Import procedure for cream sandwich biscuits into Vietnam: HS Code, tax, C/O, self-declaration and food-safety inspection 2026

F&B IMPORT PROCEDURE · UPDATED 08 SEP 2026

IMPORT PROCEDURE FOR CREAM SANDWICH BISCUITS INTO VIETNAM

Common risk: using a generic product name without distinguishing biscuit vs. wafer or cocoa vs. non-cocoa can lead to incorrect HS classification, tax, food-safety documentation and C/O treatment.

This article provides an end-to-end review map covering product identification, HS – tax – C/O, self-declaration, state food-safety inspection, documents, timeline and post-clearance obligations.

Operational reference for import-export businesses.

QUICK FACTS

POLICY
Processed prepackaged food

Standard cream sandwich biscuits are processed, prepackaged foods; review self-declaration and state food-safety inspection requirements against the actual dossier.

HS
1905.31.10 / 1905.31.20

First codes to review for sweet biscuits: non-cocoa or cocoa-containing. If the product is actually a wafer, move to heading 1905.32.

FS
MOIT scope

Circular 28/2026/TT-BCT, effective 17 July 2026, issues the list of imported goods subject to state food-safety inspection under the Ministry of Industry and Trade.

VAT
8% conditionally

Decree 174/2025/NĐ-CP applies VAT reduction through 31 December 2026 for eligible goods; exclusions must be checked.

C/O
FTA by origin

ACFTA, RCEP, ATIGA, AKFTA/VKFTA, AJCEP/VJEPA, EVFTA, UKVFTA, CPTPP and others should be reviewed by import route and final HS.

ETA
Lock documents before arrival

Ingredient list, specification, label, C/O draft, Invoice/Packing List and self-declaration status should be checked before ETA to reduce storage risk.

2. KEY TERMS & WHY THE PROCEDURE MATTERS

HS
HS Code

Commodity classification code used for customs declaration, tax and many specialized policies. For sandwich biscuits, classification depends on biscuit/wafer nature and cocoa content.

FS
Food Safety

Regulatory controls intended to ensure imported food is safe before circulation.

SELF
Product Self-declaration

The mechanism under Decree 15/2018/NĐ-CP currently continuing to apply for eligible food products while the 2026 replacement framework is suspended.

STATE
State food-safety inspection

Specialized inspection for imported food. Depending on conditions and compliance history, reduced, ordinary or strict inspection may apply.

C/O
Certificate of Origin

Used to prove origin and support preferential FTA tariff treatment where rules of origin are satisfied.

ETA
Estimated Time of Arrival

Operational milestone used to control when documents must be finalized before the cargo reaches Vietnam.

Why this matters: the commercial phrase “cream sandwich biscuit” can cover products with different structures, cocoa content or import purposes, which may change HS and regulatory conclusions.
Remember: “chocolate flavour” on marketing text does not by itself prove that the finished product contains cocoa; verify the ingredient list and specification.

3. DETAILED PRODUCT IDENTIFICATION & CLASSIFICATION

This article applies to finished cream sandwich biscuits packed for retail or distribution. Samples, non-commercial goods, wafers, specially coated products or materially different formulas require separate review.

Product group / situation Technical signs to verify Example Evidence Possible policy Documents to cross-check Application note
Sweet sandwich biscuit without cocoa Biscuit shell; finished formula has no cocoa/cacao Vanilla cream sandwich biscuit Ingredient list, specification, cross-section image, original label Self-declaration; state food-safety inspection; labeling Spec, test report, declaration, Invoice/PL/B/L Review 1905.31.10 first.
Sweet sandwich biscuit with cocoa Cocoa in shell, filling or finished formula Chocolate cream sandwich biscuit Ingredient list/formula, specification, label Same core food-safety controls Spec, test report, declaration, shipment docs Review 1905.31.20 first.
Wafer sandwich Wafer layers rather than a standard biscuit shell Cream wafer sandwich Cross-section image, catalogue/spec, ingredient list Different HS branch; food safety; labeling Spec, declaration, shipment docs Do not automatically use 1905.31; review 1905.32.
Special coating/filling structure Chocolate/compound coating, unusually high filling or different structure Coated sandwich cookie Formula, BOM/recipe, images, label May affect HS and test panel Technical file, test report, label Review actual product characteristics.
Sample / not for commercial sale Small quantity, R&D/testing/exhibition, not circulated Sample pack Invoice, packing list, purpose evidence May follow a different route Shipment and purpose documents Do not automatically apply the commercial-goods conclusion.
Identification warning: the generic description “cream-filled biscuit” may result in the wrong HS, food-safety policy, tax or label if the technical file does not clearly show product type and composition.

