GUIDE TO PRODUCT LABELING / SUPPLEMENTARY LABELING FOR IMPORTED F&B

For imported F&B goods, labeling is not merely packaging. Incorrect product name, ingredients, net quantity, manufacturing date, expiry date, origin, allergen warning, storage instruction or responsible party may trigger document supplementation, delayed market circulation, storage costs and post-clearance audit risks. This article provides an E2E map for reviewing original labels, Vietnamese supplementary labels, food-safety dossiers, HS code, C/O and post-clearance obligations.

INTRODUCTION: WHY F&B LABELING MUST BE REVIEWED BEFORE ETA

For food and beverages, labeling connects import documents, food-safety dossiers, origin, product information and market-circulation obligations. A small label inconsistency may lead to questions about product name, ingredients, product declaration, C/O or storage conditions.

Before ETA

Collect original labels, artwork, COA/specification, ingredients, net quantity, MFG/EXP, storage conditions and declaration dossiers.

During customs clearance

Cross-check Invoice, Packing List, B/L/AWB, HS, C/O, original label and food-safety dossier to reduce document queries.

Before market circulation

Complete the Vietnamese supplementary label before sale, display or distribution in Viet Nam.

After clearance

Product label

Information shown on packaging, container or accompanying documents to identify goods and responsible entities.

Supplementary label

A Vietnamese label showing mandatory contents for imported goods when the original label does not fully show them in Vietnamese.

Documents for product declaration, inspection, circulation and traceability of F&B products.

COA / Specification

Analysis certificate or product standard document used to verify ingredients, indicators and label information.

C/O

Certificate of Origin affecting preferential duty treatment; it must match description, origin, quantity and weight.

ETA

Estimated Time of Arrival, the operational milestone for locking documents before demurrage/detention risks arise.

Operational note: supplementary labeling is not a simple translation task. It connects declaration dossiers, import documents, traceability, C/O and market-circulation obligations.

DETAILED PRODUCT CLASSIFICATION AND IDENTIFICATION

This article applies to product labeling/supplementary labeling for imported F&B products: packaged food, non-alcoholic beverages, seasonings, sauces, snacks, instant noodles, cereals, tea, coffee, additives, flavorings, health supplements or other products with specific dossiers under the F&B scope. It does not automatically apply to alcohol, medicine, cosmetics or goods not intended for circulation.

Actual application must be checked against original labels, artwork, COA/specification, ingredients, SKU, import purpose and actual legal dossiers.

HS CODE – DUTIES – C/O

For this policy article, HS classification follows the main F&B product, not the supplementary label itself. If labels/stickers/decals are imported separately as independent goods, they must be classified separately by material and printing form. Duties and VAT can only be finalized after the final HS code, actual dossiers and tariff schedule on the declaration date are checked.

DOSSIER SET AND SUBMISSION METHOD

Separate the dossier into commercial documents, technical/specialized documents and documents for authority submission or explanation. Submission may be paper-based, via National Single Window, specialized portals or by authority request at the time of handling.

FAQ – COMMON QUESTIONS

1. Must imported F&B goods have a Vietnamese supplementary label?

Generally, imported goods circulated in Viet Nam need mandatory contents in Vietnamese if the original label does not fully show them. Review Decree 43/2017/ND-CP, Decree 111/2021/ND-CP and the actual product group.

2. Can supplementary labeling be done after customs clearance?

Distinguish customs clearance from market circulation. Some lots may be labeled at the warehouse after clearance, but before sale, display or distribution the label must comply.

3. Must the supplementary label copy the original label exactly?

The Vietnamese contents must accurately reflect the product nature and must not distort the original label or declaration dossier. Do not add marketing claims beyond the dossier.

4. Is nutrition labeling required?

Review Circular 29/2023/TT-BYT, product type, application roadmap and exemptions if any.

5. What if the original label shows an incorrect origin?

Do not use the supplementary label to correct the actual origin. Check C/O, purchase documents, producing country and origin rules before declaration/circulation.

6. Do samples need supplementary labels?

It depends on import purpose, quantity and whether goods are distributed/circulated. Samples should still have original labels, identification information and a purpose letter.

7. Can label errors affect C/O?

The supplementary label does not replace C/O, but wrong name/origin/description may increase explanation risks when C/O, declaration and actual goods are compared.

8. What should be archived after clearance?

Original label photos, supplementary label file, translation, food-safety declaration, COA, C/O, customs declaration, import documents and post-labeling photos by lot/SKU.

The deliverable is not only customs clearance. The enterprise should reach a status of clear product identification – sufficient circulation dossier – sufficient explanation basis.
