SENSOR IC EXPORT PROCEDURE
For Sensor IC shipments, the main risk is not shipment size but misidentifying a bare IC versus a sensor module, fixing HS by trade name, missing strategic-trade controls, or allowing part numbers to diverge across commercial documents, datasheets, C/O and AWB/B/L. An error at pre-contract stage can lead to customs amendments, licensing gaps, missed cut-offs or buyer document rejection.
This article follows the rule market first – procedure second – operations through post-shipment. Because no destination market was specified, a product-specific market scan was carried out and five routes with observable trade signals were selected for further model-, buyer-, end-use- and final-HS verification.
1. QUICK FACTS – EXECUTIVE OVERVIEW
Thailand • Hong Kong • China • South Korea • Malaysia
Screening priority based on observable 2024–2025 IC trade signals; this is not a market-share ranking.
Treat as ordinary exports only after model-level strategic-trade / dual-use and end-use/end-user screening.
8542.39.00 / 8542.31.00 are candidates only where the technical nature fits; modules/boards may classify elsewhere. Export duty must follow final HS; 0% VAT is conditional.
Thailand: ATIGA/RCEP; Hong Kong: AHKFTA; China: ACFTA/RCEP; Korea: VKFTA/AKFTA/RCEP; Malaysia: ATIGA/CPTPP/RCEP.
Screen Decree 259/2025 and Circular 30/2026/TT-BKHCN; HS alone does not decide dual-use status.
Lock policy and technical file before Cargo Ready; customs before cargo cut-off; SI/VGM/AWB data before document cut-off.
Air is often practical for high-value/light ICs; sea depends on volume and lead time. ESD/MSL packing is a dedicated control point.
2. SCOPE & SENSOR IC PRODUCT CLASSIFICATION
In this guide, a Sensor IC means a semiconductor integrated circuit that senses or supports measurement of a physical quantity such as temperature, pressure, light, magnetic field, acceleration, motion or humidity and outputs/conditions analog or digital signals. “Sensor IC” is a commercial label, not a sufficient customs description.
| Variant | Technical indicators | Evidence | Potential HS/policy | Application note |
|---|---|---|---|---|
| Standalone Sensor IC | Packaged IC, not a PCB; I²C/SPI/analog output; sensing/conditioning function | Datasheet, part number, package drawing, photo | Often review 8542.39.00 | Do not classify by the word “sensor” alone. |
| IC with MCU/processor | Embedded processing core/ALU/firmware; significant compute capability | Block diagram, core specs, processing performance | May require review of 8542.31.00 and Circular 30/2026 | Determine whether sensing or processing/control defines the product. |
| Sensor module / PCB assembly | PCB, connector, MCU, wireless, housing or multiple components | BOM, schematic, module datasheet, photo | May fall outside heading 8542 | Do not classify the entire module as an IC merely because it contains a Sensor IC. |
| Radiation-hardened / high-performance IC | Radiation ratings, performance/architecture, 32-bit ALU, specialized end use | Manufacturer data, radiation report, end-use statement | Review Decree 259/2025 + Circular 30/2026 | Potential strategic-trade licensing trigger. |
| Sample / RMA / warranty | No-charge, return-to-vendor/buyer or engineering sample | RMA, warranty letter, no-charge invoice, lot/serial list | Customs procedure/value may differ | “Sample” does not remove HS/policy obligations. |
3. EXPORT MARKETS & MARKET ACCESS REQUIREMENTS
Because the brief did not specify a destination market, this article performs a market scan before procedure design. Market selection uses verifiable HS/consignment trade signals together with FTA relevance and compliance risk. The result is a screening priority, not a market-share ranking.
