VIETNAM POLICY

New industrial spinning machinery for ordinary textile production generally follows standard export customs after policy screening. Current framework: Decree 292/2026/ND-CP.

Main direction 8445.20; Vietnam splits 8445.20.10 electric and 8445.20.20 non-electric. Export duty must be checked under the final HS; 0% VAT is conditional.

2. PRODUCT SCOPE & DETAILED CLASSIFICATION

This guide covers machinery whose primary function is spinning textile fibres into yarn. Heading 84.45 also includes fibre-preparation, doubling/twisting and winding equipment, so the term “spinning line” is not sufficient for classification.

CLASSIFICATION GATE: 8445.20 is for textile spinning machines. Fibre preparation, roving, twisting, winding and separate parts have their own branches. A scope error propagates into HS, PSR, C/O and buyer documents.

THREE DIFFERENT LAYERS: destination law, FTA conditions and buyer specifications are not the same. FAT/SAT, commissioning protocols or spare-parts kits requested by a buyer are not automatically market-wide legal obligations.

4. VIETNAM EXPORT POLICY

For new industrial spinning machinery, the correct approach is an exact-model policy screen rather than an automatic “no permit required” statement. From 05 Sep 2026, Decree 292/2026/ND-CP is the current direct implementing framework for the Foreign Trade Management Law and replaces Decree 69/2018.

OLD → NEW: Decree 292/2026 takes effect on 05 Sep 2026 and replaces Decree 69/2018. Existing ministerial guidance issued for Decree 69 may continue through 31 Dec 2026 unless replaced/repealed earlier; complete dossiers accepted before 05 Sep 2026 continue under the rules applicable when received.

5. HS CODE – EXPORT DUTY – EXPORT VAT

Heading 84.45 is function-based. For a true spinning machine, HS6 is 8445.20; Vietnam then splits electric and non-electric operation. Do not apply 8445.20 to an entire “spinning line”.

6. C/O – FTA – RULES OF ORIGIN

Spinning machines can contain imported motors/servos, spindles/rotors, inverters, PLC/HMI, PCB, sensors, bearings and pneumatic modules. Origin must therefore be reviewed from the BOM and supplier evidence before Sales promises a tariff preference.

AIFTA note: the general rule combines minimum 35% RVC and CTH, but any applicable product-specific rule prevails for the relevant HS line.

India is a large import market, but the 2024 Machinery & Electrical Equipment Safety OTR must not be used as a blanket current requirement: India’s Ministry of Heavy Industries published its withdrawal on 16 Jan 2026.

For new machinery used in ordinary textile production, the route is generally standard export customs after policy screening. Exact model, condition, end-use/end-user and Decree 292/2026 still need to be checked.

What HS code applies to spinning machines?

The HS6 direction is 8445.20. Vietnam splits it into 8445.20.10 electric and 8445.20.20 non-electric.

Does a roving frame use 8445.20?

Not automatically. Drawing/roving machines have a separate branch, 8445.13. Use the machine’s primary process function.

Do doubling/twisting and winding machines share the spinning-machine code?

No. Doubling/twisting is directed to 8445.30; winding/reeling to 8445.40.

Can export duty be stated as a fixed 0%?

Do not assume so. Lock the 8-digit HS and review the current Export Tariff; if the code is not listed, apply Article 4(1) of Decree 26/2023.

Is export VAT automatically 0%?

No. 0% is a conditional rate tied to the transaction and required export/payment evidence under current VAT law.

Is SNI mandatory for spinning machines entering Indonesia?

Not simply because SNI 08-3319-1994 is active in the BSN catalogue. Check the current compulsory-SNI/technical scope for the exact model and obtain importer confirmation.

Does India still require the 2024 OTR?

Do not use the 2024 OTR as a blanket rule. MHI published its withdrawal on 16 Jan 2026; screen current QCO/BIS orders by exact model/component.

Does an EU-bound spinning machine need CE?

Machinery within scope must follow the applicable machinery-conformity route. As of 06 Oct 2026, Directive 2006/42/EC remains through 19 Jan 2027; Regulation (EU) 2023/1230 applies from 20 Jan 2027.

What ATIGA PSR applies to HS 8445.20?

The HS2022 ATIGA PSR shows RVC40 or CTSH. Shipment-specific documentary and transport conditions still need to be met.

How are used/refurbished spinning machines different?

Use a separate conclusion. Check destination used-machinery rules, year/serial/condition/valuation and inspection evidence. Vietnam rules for importing used machinery do not automatically govern exports.

What should be archived after shipment?

Final transport docs, C/O/proof, customs file, buyer/bank docs, payment, compliance file, packing/lifting evidence and Origin Audit Trail sufficient to reconstruct the shipment later.

A shipment is truly closed only when another person can reconstruct which machine moved, why the HS was chosen, which BOM/origin version applied, which compliance route was used and how the machine was packed/lifted/lashed.

  • Completed export declaration + Invoice + Packing List + customs support file.
  • Final B/L/AWB/Sea Waybill; SI/VGM and carrier milestone record.
  • C/O/proof + BOM, supplier evidence, production records and RVC/PSR working file where applicable.
  • Indonesia/India/EU compliance file for the exact model, including importer confirmation/test/declaration/manual where applicable.
  • Packing evidence: final dimensions, GW/NW, CoG/lifting marks, crate/steel frame, lashing and stuffing/seal photos.
  • Buyer/bank docs, payment, debit/credit note and claim/survey if any.
  • Change log for model/BOM/supplier/certificate/packing versions used for the shipment.

RECOMMENDED OPERATIONAL CONTROL

For spinning machinery, control the shipment through product scope → market access → HS/policy → BOM/origin → market compliance → packing/booking → customs/cut-off → post-shipment archive.
