Seaweed Snack Import Procedure into Vietnam 2026: HS 2008.99.30 vs 1212.21, Duty, Food Safety, C/O and Labeling

F&B IMPORT PROCEDURE · UPDATED 09 SEP 2026

SEAWEED SNACK IMPORT PROCEDURE INTO VIETNAM 2026: HS 2008.99.30 VS 1212.21, DUTY, FOOD SAFETY, SELF-DECLARATION, C/O & LABELING

Seaweed snack is easy to classify from its trade name instead of its processing level. Plain dried edible seaweed may remain under 1212.21, while roasted/dried seasoned seaweed with significant oil, salt and seasoning has a Vietnam Customs precedent under 2008.99.30.

A wrong HS can cascade into import duty – C/O – food-safety records – landed cost – customs explanation. This guide covers ready-to-eat retail seaweed snack while separating plain dried raw material, coated seaweed chips and mixed snacks that require a different conclusion.

Operational reference for importers · Final conclusions must be locked against ingredient percentages, oil/seasoning ratio, process, product form, origin, label and actual shipment records.

QUICK FACTS

SCOPE
Main scope

Ready-to-eat processed seaweed snack, commonly nori/laver that is dried/roasted and may be seasoned with vegetable oil, salt, sugar, sesame or flavoring, retail-packed.

MAIN HS
2008.99.30

Primary indicative route for processed/seasoned seaweed with significant oil and seasoning where the product is materially similar to the Vietnam Customs classification precedent.

ALT HS
1212.21.19 / 1212.21.90

Review where the goods are edible dried or other seaweed forms not deeply processed into a snack. Do not automatically use these codes for heavily seasoned/oiled products.

FOOD SAFETY
Decree 15/2018

Ordinary processed prepacked food generally follows self-declaration and imported-food safety review under the applicable method, unless exempt.

2026 CHANGE
Circular 22/2026/TT-BNNMT

From 01 Sep 2026, ordinary/strict imported-food safety inspection under the Agriculture & Environment scope is decentralized to the local level.

LABEL
Circular 30/2026/TT-BYT

From 10 Jul 2026, nutrition labeling follows Circular 30/2026. Seaweed snack needs particular sodium control; added-sugar/fried products require additional applicable nutrients.

Main split: “ready-to-eat seaweed” is not automatically the same as plain dried seaweed of heading 12.12. Confirm processing level, oil/seasoning ratio and the ingredient giving essential character.

2. TERMS & WHY THE PROCEDURE MATTERS

SEAWEED
Seaweed

Marine algae used as food, such as nori/laver, kombu and wakame. The trade name alone does not establish HS; species, form and degree of processing matter.

SEASONED
Seasoned seaweed

Seaweed with added oil, salt, sugar, sesame or seasoning. This processing may move the product beyond the logic of plain dried seaweed under heading 12.12.

HS
HS Code

Customs classification drives duty, C/O and commodity-policy checks. For seaweed snack, oil/seasoning ratio and roasting/seasoning process are important classification evidence.

FS
State food-safety inspection

Imported-food safety inspection under Decree 15/2018, applying the appropriate method and exemption based on the shipment and compliance history.

SELF
Product self-declaration

The mechanism under Arts. 4–5 of Decree 15/2018 for eligible processed prepacked food. The file must match SKU, manufacturer, ingredients, test report and label.

ETA
ETA

Estimated Time of Arrival. HS draft, test, self-declaration, label, origin/C/O and food-safety records should be substantially locked before cargo arrival.

Why it matters: the difference between 2008.99.30 and 1212.21.xx is not merely naming; indicative MFN duty can differ from about 40% to 10%, directly affecting landed cost.

3. PRODUCT CLASSIFICATION & IDENTIFICATION

This guide mainly covers processed, ready-to-eat, retail-packed seaweed snack without health-supplement claims. Before import, obtain ingredients, seaweed/oil/seasoning ratios, species where available, specification/COA, flow chart, product photos, label artwork and manufacturer data.

Product scenario Technical signs to check Example Evidence Potential policy Documents to review Application note
Seasoned/oiled seaweed snack Seaweed is the principal ingredient; roasted/dried and seasoned with oil, salt, sugar or flavoring; ready to eat Korean seasoned laver, roasted seaweed snack Ingredients, seaweed/oil ratio, flow chart, spec, product photos Food safety, self-declaration, label, additives Review 2008.99.30, test, origin/C/O Main branch; compare with Customs Notice 5453/TB-TCHQ if materially similar.
Plain dried edible seaweed Dried, not ground; little or no oil/seasoning; fit for human consumption Dried nori sheets, dried edible seaweed Species, process, spec, ingredient = seaweed Food safety, label; different HS logic Review 1212.21.19 Do not use seasoned-snack HS for plain dried material.