| Market | Trade signal & data year | Market Access to lock | FTA / origin route | Market-specific risk |
|---|---|---|---|---|
| Thailand High screening priority |
2024 shipment data show multiple Vietnam-to-Thailand HS 854231 consignments, including CIS/electronic integrated circuit descriptions. | Lock importer HS, buyer quality file and lot traceability; if the item is a module/finished device, re-screen technical/wireless compliance rather than applying bare-IC conclusions. | ATIGA / RCEP; compare PSR and origin evidence under the final HS. | Do not select Form D/RCEP by habit where the fab–assembly–test chain cannot support origin criteria. |
| Hong Kong High screening priority |
2024 shipment data show a Vietnam-to-Hong Kong CIS consignment under HS 854231. | In addition to importer classification and buyer file, screen Hong Kong Strategic Commodities Control where IC parameters or end-use may be sensitive. | AHKFTA; review PSR and the appropriate origin document. | Hong Kong is a re-export hub; routing through Hong Kong does not remove strategic-control obligations. |
| China Medium-high |
2024 commercial customs datasets show HS 854231 consignments from Vietnam to China. | Lock importer classification, part number, origin and quality/reliability requirements; modules/finished devices require their own certification scope review. | ACFTA / RCEP; choose based on PSR and the evidence the buyer/importer can actually use. | Do not infer CCC applicability or non-applicability from the trade name “Sensor IC”. |
| South Korea Medium |
2025 shipment data show Vietnam-origin HS 854239 ICs entering South Korea. | Buyer quality/reliability, lot traceability, origin and end-use. Sensitive ICs merit export-control review. | VKFTA / AKFTA / RCEP; compare PSR before applying for origin proof. | Choosing the wrong origin route can trigger verification even where import duty is already low. |
| Malaysia Medium |
2025 shipment data show HS 854231 consignments from Vietnam into Malaysia. | Importer HS, buyer manufacturing/quality file and origin trail; separate bare IC from module/assembly. | ATIGA / CPTPP / RCEP; review PSR and the applicable origin evidence. | Do not choose an FTA only by the headline tariff; origin provability and buyer use matter. |
Market-scan sources: 2024 shipment-level HS 854231 data (Thailand/Hong Kong), 2024 commercial customs data (China), and 2025 shipment data (South Korea/Malaysia). These are trade-data signals used for market screening, not official Vietnam Customs market rankings. HS854231 – Thailand/Hong Kong · China · South Korea · Malaysia.
4. VIETNAM EXPORT CONDITIONS / POLICY
For a Sensor IC as a semiconductor component, Vietnam-side review first determines whether the shipment follows ordinary export procedures or triggers product-specific/strategic trade controls. A small IC, a no-battery product or a non-finished device must not be treated as automatically license-free.
| Scenario | Policy to review | Legal basis group | Authority/channel | Trigger |
|---|---|---|---|---|
| Ordinary bare/packaged Sensor IC | Foreign-trade management + export customs | Law on Foreign Trade Management; Decree 69/2018 through 04 Sep 2026; Decree 292/2026 from 05 Sep 2026 | Customs and the relevant specialist authority if triggered | Final HS, technical description, goods condition and export purpose. |
| High-performance / radiation-sensitive IC | Strategic trade control; licensing may arise | Decree 259/2025/ND-CP; Circular 30/2026/TT-BKHCN | Ministry of Science and Technology / competent authority under the applicable procedure | Only when the model matches the relevant legal and technical criteria; see Section 7. |
| Sample / RMA / warranty | Review customs regime, value, purpose and product policy | Customs law + product policy | Customs | “Sample/no-charge” does not waive HS, licensing or strategic-trade screening. |
| Sensor module/board with wireless, crypto or processor | Re-classify and review the complete module/device and destination rules | Feature-based controls + destination requirements | Depends on trigger | Do not apply a bare-IC conclusion to a finished module merely because it contains a Sensor IC. |
5. HS CODE – EXPORT DUTY – EXPORT VAT
HS must be fixed from the technical nature, not the trade name “Sensor IC”. Actual trade records also show sensing-related ICs declared under HS 854231, so this article does not force every Sensor IC into 854239.
| Variant | Reference HS | Evidence to support classification | How to use |
|---|---|---|---|
| Electronic integrated circuit fitting the “other” subheading | 8542.39.00 | Datasheet, block diagram, package, sensing/signal-conditioning function; not a processor/controller, memory or amplifier under the relevant legal subheading. | Use only where the technical file genuinely fits. |
| IC whose legal nature is processor/controller | 8542.31.00 | CPU/core, control logic, processing function, architecture and principal role. | Do not move to 854231 merely because an MCU is present; classify the whole IC by its legal nature. |
| Sensor module / PCBA / complete measuring device | Do not default to 8542 | BOM, schematic, connectors, housing, wireless, power and independent function. | Classify the complete module/device. |
| Sensor die / semiconductor element not meeting the legal character of an IC in heading 8542 | Re-classification required | Semiconductor construction, sensing principle and degree of integration. | Another heading may apply; prepare a separate technical classification file. |
Do not hard-code an export-duty rate while final HS is unresolved. Check the export tariff effective on the customs-registration date under Decree 26/2023 and amendments including Decrees 108/2025 and 199/2025.