4. HS CODE – IMPORT TAX – VAT – C/O

HS review should start from the product itself: biscuit or wafer, cocoa content, coating/structure, formula and technical evidence. The codes below are reference points only.

Reference HS Suitable description Classification basis Condition Ordinary import duty MFN duty VAT C/O / FTA to review Documents
1905.31.10 Sweet biscuits – not containing cocoa Sweet biscuit; no cocoa in finished product Not a wafer; no feature moving it elsewhere 22.5% reference 15% reference 8% if eligible under Decree 174/2025 through 31 Dec 2026; otherwise statutory rate ATIGA, ACFTA, RCEP, AKFTA/VKFTA, AJCEP/VJEPA, CPTPP, EVFTA, UKVFTA… Ingredient list, specification, label, C/O
1905.31.20 Sweet biscuits – containing cocoa Sweet biscuit; cocoa present Not a wafer; formula confirms cocoa 22.5% reference 15% reference 8% if eligible; otherwise statutory rate Same Ingredient list, formula/spec, label, C/O
1905.32.20 Wafers Wafer-shell structure Only where the product is in fact a wafer Check current tariff by final HS Check current tariff by final HS Check current VAT policy FTA by origin Cross-section image, spec, ingredient list, label

Always confirm the current tariff schedule against the final HS and actual dossier. Preferential FTA rates require full compliance with the relevant origin rules and documents.

5. DOCUMENT SET & SUBMISSION PRINCIPLES

Document management should be divided into three layers so that commercial, technical and specialized-regulatory files remain consistent. This article intentionally does not provide click-by-click submission instructions; the receiving method must be checked against the actual shipment and competent authority.

01
Commercial documents

Commercial Invoice, Packing List, B/L or AWB, Sales Contract/PO if any, and C/O where preferential tariff is claimed.

02
Technical / specialized documents

Ingredient list, product specification, original label, product images, food-safety test report, self-declaration and any additional specialized documents triggered by the actual product.

03
Registration & cross-check pack

Documents used for the applicable food-safety inspection route and customs review. Data should be prepared before arrival rather than after the cargo reaches port.

Document principle: Invoice, Packing List, B/L/AWB, C/O, label, ingredient list/spec, self-declaration and customs data should tell the same story about product name, origin, pack size and identity.

7. PROCESSING TIME, FEES & RISK COSTS

Step Time / milestone Basis / condition Potential cost Operational note
Prepare technical file Preferably before booking/ETA Depends on manufacturer data readiness Translation, label preparation and testing if required Not a statutory deadline; lock ingredient list, specification and label before filing.
Testing for self-declaration Test report must be within 12 months up to the filing date Article 5(1), Decree 15/2018/NĐ-CP Testing fees Test parameters must match the product and applicable legal basis.
Self-declaration Self-declaration mechanism; not an approval-waiting procedure Article 5, Decree 15/2018/NĐ-CP currently continuing to apply Preparation/translation/service cost if outsourced Ensure the declaration matches the technical file and label.
Reduced inspection If selected for dossier review: up to 03 working days from receipt of dossier Article 19, Decree 15/2018/NĐ-CP Potential cost if supplementation delays clearance Only where reduced-inspection conditions are met; customs may randomly select up to 5% of eligible shipments in a year for dossier review.
Ordinary inspection 03 working days from receipt of dossier Article 19, Decree 15/2018/NĐ-CP Storage risk if documents are late/incomplete Dossier review followed by a compliant/non-compliant import notice.
Strict inspection 07 working days from receipt of dossier Article 19, Decree 15/2018/NĐ-CP Sampling/testing fees; storage/DEM/DET may arise Dossier review plus sampling/testing where the strict method applies.
Customs and delivery Depends on customs channel and completion of specialized requirements Green/Yellow/Red channel and actual file Tax, local charges, storage/DEM/DET if delayed Do not budget using freight alone.
Cost principle: separate government/specialized compliance costs from logistics costs. Avoid publishing absolute numbers without a current legal basis or shipment-specific quotation.

8. END-TO-END OPERATIONAL PROCESS

STEP 01
Review the product

Obtain ingredient list, specification, original label, cross-section images and manufacturer details. Confirm biscuit vs. wafer, cocoa vs. non-cocoa and packaging form.

STEP 02
Confirm HS – tax – C/O

Review 1905.31.10/20 or 1905.32 where applicable. Compare MFN and FTA by origin, and verify VAT conditions.

STEP 03
Prepare specialized dossier

Arrange testing, self-declaration and the food-safety dossier for the exact product. Do not use one generic file across materially different SKUs.

STEP 04
Determine inspection method

Check whether the shipment is exempt, reduced, ordinary or strict inspection based on actual conditions.

