LASER CUTTING MACHINE EXPORT PROCEDURE

A “laser cutting machine” may be a fiber-laser metal cutter, a CO₂ non-metal cutter, a CNC machine with an integrated laser source, a PCB-dedicated machine, or a multi-module line. Before shipment, lock the operating principle, application, exact configuration, technical specifications and end-user/end-use; otherwise HS classification, strategic-trade screening and destination-market compliance may be applied incorrectly.

EVFTA, ACFTA/RCEP and Japan-related FTAs may be relevant by route. Preference depends on the PSR and origin audit trail, not merely on having a C/O.

4. VIETNAM EXPORT POLICY

Conclusion

Ordinary industrial laser cutting machines are not automatically prohibited, restricted or licence-controlled merely because they use a laser or have high output power.

Strategic-trade screening

Under Article 7(3) of Decree 259/2025/ND-CP and Article 2 of Circular 30/2026/TT-BKHCN, an item is treated as falling within the detailed controlled list only when its HS code + description + technical/technology characteristics match simultaneously. HS 8456.11, the word “laser”, wavelength, CW/pulse mode or output power alone is not a sufficient legal conclusion.

Catch-all: Article 4(3) of Decree 259/2025 requires escalation where there are grounds to suspect WMD-related end-use or a designated end-user, even when the item is outside the detailed list.

Execution

Classify the complete machine first, then screen any separately shipped source/module/component and retain the technical comparison, end-user statement and end-use review. If the three-part list criteria or catch-all condition is triggered, complete the competent-authority procedure before shipment.

Export duty

Under Article 4(1) of Decree 26/2023/ND-CP, where the exported good is not named in the Export Tariff, the corresponding 8-digit HS code is declared and no export-duty rate is declared on the export declaration. Decree 201/2026/ND-CP amended selected export-duty rates from 23 July 2026, so the tariff in force on the filing date must still be checked.

VAT on exports

Do not state “all exports are VAT 0%”. Apply the 0% rate only when the transaction falls within the eligible export scope and the statutory contract, payment and customs/export evidence are satisfied.

The obsolete 8456.11.00 structure should not be used for current Vietnam AHTN 2022 declarations; distinguish 8456.11.10 from 8456.11.90 by actual use and technical file.

Laser sources, CNC controllers, servo systems, chillers and cutting heads are often imported inputs. Build the origin file from BOM → supplier origin → consumption/production records → PSR/RVC calculation, rather than assuming final assembly in Vietnam establishes preferential origin.

Small machines may move by FCL/LCL; large high-power machines often require FCL, open-top or flat-rack. Air freight is generally reserved for high-value modules/parts or urgent replacement shipments.

  • Use anti-vibration and moisture protection; secure moving axes/table, optics/cutting head, chiller and control cabinet.
  • Confirm center of gravity, lifting points, fork pockets and sling limits.
  • Clarify OOG crane, survey, lashing, terminal and special-equipment charges under the Incoterm.
  • Screen gas cylinders, refrigerant, batteries/UPS and chemicals separately for DG acceptance.

14. FAQ

Can laser cutting machines be exported from Vietnam?

Usually yes, subject to model/spec/end-use review and strategic-trade controls. If the exact item falls in a licensed dual-use list, obtain the licence before shipment.

What HS code is commonly used?

8456.11.90 is a common candidate for other industrial laser-operated machine tools; 8456.11.10 may apply to equipment solely/principally used for specified electronics manufacturing.

Can I still use 8456.11.00?

No. Vietnam’s AHTN 2022 nomenclature split the old code into detailed subheadings such as .10 and .90.

Is every high-power fiber laser dual-use?

No. High power or fiber technology alone does not make the machine licence-controlled. Detailed-list control requires a simultaneous match of HS code, description and technical/technology characteristics; Decree 259 catch-all screening still applies to WMD or designated-end-user red flags.

Is CE needed for the EU?

Machinery placed on the EU market must follow the applicable machinery conformity regime and related electrical/EMC rules. Regulation (EU) 2023/1230 applies from 20 Jan 2027.

What is special about US laser imports?

A laser cutting machine entering the US should normally be reviewed against 21 CFR 1040.10. Section 1040.11 applies only when the product falls within the relevant specific-purpose laser category. Depending on the case, the foreign manufacturer/importer may need product-report/accession information, certification labels and FDA 2877 import documentation.

Is a C/O mandatory?

Not for every shipment. A buyer may request origin proof for preference or commercial/import purposes. EU, China and Japan have potentially relevant FTA routes if the machine satisfies the selected agreement’s PSR and documentary conditions.

Can a disassembled machine be declared under one HS?

Sometimes, where classification rules treat the presented set as a complete/incomplete machine with the essential character, but this must be reviewed before declaration.

What about used/RMA equipment?

Commercial, valuation, customs-regime and re-import/re-export logic can differ. Separate the scenario from new-sale shipments.

What must be final before booking?

Package dimensions, GW/NW, center of gravity, lifting points, OOG status, packing material, DG screening, Cargo Ready Date and carrier cut-offs.

What records should be archived after shipment?

Customs declaration, final transport docs, origin file, compliance certificates, dual-use/end-use screening, payment records and any claim/commissioning handover.

Can one certificate cover similar models?

Only when the certificate/test scope expressly covers the model family and technical configuration. Do not infer coverage from branding or appearance.
