EXPORTING SMART METERS FROM VIETNAM

A smart meter should not be treated as merely an electronic device with added connectivity. Meter type, accuracy class, direct/CT connection, RF band, firmware and billing use can change HS classification, legal metrology, radio compliance and buyer documentation.

This guide first scopes smart electricity meters, uses actual HS-902830 trade data to select Hong Kong, China, Japan and Australia, then connects Market Access with HS, origin/FTA, compliance, Cargo Ready, cut-offs and post-shipment controls.

Market data: WITS/UN Comtrade, reporter Vietnam, year 2023, HS H0 902830 (HS 1988/92). The dataset is used only as a market-selection signal for the electricity-meter family; the current Vietnam 8-digit HS still requires exact-model classification. Do not copy these conclusions to smart water/gas meters, standalone gateways/modules or parts. Not an official legal translation.

1. QUICK FACTS

MARKETS

Hong Kong · China · Japan · Australia

WITS 2023: Vietnam exported HS 902830 worth about US$47.79m; Hong Kong US$18.25m, China US$14.90m, Japan US$7.33m, Australia US$3.79m.

VIETNAM POLICY

Standard smart electricity meters are generally commercial exports; exact model, wireless, cryptographic/security functions, battery/power and end-use still require screening. Wireless does not automatically mean dual-use.

HS – DUTY – VAT

Reference HS 9028.30.10

Strong reference for kWh meters whose core function is energy metering. 9028.30.90 covers other electricity meters; water/gas meters and parts require separate classification.

ORIGIN / FTA

Hong Kong: AHKFTA/Form AHK. China: RCEP/ACFTA. Japan and Australia: CPTPP/RCEP; Australia also AANZFTA. Lock the PSR against the actual route.

SPECIALIZED

China: P+V legal metrology plus radio approval when triggered. Japan: Measurement Act verification. Australia: NMI pattern approval/verification and possible ACMA/RCM. Hong Kong: OFCA by band/equipment.

ETD / CUT-OFF

Lock approval scope, exact model, communication module, marking and utility/buyer requirements before Cargo Ready; manage SI/VGM/CY/CFS against the actual booking.

TRANSPORT

Air/express for samples, pilots and replacements; Sea LCL/FCL for project volume. Lithium batteries, standalone modems and wooden crates require separate screening.

QUICK GLOSSARY: Smart meter = metering device with data recording/communications; legal metrology = statutory measurement control; type/pattern approval = approval of a design/type; verification = confirmation of individual/batch conformity; Market Access = destination entry requirements; PSR = Product Specific Rule; RVC = Regional Value Content; CTSH = change in tariff subheading; Cargo Ready Date = goods-ready date; SI/VGM Cut-off = carrier-instruction/verified-gross-mass deadline.

2. SCOPE & SMART-METER CLASSIFICATION

Main scope: complete smart electricity meters / smart kWh meters, including models with PLC, RF mesh, Wi-Fi, cellular, NB-IoT, LoRa/LoRaWAN, Zigbee or wired/digital communications. HS 902830 market data is therefore a proxy for the electricity-meter family, not proof that every traded unit is “smart”.

Variant What to check Evidence Possible HS/compliance Note
Smart kWh meter, 1P/3P Active-energy kWh; display; tariff register; communications Datasheet, wiring, metrology spec, protocol Review 9028.30.10; destination metrology + RF/EMC when triggered Main scope.
Multi-function electricity meter kWh + kvarh, demand, TOU, load profile Function matrix, accuracy class, register list Review 9028.30.10/90 by core function Do not classify by “smart” alone.
Wireless meter RF mesh, Wi-Fi, cellular, NB-IoT, LoRa, Zigbee RF band/power, module ID, antenna, firmware MIIT / Japan radio / ACMA / OFCA when triggered Separate radio from legal metrology.
Prepaid / disconnect meter Relay switching, prepaid token, remote disconnect Circuit/block diagram, control logic Confirm metering remains the principal function Do not confuse with control equipment.
Smart water meter Measures water/flow Meter body, flow range, medium HS 9028.20; different Market Access Separate conclusion.
Smart gas meter Measures gas Meter body, flow conditions HS 9028.10; different Market Access Separate conclusion.
Standalone gateway/module No metrology core; data transmission only BOM, RF/module spec, interfaces Do not default to 9028.30; classify standalone function Separate from finished meter.
Parts / housing / PCB Incomplete meter BOM, drawing, assembly status Review 9028.90 or another heading Do not use finished-meter HS.
DESCRIPTION CONTROL: lock electricity/water/gas; 1P/3P; AC/DC; kWh/kvarh/demand; accuracy class; rated voltage/current; direct/CT connection; protocol/band; relay; battery; security/cryptography; model; firmware; end-use and finished/module/parts status.