Docs/Customs should lock the HS through the technical file before calculating tax exposure and before issuing the final Invoice/C/O set.
Do not state that every export automatically receives 0% VAT. The 0% rate depends on the eligible transaction and documentary conditions under current VAT law.
Review Decree 181/2025 as amended by Decree 359/2025 and Decree 144/2026, together with Circular 69/2025/TT-BTC and current guidance.
Finance/Tax should retain the export contract, customs declaration, payment evidence and export evidence required for the applicable case.
6. C/O – FTA – RULES OF ORIGIN
For Sensor ICs, the Origin Audit Trail should start from fab – assembly – packaging – test, not when the C/O application begins. A part number may have a multinational production chain; if the buyer wants preference but the exporter cannot substantiate the PSR, origin proof may be rejected or verified.
| Market | FTA to review | Origin document | PSR / data to lock | Operational note |
|---|---|---|---|---|
| Thailand | ATIGA / RCEP | Form D or RCEP origin document under the applicable mechanism | Final HS, PSR, origin inputs, direct-consignment evidence where required | ATIGA can be practical within ASEAN, but only if the actual origin criteria are met. |
| Hong Kong | AHKFTA | AHKFTA origin document | PSR, invoice, production/origin records | Do not confuse Hong Kong re-export routing with Hong Kong origin. |
| China | ACFTA / RCEP | Form E or the appropriate RCEP origin proof | Compare PSR under both mechanisms and supplier evidence | Choose the route by provable origin, not by habitually using Form E. |
| South Korea | VKFTA / AKFTA / RCEP | Origin document under the selected agreement | PSR, BOM, supplier declarations, production records | Buyer/importer should confirm which preference route it can use. |
| Malaysia | ATIGA / CPTPP / RCEP | Form D or certification/origin document under the selected mechanism | PSR, origin file, invoice/transport data | CPTPP certification differs from Form D; do not mix templates. |
7. PRODUCT-SPECIFIC REGULATORY CONTROLS
Sensor ICs require technical screening, not a conclusion based on the trade name. Decree 259/2025 establishes Vietnam’s strategic-trade control framework; Circular 30/2026/TT-BKHCN issues the dual-use list and licensing framework under the Ministry of Science and Technology. For each model, compare the exact appendix line, including the relevant HS/description/technical parameters; do not use HS alone as the control conclusion.
| Sensor IC situation | Trigger to check | Possible procedure/evidence | When to lock |
|---|---|---|---|
| Ordinary civilian bare/packaged IC | Datasheet, performance, radiation rating, architecture and end-use/end-user | Technical screening memo; where no trigger applies, retain the screening result by shipment | Pre-contract / before Cargo Ready |
| High-performance / radiation-hardened / custom IC | Technical characteristics in the Circular 30/2026 control list | Potential licence under the Ministry of Science and Technology’s authority; technical file, end-use/end-user and shipment evidence | Before production/booking, not close to ETD |
| Not listed but sensitive end-use/end-user indicators exist | Suspicion of WMD-related use or a designated end-user | Decree 259/2025 contains catch-all control: a licence may still be required; Compliance escalation is needed | At RFQ/PO stage |
| Sensor module with wireless/crypto/battery | The module is not the same product as a bare IC; check connectivity, crypto, battery/DG and destination compliance | Separate HS, export-policy, destination technical-compliance and transport review | Before quotation/Contract |
| Sample / RMA / warranty | Commercial purpose changes, technical nature does not | Review customs type, value and strategic-control status as for the actual product | Before declaration |
8. EXPORT DOCUMENT SET & FILING CHANNELS
| Document group | Documents | Use | Typical owner | Core data to match | Common error |
|---|---|---|---|---|---|
| Commercial | Contract/PO, Commercial Invoice, Packing List | Customs, booking, buyer documents | Sales/Docs | Part number, description, quantity, price, Incoterm | Over-generic “Sensor IC” description; part-number mismatch. |
| Technical | Datasheet, block diagram, part list, product photo | HS/policy/dual-use screening | Engineering/Compliance | Function, core, processing/radiation data if relevant | Wrong datasheet revision. |
| Customs | Export declaration and documents by customs regime | Export clearance | Customs/Docs | HS, description, value, origin, quantity | Bare-IC HS used for a module. |
| Strategic trade | License if applicable; end-use/end-user file; technical assessment | Pre-shipment control | Compliance/Legal | Model, threshold, buyer/end-user, destination | Screening after Cargo Ready. |
| Origin | C/O/origin document, BOM, evidence | FTA/buyer origin | Docs/Factory/Procurement | HS, criterion, invoice/shipment | Weak fab–assembly–test audit trail. |
| Transport/buyer | Booking, SI, VGM if sea, AWB/B/L, CoC, quality docs | Shipping/post-shipment | Forwarder/Docs/QA | Packages, weight, marks, lot, shipper/consignee | Transport document mismatch. |
9. LEGAL BASIS – REGULATORY & MARKET REQUIREMENT MATRIX
The legal matrix is separated into the required three layers: Vietnam law – FTA/origin – official destination-market rules. Buyer specifications are not inserted into the legal matrix where they are contractual only.