Classification warning: generic “seaweed snack” naming can lead to the wrong 2008.99.30 or 1212.21 route, followed by wrong duty, C/O and food-safety logic. A precedent applies only to materially similar goods.

4. HS CODE – DUTY – C/O

For seasoned seaweed with significant oil/seasoning, 2008.99.30 is the first route to review against Customs Notice 5453/TB-TCHQ. For plain dried edible seaweed not deeply processed, review 1212.21.19 or 1212.21.90 according to form.

5. DOCUMENT PACKAGE & SUBMISSION PRINCIPLE

Manage the seaweed-snack file in three layers: commercial records, a product file proving the processing/ingredient ratios, and the shipment-level food-safety file. Do not wait until Customs asks for the oil ratio or the food-safety authority asks for product scope before requesting supplier evidence.

01
Commercial file

Commercial Invoice, Packing List, B/L/AWB, Contract/PO where relevant, origin/C/O where preference is claimed, manufacturer/origin information.

02
Technical / specialized file

Ingredients, seaweed–oil–seasoning ratios, specification/COA, flow chart, test report, self-declaration, label and nutrition panel.

03
Registration & cross-check file

Imported-food safety file under the applicable method where required, HS memo distinguishing 2008.99.30 from 1212.21 and shipment documents before ETA.

Preparation rule: product name, net weight, SKU, manufacturer, origin, ingredient %, oil/seasoning %, lot/date and HS draft must align across Invoice – Packing – origin/C/O – self-declaration – test – label.

7. TIMING, FEES & RISK COSTS

Actual timing depends on product-file completeness, inspection method and customs channel. The major risk is mistaking processed seasoned snack for plain dried seaweed, or vice versa, and having to revise HS, C/O and landed cost after shipment.

Stage Work Recommended timing Target output Delay risk
1. Prepare product file Lock seasoned/plain status, ingredients %, oil %, process, HS draft, test, self-declaration and label Before shipment confirmation Product master file Wrong HS/landed cost; label/declaration rework.
2. Review food-safety method Determine exemption/normal/strict method under Decree 15 and local authority under 2026 decentralization Before ETA Food-safety file ready Late acceptance and storage.
3. Cross-check shipment documents Compare Invoice, Packing, B/L/AWB, origin/C/O, manufacturer, SKU and HS Before ETA No major shipment-file gaps C/O/document rework after cargo departure.
4. Amend/supplement Add test, formula, process, label or origin evidence As soon as gap is found Gap list closed Storage/DEM/DET and release delay.
5. Complete specialized control Complete food-safety outcome under applicable method Per shipment progress Ready for customs processing Clearance delay.
6. Customs – tax – clearance Declaration, channel, HS/C/O and tax handling When conditions are met Clearance/release Port/warehouse cost and stockout.
7. Post-clearance / circulation Vietnamese supplemental label, retain declaration/test/C/O/customs records, change control Before circulation and after clearance Complete shipment file Post-entry, food-safety and labeling exposure.
Fees/costs: determine them from the actual file and provider. Do not publish one fixed fee for all shipments; separate state fees where any, testing costs and logistics exposure such as storage/DEM/DET.

8. PRACTICAL E2E PROCESS

STEP 01
Identify the snack

Collect ingredients %, oil/seasoning ratio, species where available, process and finished-product photos. Decide first: processed seasoned snack or plain dried seaweed.

STEP 02
Lock HS – duty – C/O

Compare 2008.99.30 with 1212.21.19/.90. If batter/starch/nuts are material, stop and reclassify before modeling landed cost.

STEP 03
Prepare food-safety file

Lock self-declaration, test report, additive review, nutrition panel, label artwork and SKU version.

STEP 04
Determine applicable method

Use Decree 15/2018 to determine exemption/normal/strict method and identify the locally assigned body after the 01 Sep 2026 decentralization.

STEP 05
Freeze documents before ETA

Cross-check Invoice, Packing, B/L/AWB, origin/C/O, manufacturer, net weight, SKU and HS draft. Confirm oil/seasoning ratio matches the product file.

STEP 06
Customs declaration & channel

Green is lower-intervention system treatment; Yellow is document review; Red may include physical inspection. Keep HS memo and ingredients/process ready.

STEP 07
Complete food safety – tax – clearance

Track specialized result, origin/C/O, tax and cargo-release/pickup status.

STEP 08
Circulation & post-entry

Complete Vietnamese supplemental labeling, retain product master + shipment file, and control changes in formula, oil %, factory and origin.