3. EXPORT MARKETS & MARKET ACCESS

3.1. MARKET SCAN – NO DEFAULT US/EU LIST

WITS/UN Comtrade reports Vietnam’s 2023 exports under HS H0 902830 (HS 1988/92) at about US$47.785 million and 717,134 items. The first four destinations are Hong Kong, China, Japan and Australia. Since HS 902830 covers electricity meters generally, this dataset identifies commercially relevant routes rather than a pure “smart-meter-only” market size.

Market 2023 trade signal Fit Market-access condition Product/business requirement Documents/data to prepare
Hong Kong, China US$18.25m; 273,952 items High Wireless variants require exact band/power, licensing/class-licence and HKTEC/OFCA review by equipment type; there is no single mandatory certificate for every wireless meter. Keep utility/buyer acceptance separate from statutory obligations; lock protocol, cybersecurity, marking and the RF variant for the market. RF band/power, module ID, technical file, marking/label, utility/buyer specification and certification evidence where the exact equipment falls in scope.
China US$14.90m; 223,597 items High Electric energy meters used for trade settlement are in mandatory metrology mode P+V; imported measuring instruments within type-approval scope require imported type approval. Wireless may separately trigger MIIT model approval. Exact meter type, accuracy class, rated V/A, direct/CT configuration, trade-settlement use and RF parameters must match the approval scope. Type-approval file, verification evidence/plan, Chinese technical description, RF/module records, model/serial list and utility/buyer specification.
Japan US$7.33m; 110,052 items High Meters used for transaction/proof require a valid verification or conformity mark under Measurement Act Art.16; radio functions require a separate exact-equipment review. Lock type/family, accuracy, mark validity, hardware/firmware revision and utility specification; JEMIC type approval is not a universal import licence. Verification/type records, model-family mapping, RF technical file if applicable, marking/label and utility/buyer acceptance records.
Australia US$3.79m; 56,870 items Medium-high Specified electricity meters used for trade within scope must be pattern approved and verified. NMI states that electricity meters installed from 1 Jan 2013 and measuring <750 MWh/year fall within the rule; wireless variants may separately trigger ACMA/RCM. Map the exact model/firmware to the approved pattern; identify the verifier and responsible supplier where applicable; keep metrology separate from radio/electrical compliance. Pattern-approval certificate, verification records, serial mapping, RF/EMC evidence, supplier records and buyer/project specification.
MARKET-SELECTION CONCLUSION: no one market is dominant enough to force a one-market H1. Hong Kong is the largest reported destination, but destination data does not prove final consumption. Deep SEO/regulatory work should split Smart Meter × China, × Japan, × Australia and × Hong Kong.

3.2. CHINA – LEGAL METROLOGY BEFORE CARGO READY

SAMR’s mandatory catalogue lists electric energy meters used for trade settlement under P+V. Current imported-measuring-instrument rules require type approval where the product is within the approval scope. If the meter has radio transmission, metrology approval does not replace radio approval: MIIT manages model approval for radio transmitting equipment within scope, with separate micro-power SRD routes/exceptions.

3.3. JAPAN – VERIFICATION / TYPE FAMILY

METI states that electricity meters used for transaction or proof must carry a valid verification mark or conformity mark under Measurement Act Article 16. JEMIC conducts type approval for mass-produced meters and verification; type approval should not be described as a universal import licence outside the applicable legal-metrology use case.

3.4. AUSTRALIA – PATTERN APPROVAL + VERIFICATION

NMI requires specified electricity meters used for billing/trade to be pattern approved and verified within scope. Map the exact model to the certificate/pattern and verifier before project shipment. Wireless smart meters may separately trigger ACMA technical standards, responsible-supplier records and RCM requirements.

3.5. HONG KONG – RF + UTILITY/BUYER SPEC

OFCA regulates radiocommunications by band, output power, licensing and certification scheme. Some Bluetooth/RFID/SRD routes are licence-exempt/class-licensed with voluntary certification. Do not state that every wireless smart meter needs the same OFCA certificate; check the exact RF technology and utility/buyer acceptance requirements.

