IMPORT PROCEDURES FOR COMPACT FLUORESCENT LAMPS

Compact fluorescent lamps (CFL) are often described simply as “compact”, “CFL lamp” or “energy saving lamp” on commercial documents, while customs treatment depends on whether the product is a complete CFL with built-in ballast, a tube for compact lamps, its wattage range, energy-efficiency compliance and actual HS classification. For the product covered in this article, the importer should confirm the model, intended use, construction or composition, new/used condition, and technical documents before concluding the HS code, tax treatment, or specialist policy. The following sections organize the main controls from document receipt, catalogue and label review through dossier preparation, declaration, and coordination at the port of entry.

Wrong HS classification, missing energy-efficiency documents, inconsistent model descriptions between catalogue and labels, or importing models below minimum energy performance requirements may trigger document requests, customs inspection, denial of preferential C/O treatment, DEM/DET exposure and delivery delay.

This article provides an E2E (End-to-End) review map before ETA: HS code, duties, specialized policy, customs documents, clearance process and key risks to block before arrival.

QUICK FACTS

Review pointOperational recommendation
Controlled goods nameState compact fluorescent lamp/CFL, built-in ballast status, wattage, voltage, model, brand, quantity and origin.
Main HS reference8539.31.30 for compact fluorescent lamps with built-in ballast; review 8539.31.10 if the goods are tubes for compact lamps.
Duty referenceCommon MFN for 8539.31.x0: 25%; ordinary duty reference: 37.5%; base VAT 10%, possibly 8% under VAT reduction if not excluded.
Core complianceReview minimum energy performance requirements, energy labeling and technical test reports if the model is covered.
Minimum technical documentsCatalogue/datasheet, model list, original label, wattage, voltage, applicable standard and energy-efficiency test report if required.
Legal note: HS codes, taxes and specialized policies are for dossier preparation only. For an actual shipment, review the product against catalogue, datasheet, model, label, origin, C/O and tariff schedule at declaration date.

SCOPE OF APPLICATION

This article applies only to compact fluorescent lamps (CFL), normally fluorescent discharge lamps in compact/twisted shapes, with or without built-in ballast, used for household or commercial lighting.

  • Do not apply this procedure automatically to LED lamps, linear fluorescent lamps, separate ballasts or complete luminaires.
  • Do not group complete CFLs with built-in ballast and separate fluorescent tubes under one conclusion.
  • Samples, warranty goods, project goods, used/refurbished items or goods imported by EPE/FDI entities may require separate review.
  • Review according to catalogue, datasheet, model and actual import purpose.

CLASSIFICATION & TECHNICAL IDENTIFICATION

Technical identity

CFLs normally use low-pressure mercury vapor discharge and phosphor coating. Determine whether the product has a built-in ballast or is only a separate tube.

Required specifications

Model, wattage, voltage, frequency, cap type, luminous flux, color temperature, lifetime, standards, brand and intended use must match all shipment documents.

HS CODE – DUTY – C/O

The main classification basis is lighting function, fluorescent discharge principle and whether the product is complete with built-in ballast. Do not use LED or separate ballast HS codes for CFLs.

APPLICABLE SPECIALIZED POLICIES

Operational note: For compact fluorescent lamps/CFL, review Decision 1182/QD-BCT, Decision 1725/QD-BCT, Circular 52/2025/TT-BCT and TCVN 7896:2015 together. The key is to confirm the model, wattage, integrated ballast status and the 5 W–60 W scope if energy-performance inspection applies.

FAQ

QuestionShort answer
Do CFL imports require a permit?Do not conclude by name only. Review model, wattage, energy performance, label and import purpose.
Is energy labeling required?Potentially yes. Review Decision 14/2023/QD-TTg, Circular 52/2025/TT-BCT, Decision 1725/QD-BCT and applicable TCVN.
What is the main HS code? For CFL with built-in ballast, reference code is usually 8539.31.30. Separate tubes require separate review.
What is the MFN rate?Common MFN for 8539.31.x0 is 25%; ordinary duty reference 37.5%; verify at declaration date.
Can C/O reduce duty?Yes, if the C/O is valid, correct in form, origin criteria, description and FTA tariff line.
Is “energy saving lamp” sufficient on invoice? No. Use Compact Fluorescent Lamp/CFL, model, wattage, voltage and built-in ballast status if applicable.
Are samples processed like commercial goods?Purpose may affect dossier, but HS, labeling and specialized policy still need review.

IMPLEMENTATION SUPPORT FROM TGIMEX

This article provides a review map for HS code, taxes, documents and specialized policy for compact fluorescent lamps. For actual shipments, enterprises should still verify catalogue, datasheet, model, documents, origin and import purpose.

Coordination capability

  • Agent network in over 60 countries.
  • Member of WCA, WCA China Global, VLA, HNLA.
  • Sea, air, road and rail logistics capacity.

Support scope

  • Pre-ETA review of HS, duty, C/O, labels and energy performance.
  • Control of Invoice, Packing List, B/L/AWB, catalogue and test reports.
  • Customs declaration, channel handling, domestic delivery and dossier archiving.

Enterprises should not wait until cargo arrival to review documents where specialized policy, C/O or labeling is involved. Small inconsistencies between Invoice, Packing List, catalogue, datasheet, C/O or labels may cause additional document requests, clearance delay or unplanned storage costs.
