IMPORT PROCEDURE GUIDE FOR ACCESS POINT
Access point refers to a wireless access device used to create or extend a WLAN (Wireless Local Area Network). For import clearance, the key risks are not limited to the commercial name; they relate to HS classification, Wi‑Fi frequency bands, EIRP power, Wi‑Fi standards, encryption functions, ICT conformity dossiers, and model consistency between commercial documents and technical datasheets.
If handled incorrectly, the shipment may face delayed clearance, document inspection, additional test report requests, loss of C/O preferential treatment, DEM/DET charges, or post-clearance compliance issues. This article provides an E2E (End-to-End) review map before ETA.
QUICK FACTS
| Item | Review direction | Operational note |
|---|---|---|
| Product name | Access point / wireless access point | Avoid generic descriptions such as “network device” if the technical dossier shows Wi‑Fi standard, frequency band and model. |
| Suggested HS code | 8517.62.51 – wireless LAN equipment | Do not automatically apply this to router, mesh, CPE, ONT/ONU or integrated gateway products. |
| Suggested duties | MFN: reference 0%; ordinary duty: reference 5%; VAT: reference 10% | FTA preferential duty depends on valid C/O and the tariff schedule at declaration time. |
| Specialized policy | Review Group-2 ICT goods under Circular 29/2025/TT-BKHCN | Wi‑Fi equipment under HS 8517.62.51 may require conformity certification/declaration under applicable QCVNs. |
| Technical dossier | Catalogue, datasheet, user manual, test report, model list, label images | Product name, model, origin, frequency and EIRP must match commercial and compliance documents. |
SCOPE OF APPLICATION
Covered products
Ceiling-mounted, wall-mounted, desktop or outdoor wireless access points; DC adapter or PoE powered; standalone, controller-managed or cloud-managed APs.
Not automatically covered
Do not generalize this guide to modems, routers, mesh systems, CPE, ONT/ONU, firewalls or 4G/5G SIM-based telecom devices. These variants may change HS code, license requirements, QCVNs and specialized dossiers.
CLASSIFICATION & TECHNICAL IDENTIFICATION
For access points, the technical review should cover Wi‑Fi transmission/reception, IEEE 802.11 standard, 2.4/5/6 GHz bands, EIRP, antenna type, power source, management method and encryption/security functions.
| Criteria | Documents to check | Risk if misdescribed | Suggested customs description |
|---|---|---|---|
| Main function | Catalogue, datasheet, user manual | Misclassified as router/gateway/switch; wrong HS and policy | Wireless Access Point, model…, used for wireless LAN |
| Wi‑Fi band | RF datasheet, test report | Wrong QCVN or missing radio test | Access point supporting Wi‑Fi 2.4 GHz/5 GHz/6 GHz as per model |
| EIRP power | Test report, RF specification | Incorrect scope of Group-2 management | Keep in technical file and explain when requested |
| Router/VPN/firewall function | User manual, security datasheet | Possible civil cryptography or cyber-security review | Clarify whether it is standalone AP or AP with router/gateway functions |
| Goods condition | Invoice, serial photos, new-goods confirmation | Used/refurbished ICT goods may be restricted/prohibited | Brand-new access point, model…, brand…, origin… |
HS CODE – DUTY – C/O
For an access point, the key issue is not merely that it is a “network device”, but that it is a wireless data transmitting/receiving device used in a WLAN/local area network. The proposed HS code should therefore be reviewed against the device’s data transmission function, Wi‑Fi standard, frequency band, radio module, Ethernet ports, PoE/DC power supply and whether the device also performs router, gateway or controller functions.