| Layer | Instrument/source | Authority | Effective timing | Application / old → new |
|---|---|---|---|---|
| Vietnam – Foreign trade management | Decree 69/2018 → Decree 292/2026 | Government | Decree 292: 05 Sep 2026 | Decree 292 replaces Decree 69 from 05 Sep 2026; as of 03 Sep 2026 the transition is not yet complete. |
| Vietnam – Strategic trade | Decree 259/2025 | Government | 10 Oct 2025 | Strategic-trade goods including dual-use goods; licensing and catch-all/end-use controls. |
| Vietnam – Dual-use under MOST | Circular 30/2026/TT-BKHCN | Ministry of Science and Technology | 06 Jun 2026 | Dual-use list/licensing under MOST; compare each model against the exact technical appendix line. |
| Vietnam – Customs | Customs Law 2014; Decree 08/2015 as amended by Decree 167/2025; Circular 121/2025/TT-BTC | National Assembly / Government / Ministry of Finance | Decree167: 15 Aug 2025; Circular121: 01 Feb 2026 | Customs procedure, inspection/supervision and export-import tax administration. |
| Vietnam – HS/tariff | Circular 31/2022/TT-BTC; Decree 26/2023 and amendments 108/2025, 199/2025 | MOF / Government | Use version effective on declaration date | HS nomenclature and export tariff. Final HS must be supported by the technical file. |
| Vietnam – VAT | Decree 181/2025 amended by Decree 359/2025 and Decree 144/2026; Circular 69/2025/TT-BTC | Government / MOF | Decree144: 20 Jun 2026 | Conditions for export VAT; do not assume 0% automatically. |
| FTA / Origin | ATIGA, AHKFTA, ACFTA, VKFTA/AKFTA, CPTPP, RCEP | Agreement bodies + Vietnam implementing authorities | Current agreement/implementing rules | PSR, origin proof, direct-consignment and verification by route. |
| Destination – Hong Kong | Import and Export (Strategic Commodities) Regulations Cap. 60G + current control list | Hong Kong Trade and Industry Department | Control list updated periodically; 2025 amendment effective 30 May 2025 | Where an IC meets strategic-control parameters, import/export/re-export may require a licence. TID offers Pre-Classification Service. |
| Destination – Thailand/China/Korea/Malaysia | Official customs tariff + strategic/technical control list by final model/end-use | Destination customs / trade / technical authority | Review before Contract and before shipment | There is no single universal “Sensor IC licence”; final HS, product form and end-use must be locked before selecting the exact regulation. |
10. PRACTICAL 8-STEP E2E EXPORT WORKFLOW
Product review + market scan
Identify bare/packaged IC versus module, part number/revision, buyer, destination and end-use/end-user; use the Thailand/Hong Kong/China/Korea/Malaysia scan to choose the actual route.
Lock HS – policy – FTA/C/O
Use datasheet, block diagram and construction to select HS candidates; screen Decree259/Circular30; determine FTA/PSR for the selected market.
