CIRCULAR

Providing temporary regulations on permissible content limits of certain hazardous chemicals in electrical and electronic products

Legal grounds

Pursuant to Decree No. 189/2007/ND-CP dated 27 December 2007 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade; Decree No. 44/2011/ND-CP dated 14 June 2011 amending and supplementing Article 3 of Decree No. 189/2007/ND-CP; Pursuant to the Law on Chemicals dated 21 November 2007; the Minister of Industry and Trade temporarily regulates permissible content limits of certain hazardous chemicals in electrical and electronic products as follows:

Article 1. Scope of regulation

1. This Circular temporarily regulates permissible content limits of certain hazardous chemicals in electrical and electronic products circulated on the Vietnamese market. 2. The following goods are outside the scope of this Circular: a) Electrical and electronic components; batteries and accumulators; b) Replacement parts used for repair, reuse or upgrade of electrical and electronic products; c) Electrical and electronic products being gifts, souvenirs, goods serving exhibitions and product introductions; hand luggage and movable personal assets of organizations and individuals; goods temporarily imported for re-export, goods in border-gate transfer or transit; d) Electrical and electronic products already circulating on the Vietnamese market before this Circular takes effect.

Article 2. Regulated entities

This Circular applies to organizations and individuals manufacturing, trading in or importing electrical and electronic products.

Article 3. Interpretation of terms

1. The permissible content limit of certain hazardous chemicals in electrical and electronic products means the maximum percentage by weight of these substances allowed in homogeneous materials constituting electrical and electronic products. 2. Homogeneous material means a material that cannot be mechanically separated into different materials.

Article 4. Electrical and electronic products required to meet permissible content limits

Electrical and electronic products circulated on the Vietnamese market must meet permissible content limits of certain hazardous chemicals as provided in Appendix 2 to this Circular, including: 1. Large household appliances; 2. Small household appliances; 3. Information technology and telecommunications equipment; 4. Consumer equipment; 5. Lighting equipment; 6. Electrical and electronic tools, except large stationary industrial tools; 7. Toys, leisure and sports equipment; 8. Automatic measuring instruments.

Article 5. Hazardous chemicals restricted in electrical and electronic products

1. Restricted hazardous chemicals include Lead (Pb), Cadmium (Cd), Mercury (Hg), Hexavalent chromium (Cr6+), Polybrominated biphenyls (PBB) and Polybrominated diphenyl ethers (PBDE). 2. The content of hazardous chemicals in electrical and electronic products circulated on the Vietnamese market must not exceed the permissible limits specified in Appendix 1, except for the cases specified in Appendix 3 to this Circular. 3. An electrical and electronic product is considered compliant if all homogeneous materials constituting such product comply with hazardous chemical content limits. 4. Pending corresponding Vietnamese National Technical Regulations, the current IEC 62321 standard, Electrotechnical products – Determination of levels of six regulated substances, or an equivalent standard, shall temporarily apply to assessing hazardous chemical content in electrical and electronic products.

Article 6. Responsibilities of manufacturers and importers

1. Ensure that manufactured or imported electrical and electronic products do not contain hazardous chemicals exceeding the limits in Appendix 1. 2. Manufacturers and importers shall publish general information that the electrical and electronic products they manufacture or import comply with this Circular on permissible content limits of hazardous substances. Information may be published by: a) Posting on the organization’s or individual’s website; b) Providing information in user manuals or documents accompanying products; c) Providing information in electronic form, such as CD; d) Printing directly on products or packaging. 3. In all cases, manufacturers and importers are legally responsible for the truthfulness of the information published under Clause 2 of this Article. 4. Build or retain management dossiers on hazardous chemical content in electrical and electronic products before such products circulate on the Vietnamese market. Such dossiers must include one of the following: a) Testing/inspection certificates proving that products do not exceed the permissible limits in Appendix 1; b) Management procedures or other documents proving that products do not exceed the permissible limits in Appendix 1.

Article 7. Responsibilities of traders

Distributors and retailers of electrical and electronic products may only trade in products for which information on permissible hazardous chemical content has been provided in accordance with Clause 2 Article 6 of this Circular.

Article 8. Responsibilities of state management agencies

1. Vietnam Chemicals Agency: a) Preside over and coordinate with relevant agencies in inspecting manufacturers and importers whose electrical and electronic products fail to meet permissible content limits under this Circular; b) Designate laboratories accredited as conforming to ISO/IEC 17025, General requirements for the competence of testing and calibration laboratories, to test the indicators in Appendix 1. Designation of testing laboratories shall comply with Circular No. 09/2009/TT-BKHCN dated 08 April 2009 of the Ministry of Science and Technology guiding requirements, procedures and processes for designating conformity assessment organizations. 2. The Market Surveillance Agency shall handle violations in accordance with law for electrical and electronic products circulating on the market that do not meet permissible content limits.

Article 9. Effect

1. This Circular takes effect from 23 September 2011 and applies until replaced by corresponding National Technical Regulations. 2. From 01 December 2012, manufacturers and importers of electrical and electronic products must: a) Publish information on permissible content limits of certain hazardous chemicals under Clause 2 Article 6; b) Ensure permissible content limits of certain hazardous chemicals in electrical and electronic products as specified in Appendix 1; c) Build or retain documents on permissible content limits of certain hazardous chemicals in electrical and electronic products as required under Clause 4 Article 6. 3. Any difficulties arising during implementation should be reported to the Ministry of Industry and Trade for amendment or supplementation as appropriate.

2.1.a Tri-band phosphor fluorescent lamps with normal lifetime and tube diameter below 9mm: 5mg Expired on 31/12/2011; after 31/12/2011 one lamp may use 4mg.
2.1.b Tri-band phosphor fluorescent lamps with normal lifetime and tube diameter from 9mm to 17mm: 5mg Expired on 31/12/2011; after 31/12/2011 one lamp may use 3mg.
2.1.c Tri-band phosphor fluorescent lamps with normal lifetime and tube diameter from 17mm to 28mm: 5mg Expired on 31/12/2011; after 31/12/2011 one lamp may use 3.5mg.
2.1.d Tri-band phosphor fluorescent lamps with normal lifetime and tube diameter of 28mm or more: 5mg Expired on 31/12/2012; after 31/12/2012 one lamp may use 3.5mg.
2.1.e Tri-band phosphor fluorescent lamps with long lifetime (2,500 hours or more): 8mg Expired on 31/12/2011; after 31/12/2011 one lamp may use 5mg.
2.2 Mercury in other fluorescent lamps shall not exceed the following levels (per lamp):
2.2.a Linear calcium halophosphate fluorescent lamps with tube diameter greater than 28mm: 10mg Expired on 13/4/2012.
2.2.b Non-linear calcium halophosphate fluorescent lamps (any diameter): 15mg Expired on 13/4/2016.
2.2.c Non-linear tri-band phosphor fluorescent lamps with tube diameter greater than 17mm No use restriction until 31/12/2011; after 31/12/2011 each lamp may use 15mg.
2.2.d Lamps for general lighting and other special purposes (for example induction lamps) No use restriction until 31/12/2011; after 31/12/2011 each lamp may use 15mg.