| Reference HS code | Classification description | Applicable condition for access points | When not to apply mechanically | Documents to check |
|---|---|---|---|---|
| 8517.62.51 | Wireless LAN equipment; under equipment for transmitting/receiving data in wired or wireless networks. | Wi‑Fi access point used in WLAN; transmitting/receiving Wi‑Fi 2.4 GHz, 5 GHz or 6 GHz; uplink via Ethernet/PoE; managed standalone, by controller or cloud. | Do not apply automatically if the device is actually a 4G/5G router, outdoor CPE, optical ONT/ONU, mesh gateway with principal routing, firewall or specialized transmission device. | Catalogue, datasheet, user manual, model label images, functional diagram, frequency/EIRP data, Invoice, Packing List, C/O. |
| 8517.62.43 | Controllers/adaptors, including connectors, bridges, routers and similar devices designed solely for connection to ADP machines of heading 84.71. | Review only where the device is in fact a bridge/router/controller/adaptor rather than a standalone WLAN access point. | May be confused with enterprise APs managed by controller/cloud; the datasheet must be read to identify principal function. | Layer 2/layer 3 function sheet, routing table, NAT, gateway mode, controller architecture. |
| 8517.62.59 / 8517.62.99 | “Other” categories for data transmitting/receiving equipment. | Review only when the product does not fit Wireless LAN equipment or has other special transmission functionality. | Do not use as a “safe” code without technical basis; it may lead to wrong duty, wrong specialized policy and wrong conformity dossier. | Detailed technical dossier, classification ruling if any, structure and function explanation. |
SUGGESTED DUTY TABLE FOR ACCESS POINTS
| Tax/duty item | Suggested reference rate | Operational basis when HS 8517.62.51 applies | Condition for application | Key risk to control |
|---|---|---|---|---|
| Preferential import duty – MFN | 0% | HS 8517.62.51 – Wireless LAN equipment under heading 85.17 is shown with a 0% preferential import duty rate in the current MFN tariff. | Applicable where the goods are imported from an MFN country/territory and the HS code, customs value and product description are correctly declared. | If the product is reclassified as router/CPE/ONT/gateway or another device, duty and policy may change. |
| Ordinary import duty | 5% | Used as a contingency where the goods do not qualify for MFN preferential treatment or any applicable preferential regime. | Only used where the ordinary tariff must apply; verify at the time of customs declaration. | Do not treat the ordinary rate as the default landed-cost basis if the shipment qualifies for MFN or FTA treatment. |
| VAT | 10% | Network equipment is generally not within the 0% or 5% VAT groups, so a 10% VAT assumption is used for planning. | Apply the VAT policy effective at the time of declaration; monitor temporary VAT-reduction programs if any. | Do not confuse VAT with import duty; VAT is assessed after determining customs value and import duty payable. |
| Special preferential duty under FTAs | Often may be 0% if the relevant FTA tariff schedule provides 0% and the C/O is valid | Review the applicable agreement: ASEAN, ASEAN–China, ASEAN–Korea, ASEAN–Japan, VJEPA, CPTPP, EVFTA, UKVFTA, RCEP, etc., depending on origin. | The C/O must have the correct form, origin criterion, goods description, HS code or acceptable HS discrepancy under customs rules. | Wrong form, criterion, invoice number, product description or late-issued C/O may cause loss of preferential duty. |
C/O CHECKLIST FOR SPECIAL PREFERENTIAL DUTY
| Item to review | Practical check | Common error | Impact | Recommendation before ETA |
|---|---|---|---|---|
| C/O form | Match origin country and agreement: Form E, D, AK, AJ/VJ, EUR.1, CPTPP, RCEP or permitted self-certification. | Wrong form or confusing export country with origin country. | Special preferential duty may be rejected; MFN duty or additional explanation may apply. | Confirm the C/O form at purchase-order stage, not after cargo arrival. |
| HS code on C/O | Compare HS code on the C/O with the intended Vietnam import declaration code. | The C/O shows a 6-digit/8-digit code different from Vietnam’s code due to exporter-country tariff differences. | Customs may request explanation if the product description is unclear or the discrepancy changes product nature. | Prepare catalogue/datasheet to prove the same goods and same function. |
| Goods description | Description should show “Wireless Access Point / Wi‑Fi Access Point”, model, brand, quantity and origin. | Generic wording such as “network device” or missing model. | C/O may be viewed as inconsistent with Invoice, Packing List and declaration. | Align goods description across Invoice, Packing List, C/O and labels. |
| Origin criterion | Check WO, PE, RVC, CTH/CTSH or product-specific rules under the relevant agreement. | Origin criterion stated but not compliant with the product rule. | Preferential duty may be denied or reviewed post-clearance. | Ask the supplier to confirm origin criteria before C/O issuance. |
| Document consistency | Cross-check invoice number/date, exporter/importer name, loading/discharge ports, gross/net weight. | Incorrect invoice number, date, company name or quantity. | Additional documents, C/O amendment or supplementary duty payment may arise. | Review draft C/O before vessel/flight departure. |
SUGGESTED GOODS DESCRIPTION ON SHIPPING AND CUSTOMS DOCUMENTS
Note: HS code, duty and C/O are linked control layers. A wrong goods description or model may lead to an incorrect HS code; an incorrect HS code may lead to a wrong tariff; a wrong tariff position may cause loss of C/O preference or post-clearance duty recovery.

FAQ – COMMON BUSINESS QUESTIONS
1. Does importing an access point require a license?
Do not make an absolute conclusion. Wi‑Fi access points commonly require Group-2 ICT review and may trigger civil cryptography review if special encryption/security functions exist.
2. Is conformity certification required?
If the model falls under the HS and product description of Circular 29/2025/TT-BKHCN, a conformity dossier under relevant QCVNs should be prepared.
3. Is Vietnamese sub-labeling required?
Yes, if the goods circulate in Vietnam and the original label does not fully show mandatory contents in Vietnamese.
4. Does HS 8517.62.51 apply to all access points?
No. It is a reference code for wireless LAN equipment. Routers, mesh, CPE, ONT/ONU or gateways require separate review.
5. Can C/O reduce duty?
Possibly, if the C/O is valid and the relevant FTA tariff schedule grants preference for the actual HS code.
6. Are samples/warranty goods handled like commercial imports?
Not automatically. Customs regime, purpose, quantity and specialized policy must be reviewed case by case.