Contract + buyer requirements
Lock Contract/PO, Incoterm, payment term, model/spec, importer, CoC/material/traceability deliverables and the master data used across Invoice/PL/SI/C/O.
Complete compliance / regulatory work
Complete technical screening, licence if triggered, origin evidence, labels/marks and ESD/MSL packing plan.
Booking – packing – trucking
Choose Air/Sea; book cargo; verify ESD bag, MBB/desiccant/HIC where required, reel/tray/tube, insurance, trucking and cargo data.
Export customs declaration
Open the correct customs type; cross-check Invoice/PL/datasheet/origin; declare HS, part number, quantity, value and origin; handle inspection channel if triggered.
SI – VGM – CY/CFS / Air cargo cut-off – Loading
Sea: lock SI/VGM/CY/CFS; Air: AWB instruction, cargo cut-off and security acceptance; review Draft B/L/AWB.
Close post-shipment documents
Complete Final B/L/AWB, C/O/certificates where applicable, buyer/bank set, payment follow-up, claim/survey and origin/compliance archive.
11. PRE-ETD / CARGO READY / CUT-OFF TIMELINE
| Milestone | Items to lock | Documents/data | Typical owner | Delay risk |
|---|---|---|---|---|
| Before Contract/PO | Product scope, market/buyer requirement, end use, preliminary HS, FTA | Datasheet, buyer specs, destination/end user | Sales + Compliance + Engineering | Order accepted before control or buyer requirements are known. |
| Before Cargo Ready | Dual-use screening, origin file, markings, ESD/MSL plan, booking | Technical assessment, BOM/origin, packing spec | Compliance + Factory/QA + Docs | Finished goods without license/origin/packing evidence. |
| Before CY/CFS/Air cargo cut-off | Customs, trucking/gate-in, package/weight | Declaration, booking, cargo data | Ops + Customs + Forwarder | Missed cut-off, roll/rebooking, storage. |
| Before SI/VGM/AWB cut-off | Transport document data | SI/VGM or AWB instruction | Docs + Forwarder | Amendment/discrepancy/buyer rejection. |
| After on-board/departure | Final transport docs, C/O/certs, buyer/bank set, payment | On-board data, origin/cert file | Docs + Finance | Late documents, lost preference, L/C discrepancy, delayed cash collection. |
12. INCOTERMS – TRANSPORT – PACKING – COST
Air freight is common for high-value, low-weight Sensor ICs. For air shipments, FCA, CPT or CIP often align better with actual transport than using FOB by habit. FOB is a sea-shipment term and should only be used where the delivery/risk point is actually appropriate.
| Item | Operational guidance | Data to lock | Cost/risk |
|---|---|---|---|
| Air | High-value/urgent chips; manage AWB/cargo cut-off and security acceptance | Chargeable weight, packages, value, route | Airfreight, screening, handling, insurance. |
| Sea LCL/FCL | Bulk/non-urgent; strengthen moisture protection and consolidation controls | CBM/pallet, VGM if FCL, SI/CFS/CY cut-off | Local charges, storage, roll/rebooking. |
| ESD/MSL packing | ESD packaging; MBB/desiccant/HIC/vacuum where specified; protect reel/tray/tube | MSL, floor life, package type, lot, bake requirement | Moisture/ESD damage can cause major functional claims. |
| Insurance | Review by Incoterm and value density | Invoice value, coverage, exclusions | Tiny packages may carry very high value. |
13. RISKS & CONTROL POINTS
| Sensor IC × market risk | Root cause | Impact | Control | Timing |
|---|---|---|---|---|
| Bare IC declared as module, or vice versa | Generic trade name; missing image/BOM | Wrong HS, policy and buyer compliance | Technical classification memo + datasheet + product photo/BOM | Pre-contract |
| Vietnam strategic-control missed | HS-only review; technical parameters/end-use ignored | Licence gap / shipment hold | Decree259 + Circular30 screening; end-use/end-user questionnaire | RFQ/PO and before Cargo Ready |
| Hong Kong re-export without strategic-commodities screening | Hong Kong treated only as a logistics hub | Hong Kong licence/hold exposure | HK TID control list / Pre-Classification where needed | Before routing/booking |
| Wrong origin route for Thailand/China/Korea/Malaysia | C/O selected by habit; weak fab–assembly–test evidence | C/O rejection or verification | PSR matrix + Origin Audit Trail | Before production/C/O |
| Part number/revision mismatch | Buyer PO, factory datasheet and Invoice use different masters | Customs/buyer queries, C/O/cert mismatch | Single master part list | Before document issuance |
| ESD/MSL damage | Packing not aligned with datasheet/buyer spec | Electrical failure / claim | QA packing checklist, MBB/HIC/desiccant/ESD controls per spec | Before sealing |
| Missed Air cargo / SI-VGM cut-off | Policy/customs/packing handled too late | Roll/rebooking/storage/delay | Milestone owner + buffer | Before cut-off |
14. FAQ
1) Can Sensor ICs be exported from Vietnam?