Before ETA: have at least ingredients % + oil/seasoning % + process + HS draft + self-declaration/test + label + origin/C/O draft. If the supplier has not provided oil/seasoning ratios, do not lock HS from the name “seaweed snack”.
Main blockers: supplier changes oil %, seasoning, adds batter/starch, changes factory/origin, or origin evidence still uses the old HS after formula changes.

9. FAQ

Which HS should seasoned/oiled seaweed snack be reviewed under?

Where the product is processed seasoned seaweed with significant oil/seasoning and is materially similar to Customs Notice 5453/TB-TCHQ, 2008.99.30 is the first route to review. Do not classify from the name ‘seaweed snack’ alone.

When is 1212.21.19 relevant?

Where the goods are edible seaweed that is dried but not ground and has not been deeply processed into an oiled/seasoned snack.

Why can duty differ so much for seaweed?

Because 2008.99.30 is a processed plant preparation while 1212.21.xx covers seaweed/algae within heading 12.12. Indicative MFN rates are about 40% versus 10%, making early HS control critical.

Does ordinary seaweed snack require self-declaration?

Generally yes under Arts. 4–5 of Decree 15/2018 for ordinary processed prepacked food, unless it falls into a product-registration category.

Must processed prepacked seaweed meet country/facility listing rules like raw materials?

For processed, prepacked food, Decree 15/2018 excludes it from the additional country/facility conditions applied to relevant raw animal/plant/aquatic foods under Art. 14. Self-declaration and import inspection still need separate review.

Which authority handles imported-food safety now?

From 01 Sep 2026, normal/strict inspection for imported plant-origin food under the Agriculture & Environment scope is decentralized to the local level. Confirm the body assigned/designated by the provincial authority for the shipment.

How old can the self-declaration test report be?

Under Art. 5 of Decree 15/2018, the food-safety test report used for self-declaration must be within 12 months before filing.

Does Korea-origin seaweed automatically get 0% duty?

Do not assume so. Compare AKFTA/VKFTA/RCEP against the final HS, PSR and actual origin evidence. 2008.99.30 and 1212.21 may follow different schedules.

What about China-origin goods with Form E?

The ACFTA 2022–2027 schedule shows 0% for 1212.21.19/.90 and 2008.99.30. Preference still depends on valid origin rules, evidence and consistent HS/description.

What matters for 2026 labeling?

Besides Decree 43/2017 and Decree 111/2021, nutrition labeling now follows Circular 30/2026/TT-BYT. Sodium deserves particular review; added-sugar or fried products require the additional applicable nutrient declarations.

10. OUTPUTS & POST-CLEARANCE OBLIGATIONS

01
Product file

Ingredients %, oil/seasoning %, species where available, process/flow chart, spec/COA, test, self-declaration and version-controlled artwork.

02
Shipment file

Invoice, Packing, B/L/AWB, customs declaration, origin/C/O, value documents and specialized records.

03
Food-safety file

Self-declaration, test report, inspection/exemption method and specialized result where applicable.

04
Label & circulation

Vietnamese supplemental label, ingredients/additives, nutrition, net weight, dates, origin and responsible entity.

05
Retention & audit

Traceability from SKU → formula/process → HS → self-declaration/test → label → origin/C/O → customs declaration.

CHECK
Change control

Oil %, seasoning, batter/starch, factory, artwork or origin changes trigger a fresh HS, food-safety, test and label review.

Target state: the importer should be able to explain “why 2008.99.30 or why 1212.21” using ingredients/process evidence, not only the trade name on the Invoice.
Clearance is not the end. Changes in oil/seasoning ratio, snack structure, factory or origin trigger a fresh HS, testing, self-declaration, label and shipment-file review.

11. SOLUTIONS FROM TGIMEX

For seaweed snack, the key control point is locking product scope – HS 20.08/12.12 – duty – C/O – food safety – self-declaration – label before ETA, because processing differences can materially change tax and compliance.

01
Pre-ETA review

Review seasoned/plain status, heading 20.08 vs 12.12, duty, C/O, food safety, self-declaration, testing and labels before shipment.

02
Compliance-file control

Cross-check Invoice, Packing, B/L/AWB, C/O, formula, oil %, process, spec, test, self-declaration and artwork; issue a supplier gap list.

03
Operations/logistics coordination

Track ETA – food safety – declaration – channel – tax – pickup and alert early on storage/DEM/DET where HS or documents are not locked.

Importers should work with a team capable of coordinating logistics, documentation, customs and specialized compliance from product scope through clearance and post-entry filing.
