IMPORT PROCEDURE GUIDE FOR BALLASTS

Ballasts are often declared too generally as “power supplies”, “LED drivers” or “lighting parts”, while the actual technical nature may change HS classification, import duty, energy-efficiency requirements, C/O eligibility and labelling obligations. This article provides an E2E (End-to-End) review map before ETA: identify the correct ballast type, confirm HS code, review duties, align documents and reduce the risk of additional customs explanations.

SCOPE OF APPLICATION

This article applies only to standalone ballasts imported for stabilising current and controlling the start-up/operation of discharge lamps, discharge tubes or fluorescent lamps according to technical documentation.

It does not automatically apply to LED lamps, straight fluorescent tubes, compact fluorescent lamps with integrated ballasts, LED drivers/LED power supplies, transformers, adapters or multi-purpose electronic components. Review by catalogue, datasheet, model and actual import purpose is required.

CLASSIFICATION & PRODUCT IDENTIFICATION

Electromagnetic ballast

Generally uses an inductive core/coil and is used for fluorescent lamps; review the 4 W to 65 W scope where TCVN 8248:2013 is relevant.

Electronic ballast

Uses an electronic circuit for fluorescent lamps; review input voltage, frequency, compatible lamp wattage and TCVN 7897:2013.

LED driver / LED power supply

Not automatically a ballast. If the catalogue states LED driver, constant current power supply or switching power supply, review 8504.40.x or another suitable code.

Integrated ballast in a lamp

If the imported item is a complete compact lamp, LED lamp, luminaire or lighting product with integrated ballast, HS and policy may shift to lamp/luminaire headings. Do not declare it as a standalone ballast if the goods are complete products.

HS CODE – DUTIES – C/O

HS classification must be based on the technical nature, not only the commercial name. For standalone ballasts for discharge lamps or tubes, the reference HS is 8504.10.00. If the goods are LED drivers, LED power supplies, transformers, rectifiers or complete lamps/luminaires, do not use this code by default.

8504.10.00Ballasts for discharge lamps or tubes; may include electromagnetic/electronic fluorescent lamp ballasts where supported by technical files.Misdeclaring as LED driver/power supply may cause wrong duty, wrong energy policy and C/O mismatch.Catalogue, datasheet, label photo, model list, application diagram.
8504.40.xConsider only where the actual goods are power supplies/LED drivers/static converters, not ballasts for discharge lamps/tubes.Wrongly shifting from 8504.10 to 8504.40 may affect duty and specialized policy.Datasheet showing constant-current/constant-voltage LED output, not fluorescent lamp use.
8539.31.x / 9405.xConsider where the goods are complete lamps/luminaires or compact lamps with integrated ballasts.Separating components from complete products may be inconsistent with actual goods.Invoice, packing list, product photos, packing configuration.

Ordinary import duty22.5%Indicative where MFN/FTA treatment is not available; calculated on the basis of 150% of the 15% MFN duty.Ordinary tariff list, origin country, MFN eligibility.
MFN import duty15%Applicable where goods originate from a country/territory entitled to MFN treatment and HS classification is correct.C/O if any, origin evidence, invoice, packing list, catalogue.
Special preferential FTA dutyMay be lower than MFN, in many cases 0% if the applicable FTA schedule for 8504.10.00 allows.Depends on origin country, agreement, year, C/O form and origin criteria. Not automatic where C/O is incorrect or HS/description differs.Relevant C/O Form D/E/AK/AJ/VJ/VC/EVFTA/CPTPP/RCEP, direct transport evidence, third-party invoice where applicable.
Import VAT10% according to Vietnam Trade PortalDeclare according to the VAT schedule/customs system on the declaration date. If a temporary VAT reduction policy applies, review exclusions before use.Declaration, effective VAT policy, product description, HS.
Trade remediesNot treated as a default item in this guideOnly applies if a trade remedy decision is issued for a specific origin/manufacturer.Check current trade remedy decisions before large-volume imports.
C/O scenarioTax treatmentCommon riskHow to check
No preferential C/O but MFN conditions metUsually declare MFN 15%.No proof for special preference; origin evidence may still be requested.Review export country, declared origin, invoice/packing list.
Valid FTA C/OMay claim the special preferential rate under the relevant agreement schedule.C/O indicates different HS, description says “LED driver” while declaration says ballast; origin criterion or direct transport is not met.Cross-check C/O, invoice, packing list, catalogue and declaration.
Retroactive C/O / third-party invoiceMay still be considered if permitted by the relevant FTA.Missing “issued retroactively”, missing third-party invoice country or stamp/signature mismatch.Review the specific FTA rules, C/O issue date, invoice information and transport documents.

FAQ – COMMON BUSINESS QUESTIONS

Which HS code applies to imported ballasts?

The reference code is 8504.10.00 where the goods are ballasts for discharge lamps or tubes. If the item is an LED driver or LED power supply, another HS branch must be reviewed.

What are the import duties?

For HS 8504.10.00, reference MFN duty is 15%, VAT is 10%, and ordinary duty is approximately 22.5%. FTA rates may be lower if a valid C/O and tariff schedule support the claim.

Is energy-efficiency testing required?

It may be required where the model falls under the MOIT list and TCVN 8248:2013 or TCVN 7897:2013. Review product type, wattage and compatible lamp type.

Can C/O reduce duty?

Possibly, but not automatically. The C/O must have the correct form, HS/description, origin criterion, direct transport and be consistent with commercial documents.

Is an LED driver the same as a ballast?

Not automatically. LED drivers are usually LED power supplies/static converters and require separate HS and policy review.

What is the risk of writing “lighting parts” on invoice?

A generic description may lead customs to request catalogue, HS explanation and specialized policy documents. Use a clear technical description such as “ballast for discharge lamps/tubes, model…, power…”.

TGIMEX EXECUTION SOLUTION

This article provides a map of HS code, duties, C/O, documents and specialized policies for ballasts. In an actual shipment, the enterprise still needs to review catalogue, datasheet, model, commercial documents, origin and import purpose.

For shipments involving energy-efficiency testing, C/O or labelling requirements, the enterprise should not wait until cargo arrival to start dossier review. Any mismatch among invoice, packing list, catalogue, datasheet, C/O or labels may trigger additional documentation, clearance delay or unexpected storage cost.

Pre-ETA review

HS, specialized policy, C/O, duties, labelling and catalogue/datasheet/model.

Compliance dossier control

Cross-check invoice, packing list, B/L/AWB, C/O, test report, labels and technical files.

E2E clearance execution

Coordinate international freight, customs declaration, channel handling, domestic delivery and post-clearance records.