Yes, where the actual model meets applicable policy. Do not conclude “freely exportable” before separating bare IC/module and screening Decree259/Circular30 plus end-use/end-user.
2) Is 8542.39.00 the default HS for Sensor IC?
No. 8542.39.00 and 8542.31.00 are candidates only for certain IC configurations; modules/PCBAs or sensor dies may fall elsewhere. Use datasheet, block diagram, construction and function.
3) For Thailand, Form D or RCEP?
Compare PSR and origin provability. ATIGA/Form D is commonly reviewed for ASEAN routes; RCEP is another route. Do not select a form before final HS and origin trail are locked.
4) For China, Form E or RCEP?
ACFTA/Form E and RCEP are both routes to review. Choose using the final-HS PSR, origin evidence, transport conditions and the buyer/importer ability to use the preference.
5) What is different about Hong Kong?
For technically sensitive models, screen Hong Kong Strategic Commodities Control. Hong Kong maintains its own control list and Pre-Classification Service; re-export routing does not automatically remove licensing.
6) Is C/O mandatory for South Korea or Malaysia?
Not for every shipment. Korea may involve VKFTA/AKFTA/RCEP; Malaysia may involve ATIGA/CPTPP/RCEP. Apply only where the buyer/importer needs it and the PSR can be substantiated.
7) Does a Sensor IC require a Vietnam dual-use licence?
Not every model. Compare the model with Circular30/2026 technical control entries and Decree259/2025 triggers, including catch-all/end-use/end-user screening.
8) Can samples/RMA skip policy review?
No. The commercial purpose may alter customs type/value, but HS, technical screening and strategic-control review still follow the actual goods.
9) Are buyer RoHS/CoC requests market-wide law?
Not automatically. Buyer requirements, destination law and FTA rules are separate layers. Mark each document as legal requirement or contractual deliverable.
10) Air or sea?
Air often fits high-value/light ICs and short deadlines; sea depends on volume and lead time. Both require ESD/MSL packing and cut-off control.
11) What remains after on-board?
Complete Final AWB/B/L, C/O/certificates where applicable, buyer/bank set, payment follow-up, claim file and Origin/Compliance Audit Trail. Do not close the job merely because the flight/vessel departed.
15. POST-SHIPMENT OUTPUTS & RECORD RETENTION
- Completed export declaration and customs file.
- Final AWB/B/L/Sea Waybill and proof of shipment.
- C/O/origin document and Origin Audit Trail where applicable.
- Dual-use license or technical screening/end-use file where relevant.
- Correct-revision datasheet, part/lot list, CoC/material/quality declarations as required by the buyer.
- Buyer/bank document set under Contract/L/C/payment term.
- Payment, debit/credit note, claim/survey documents if any.
- Lot-level archive for post-clearance, origin verification or customer audit.
SOLUTIONS FROM TGIMEX
This article locks the product logic, market scan, HS candidates, strategic-control screening, FTA/origin and Cargo Ready–cut-off–post-shipment milestones. A live shipment must still be reviewed against the part number, datasheet, buyer, end-use/end-user, destination market and effective-date rules.
Review product scope, market access, HS, policy, Decree259/Circular30, origin route and buyer requirements before shipment commitment.
Cross-check Invoice–Packing List–declaration–C/O–SI/VGM–AWB/B/L; coordinate booking, customs, ESD/MSL packing and milestone control.
For Sensor ICs with strategic-control or origin-verification exposure, do not wait until Cargo Ready to begin document review. An E2E approach improves control of schedule, documents and compliance from pre-contract through post-shipment.