4. VIETNAM EXPORT POLICY

Scenario Possible control Basis Authority Trigger
Standard smart electricity meter Ordinary commercial export; screen current prohibited/restricted/licensed lists Foreign Trade Management Law; Decree 69/2018 through 4 Sep 2026; Decree 292/2026 from 5 Sep 2026 Customs / specialized authority if triggered HS, exact model, function, condition, end-use
Wireless / security / cryptographic function Strategic-trade screening; not automatically dual-use Decree 259/2025; Circular 42/2026/TT-BCT from 12 Sep 2026 MOIT / competent authority Specification/end-use intersects a controlled list
Sample/RMA/warranty/used Review customs regime, value, ownership and condition Current customs/foreign-trade rules Customs Transaction purpose/condition
Meter + external battery/radio module Separate DG/transport and module-classification review Transport/HS rules by actual item Carrier/Forwarder/Customs Battery chemistry; separately shipped module
OLD → NEW: Decree 292/2026/ND-CP, issued 22 Jul 2026, takes effect 5 Sep 2026 and replaces Decree 69/2018. Circular 42/2026/TT-BCT, issued 29 Jul 2026, takes effect 12 Sep 2026; it was not yet effective on 28 Aug 2026.

5. HS CODE – EXPORT DUTY – EXPORT VAT

5.1. REFERENCE HS BY VARIANT

Variant Reference HS Basis Evidence
Smart electricity meter measuring kWh 9028.30.10 Heading 90.28 → electricity meters → kilowatt-hour meters Datasheet, rated V/A, 1P/3P, direct/CT, registers, communications
Other electricity meter 9028.30.90 Other branch of electricity meters Exact function, catalogue
Parts/accessories Review 9028.90 at 8 digits Not a complete apparatus BOM, drawing, assembly status
Smart water / gas meter 9028.20 / 9028.10 Different measured medium Meter structure, medium
Standalone gateway/module Reclassify Principal function may be communications RF/module spec, interfaces, BOM
DO NOT CLASSIFY BY “SMART”: 9028.30.10 is a strong reference for kWh meters and 9028.30.90 for other electricity meters. Integrated communications do not automatically change the heading if the principal function remains metering, while standalone modules and water/gas meters require separate analysis.

5.2. EXPORT DUTY

CONCLUSION: do not mechanically state “0%”. Confirm the final 8-digit HS and check Annex I – Export Tariff of Decree 26/2023/ND-CP and effective amendments.

LEGAL BASIS: Decree 26/2023/ND-CP, effective 15 Jul 2023; review Article 4 and Annex I.

EXECUTION: retain the technical classification file, exact model/spec and tariff check used on the declaration date.

5.3. EXPORT VAT

CONCLUSION: qualifying exports may use 0% VAT only when statutory scope and evidence conditions are met.

LEGAL BASIS: Decree 181/2025/ND-CP, effective 1 Jul 2025; Articles 17–18.

EXECUTION: review Contract/PO, Invoice, qualifying payment evidence, customs declaration and shipment records.

14. FAQ

1. What “Smart meter” does this article cover?

Mainly smart electricity meters / smart kWh meters. Smart water and gas meters require different HS, Market Access and legal-metrology analysis.

2. Is HS 9028.30.10 automatic for every smart meter?

No. It is a strong reference for kWh meters; verify the metering function, construction and finished/module/parts status.

3. Why Hong Kong, China, Japan and Australia?

WITS/UN Comtrade 2023 lists them as the first four destinations for Vietnam-reported HS902830 exports. This is an electricity-meter proxy, not a smart-only dataset.

4. Does a smart meter exported to China require type approval?

Where an imported measuring instrument falls within a P/P+V approval scope, import type approval applies. Electric energy meters used for trade settlement are listed as P+V; exact model/use must be confirmed.

5. Does wireless add a China MIIT requirement?

Potentially. Radio transmitters within scope require model approval; micro-power SRD routes/exceptions must be checked by exact band/equipment.

6. Is JEMIC type approval mandatory for every meter entering Japan?

For transaction/proof use, the key statutory gate is a valid verification/conformity mark under Measurement Act Art.16. Type approval is important for mass-produced meter verification, but is not a universal import licence.

7. What must be ready for trade-use meters in Australia?

Within NMI scope, the meter design must be pattern approved and the meter verified. Map the exact model, certificate and verifier before shipment.

8. Does every Hong Kong wireless smart meter need an OFCA certificate?

No universal answer. OFCA requirements depend on frequency/equipment/licensing scheme; some SRD routes use voluntary certification.

9. CPTPP or RCEP for Japan/Australia?

Compare tariff and PSR. CPTPP 9028.30 offers heading-change or RVC 40/50/65 methods; RCEP uses CTSH or RVC40.

10. What must be archived after shipment?

Customs, final transport docs, origin audit trail, market approval/verification/radio files, model–serial records, buyer/bank, payment and claim records.

15. POST-SHIPMENT OUTPUTS & RECORDS

  • Completed export declaration and technical classification file.
  • Final B/L, Sea Waybill or AWB.
  • C/O/proof of origin and Origin Audit Trail where preference is claimed.
  • China import type approval/verification; Japan verification/type records; Australia pattern approval/verification; Hong Kong OFCA/radio records when triggered.
