IMPORT PROCEDURE GUIDE FOR NOODLES

Noodles are often underestimated in import compliance. The same commercial description may refer to instant noodles, dried noodles, fresh noodles, instant rice noodles, noodles with soup/seasoning sachets, or stuffed pasta products. If the goods description does not match the ingredient list, packing form and specification sheet, the importer may classify the wrong HS code, declare the wrong duty, miss the self-declaration or imported-food safety inspection dossier, prepare an incorrect Vietnamese supplementary label, or lose C/O preferential duty. This article provides an E2E (End-to-End) review map for HS code, duty/tax, C/O, food safety requirements, customs documents, clearance steps and pre-ETA risk controls.

Indicative duty/tax For HS 1902.30.40: MFN 30%; indicative ordinary import duty 45%; operational VAT reference: 8% during 01/07/2025–31/12/2026 if the goods are not excluded; the standard/fallback rate is 10% when the VAT reduction policy no longer applies or the goods are excluded; FTA duty may be 0% or lower if the C/O is valid and origin rules are met.
Specialized policy Prepackaged processed food generally requires product self-declaration and imported-food safety inspection unless an exemption applies. Review by ingredient, declaration status, label, import purpose and test report dossier.

SCOPE OF APPLICATION

This article applies to imported noodles for human consumption, including instant noodles, dried noodles, fried or non-fried noodles, cup/bowl noodles, packet noodles and similar products supplied with seasoning powder, soup base, oil sachets or dried vegetables.

  • Packaged instant noodles, cup noodles, bowl noodles and dried instant noodles.
  • Conventional processed noodles with seasoning, oil, dried vegetable or soup sachets.
  • New commercial goods, samples, retail-chain or supermarket project shipments.

Not automatically covered

  • Frozen fresh noodles, products stuffed with meat/seafood, or cold-chain products.
  • Rice noodles/vermicelli/pho, glass noodles, pasta, spaghetti, couscous or foods for special dietary use.
  • Medical nutrition products, health supplements or foods for children under 36 months.
  • Wheat flour, starch, food additives or other raw materials imported separately.
Review against the actual dossier: ingredients, meat/seafood ratio if any, processing method, goods condition, product declaration, shelf life, original label, supplementary label and actual import purpose.

CLASSIFICATION & PRODUCT IDENTIFICATION

The classification of noodles should start from the product nature: whether it is a pasta/noodle product, whether it is cooked or otherwise prepared, whether it is instant, whether it is made from rice or wheat, whether it is stuffed, and whether seasoning sachets are packed together with the product.

HS CODE – DUTY – C/O

For noodles, HS classification depends not only on the commercial name but also on product nature: pasta/noodle product, prepared status, instant use, rice/wheat/starch base, stuffing, and meaningful meat/seafood ingredients. Technical documents and labels should be locked before the HS code is finalized on the customs declaration.

C/O checklist for preferential duty

  • The C/O form must match the FTA and exporting country, such as Form D, E, AK, AJ, VJ, CPTPP, RCEP, EUR.1 or another applicable form.
  • Description on C/O must not conflict with invoice, packing list, label and customs declaration.
  • HS code on C/O should be consistent or explainable if declared at a different digit level in Viet Nam.
  • Origin criterion must match product-specific rules, especially where flour, oil, seasoning, additives and soup sachets are involved.
  • Check direct transport, third-party invoice, C/O issue date, stamp and signature before ETA.
Do not finalize duty/tax based only on the word “noodles”: the same commercial name may lead to different HS codes if the product is rice noodles, glass noodles, other instant noodles, unprepared noodles or stuffed products.

PRACTICAL E2E PROCESS

Step 1: Pre-ETA review

Finalize HS code, food-safety policy, self-declaration, state inspection, duty/tax, C/O, supplementary label and remaining shelf life.

Step 2: Lock documents and product dossier

Cross-check Invoice, Packing List, B/L/AWB, ingredient list, specification, original label, test report and SKU list.

Step 3: Prepare food-safety dossier if applicable

Complete self-declaration, test report, imported food-safety inspection dossier and supplementary label before arrival.

Step 4: Open customs declaration

Declare correct goods name, HS code, value, origin, quantity and weight; prepare explanations for yellow/red channel questions.

Step 5: Clearance and post-clearance completion

Deliver goods to warehouse, check packaging and shelf life, apply supplementary label if needed and archive the lot dossier.

FAQ – COMMON BUSINESS QUESTIONS

Do imported noodles require an import permit?

Do not conclude based on the name alone. Conventional processed noodles usually focus on self-declaration and imported food-safety inspection where applicable; special products may trigger different policies.

Is food-safety inspection required?

It may be required unless an exemption applies. Review Decree 15/2018/ND-CP, import purpose, declaration dossier and shipment condition.

Which HS code applies to instant noodles?

The main reference is 1902.30.40 for other instant noodles. Rice noodles, glass noodles or other pasta products may require different codes.

Is VAT 8% or 10%?

During 01/07/2025–31/12/2026, review whether 8% VAT applies if the goods are not excluded under Decree 174/2025/ND-CP; the standard/fallback rate is 10% when the reduction policy no longer applies or the goods are excluded.

Can C/O reduce import duty?

Yes, if the C/O is valid, correct in form and satisfies the origin rules; some FTAs may offer very low or 0% duty.

Are samples handled the same as commercial goods?

Not automatically. Review purpose, quantity, value, food-safety dossier and intended use after import.

What if the original label has no Vietnamese?

A Vietnamese supplementary label should be prepared before circulation and must not conflict with the original label and self-declaration dossier.
