ↔ 0307.49 ↔ Ch19/21 before duty/VAT/FTA.

STEP 03
Review specialized controls

Determine food-safety inspection, self-declaration, label/nutrition and AQ by actual condition.

STEP 04
Complete product file

Lock self-declaration where applicable, test, ingredients, nutrition and label.

STEP 05
Lock documents before ETA

Reconcile commercial docs, C/O, recipe, process, pack, label and food-safety dossier.

STEP 06
Customs declaration & channel

Declare the final HS and handle green/yellow/red channel questions on snack composition.

STEP 07
Complete checks/tax/clearance

Finish food-safety steps if applicable, process C/O/duty and release cargo.

STEP 08
Market placement & post-control

Control recipe/label version and re-review changes to seafood %, supplier, process, pack, origin or claims.

Before ETA: Steps 01–05 should be complete before ETA. For shredded squid snack, the two documents that should never be missing are the percentage recipe and process flow.
Main blocker: An ingredient list without percentages may still be insufficient to apply Chapter 16 Note 2. Lock the total squid/seafood percentage before customs declaration.

9. FAQ – FREQUENTLY ASKED QUESTIONS

1. What HS is commonly reviewed for shredded squid snack?

Where total Chapter 16 ingredients exceed 20% by weight, squid predominates among those Chapter 16 components and the product is prepared/preserved, review 1605.54.10 or 1605.54.90 depending on packaging.

2. Does vacuum packing automatically mean 1605.54.10?

No. First confirm 1605.54; then test whether the pack qualifies as an airtight retail container.

3. Does simply shredding dried squid move it to Chapter 16?

Not necessarily. Mere mechanical cutting/shredding of dried squid may remain under 0307.49.xx if no deeper preparation occurs.

4. Can a low-squid seafood snack use 1605.54?

Do not assume so. If listed Chapter 16 ingredients do not exceed 20%, Note 2 does not itself draw the product into Chapter 16; classify by actual nature and check the 19.02/21.03/21.04 exceptions.

5. Is shredded squid snack subject to aquatic quarantine?

Ambient dried/heat-treated snack is not automatically within ordinary aquatic quarantine under Circular 03/2026; re-check specific triggers from the actual condition/case.

6. Is imported-food-safety inspection required?

Potentially yes. Review the applicable inspection method or exemption under Decree 15/2018. Processed, prepackaged food is excluded by Article 14(1) from its separate country/establishment/per-shipment certificate conditions, but that does not mean exemption from all imported-food-safety controls.

7. Is product self-declaration required?

Processed prepacked food normally follows Decree 15/2018 self-declaration unless another category or exemption applies.

8. What is the MFN rate for 1605.54?

Reference MFN for 1605.54.10/.90 is 25%; ordinary duty is 37.5%.

9. What VAT applies in 2026?

For another processed product, standard VAT is 10% and eligible goods may use 8% through 31 Dec 2026 under Decree 174/2025. Merely preliminary processing requires Decree 181/2025 review.

10. Can China or ASEAN origin reach 0% duty?

For 1605.54, ACFTA and ATIGA provide 0% in the 2026 schedule when the applicable PSR and origin evidence are satisfied.

11. What labels matter for seafood snack?

Product name, origin, responsible entity, ingredients, net content, date/shelf life, storage and other mandatory items under Decree 37/2026; nutrition under Circular 29/2023 where applicable.

12. Must HS be rechecked after changing squid percentage or process?

Yes. Ingredient percentage and processing are core classification facts and can shift the goods among Chapters 03, 16, 19 or 21.

10. OUTPUTS & POST-CLEARANCE OBLIGATIONS

01
Classification/product file

% recipe, species/raw materials, process, pack and classification memo for 1605.54, 0307.49 or another branch.

02
Shipment file

Invoice, PL, B/L-AWB, contract/PO, SKU/lot and consistent description.

03
Specialized-control file

Self-declaration, test report, food-safety result/file and AQ document only if actually triggered.

04
Customs & tax file

Declaration, value, C/O, tax documents and any HS explanation.

05
Label & market file

Original/supplementary labels, ingredient statement, allergen/claims where relevant, nutrition, storage and shelf life.

CHECK
Retention & change control

Re-review changes to squid/seafood %, supplier, recipe, process, pack, origin or claims.

Required output: The final dossier should prove the snack’s nature and percentage composition, explain why Chapter 16 applies or does not, and link the final HS to duty, origin and food-safety treatment.
Change warning: A small change in squid percentage or starch content can change Chapter 16 eligibility. Do not reuse the old classification memo after the recipe changes.

11. TGIMEX SOLUTIONS

TGIMEX can support pre-ETA product-data control to reduce classification and specialized-compliance risk for seafood snacks.

01
Pre-ETA review

Cross-check % recipe, process, HS, MFN/VAT, C/O, food safety/AQ, packing and label.

02
Compliance document control

Reconcile formula, spec, test/self-declaration, nutrition, labels, C/O and shipment file by the same SKU/version.

03
Logistics & customs coordination

Coordinate specialized-control tasks, transport documents, customs channel and cargo-release plan.

Scope should be tailored to the SKU, formula, origin, import purpose and actual dossier.