STEP 05
Lock documents before ETA

Cross-check Invoice, PL, B/L/AWB, C/O, label, self-declaration and specification so identity/origin/pack data match.

STEP 06
Customs declaration & channel handling

Declare HS, value, origin and policy correctly. Green focuses on system processing, Yellow on document review, Red may include physical inspection.

STEP 07
Complete inspection – tax – clearance

Close food-safety requirements, tax obligations and customs issues before cargo release according to actual status.

STEP 08
Post-clearance obligations

Complete Vietnamese supplementary labeling before circulation and retain product/shipment/C/O records for traceability and post-clearance review.

Pre-ETA milestone: technical file, provisional HS, C/O draft, self-declaration and inspection-method review should be done before arrival whenever possible.
Main control point: HS – cocoa composition – biscuit/wafer – self-declaration product name – C/O – label – Invoice/PL/B/L must follow one consistent product identity.

9. FAQ

1. Do cream sandwich biscuits require self-declaration?

For standard processed prepackaged food imported for commercial circulation, review the self-declaration mechanism under Decree 15/2018/NĐ-CP currently continuing to apply; exceptions depend on product type and import purpose.

2. Can vanilla cream sandwich biscuits automatically use HS 1905.31.10?

No. Verify the ingredient list and physical structure to confirm non-cocoa status and that the product is a biscuit rather than a wafer.

3. Does “chocolate flavour” mean the product contains cocoa?

Not necessarily. Marketing flavour is not a substitute for the formula/ingredient list.

4. What if the sandwich product is a wafer?

Review heading 1905.32 and the corresponding regulatory file; do not use 1905.31 merely because the name contains “sandwich”.

5. Does Form E automatically guarantee 0% import duty?

No. ACFTA 0% is conditional on rules of origin, valid proof, transport and other FTA requirements.

6. Is every shipment sampled at the border?

No. The inspection level depends on the applicable method and shipment conditions.

7. Is VAT always 8% in 2026?

No absolute conclusion should be made. Decree 174/2025 reduces eligible 10%-rated goods to 8% through 31 Dec 2026, subject to exclusions and other statutory rates.

8. Can one self-declaration cover every flavor?

Review product name, origin and composition. Material changes may require re-assessment of the declaration obligation.

9. Which labeling rules apply to imported goods in 2026?

From 23 Jan 2026, imported-goods labeling should be reviewed under Decree 37/2026/NĐ-CP. Decrees 43/2017 and 111/2021 ceased to be effective from that date. For food, nutrition labeling should also be checked against Circular 30/2026/TT-BYT, effective 10 Jul 2026.

10. Does customs clearance mean the compliance file is finished?

No. Records, labeling, C/O, self-declaration and traceability data still need to be retained for post-market or post-clearance checks.

10. OUTPUTS & POST-CLEARANCE OBLIGATIONS

01
Product file

Ingredient list, specification, label, images and manufacturer data sufficient to prove product identity.

02
Shipment file

Invoice, Packing List, B/L/AWB, customs declaration and transport documents retained by shipment.

03
Specialized compliance file

Self-declaration, food-safety test report and the inspection documents/results applicable to the shipment.

04
Label & circulation

Review imported-goods labeling under Decree 37/2026/NĐ-CP and food nutrition labeling under Circular 30/2026/TT-BYT, including applicable transition rules; information should remain consistent with the product file.

05
Retention & audit readiness

Retain C/O/origin proof, tax documents and traceability records for post-clearance or market inspection.

CHECK
Change management

If manufacturer, origin, composition, biscuit/wafer structure or product name changes, re-check HS, declaration, labeling and policy before the next shipment.

Desired output state: the business can trace the chain “what is the product” → “which HS” → “which food-safety route” → “which C/O” → “how it is labeled” → “where the evidence is retained”.
Change warning: clearance of one shipment does not automatically validate every SKU or future shipment if formula, origin, manufacturer or product structure changes.

11. SOLUTIONS FROM TGIMEX

For cream sandwich biscuits, the operational focus is to identify the product correctly before ETA and keep one consistent data chain across the technical file, food safety, C/O, customs and labeling.

01
Pre-ETA review

Review biscuit/wafer nature, cocoa content, HS, tax, C/O, VAT, label and food-safety triggers before arrival.

02
Compliance document control

Cross-check Invoice, Packing List, B/L/AWB, ingredients, specification, test report, self-declaration, C/O and declaration data.

03
Operational/logistics coordination

Track shipment timeline, coordinate customs and specialized inspection, cargo release/warehouse handling and post-clearance record retention.

Businesses should work with a party experienced across logistics, documentation, customs and specialized policy to reduce storage, document supplementation and unplanned costs.
