IMPORT PROCEDURE GUIDE FOR CEREALS

For cereals, the key risk is not a single import permit but an imprecise product description. Wheat, corn, rice, oats, barley, rye, sorghum, millet, quinoa and other grains may fall under different HS codes, tax rates, plant quarantine requirements, food safety checks and labeling rules. If the HS code is wrong, the Phytosanitary Certificate is missing, the food safety dossier is inconsistent, or the C/O does not match the declaration, the shipment may be selected for documentary/physical inspection, delayed, or incur DEM/DET and storage costs. This article provides an E2E (End-to-End) operating map for pre-ETA review: product identification, HS code, duty, C/O, plant quarantine, food safety, labeling, customs documents, clearance decision points and risk checklist.

Applicable to

  • Cereals in grain form, with or without ears/stalks under Chapter 10 classification logic.
  • Wheat, meslin, rye, barley, oats, corn, rice, sorghum, millet, quinoa, buckwheat, canary seed and similar cereals.
  • New goods imported for trading, factory use, food manufacturing or further plant-based processing.

Not automatically applicable to

  • Cereal flour, starch, malt and milling products under Chapter 11.
  • Breakfast cereals, cakes/snacks/noodles and deeply processed food products under Chapter 19 or other chapters.
  • Seeds for sowing, animal feed ingredients, research samples or specially treated goods if separate regulations apply.
  • Review according to catalogue/specification, batch, processing method and actual import purpose.

CLASSIFICATION & PRODUCT IDENTIFICATION

The description “cereal/grain” is insufficient. The dossier should clearly state the cereal type, seed/commercial use, post-harvest treatment, whether hulled/milled/polished/glazed, intended use, retail/industrial packaging and whether any ingredients have been blended. Incorrect description can lead to incorrect HS code, quarantine policy, food safety dossier and labeling.

The main classification basis is cereal type, grain status, processing level, end use and Chapter 10 notes. Do not determine HS solely by trade name.

C/O risk: The C/O must match the goods description, HS code, quantity/weight, origin, origin criterion and transport route. A wrong form, third-party invoice issue or mismatch with the customs declaration may cause loss of preferential duty.

E2E OPERATIONAL PROCEDURE

Pre-ETA review

Confirm cereal type, HS code, MFN/ordinary duty/VAT, C/O possibility, plant quarantine, food safety and labeling. Do not wait until cargo arrival.

Lock documents and technical dossier

Finalize Invoice, Packing List, B/L/AWB, specification, COA, Phytosanitary Certificate, original label, lot/batch and end-use statement.

Register quarantine/food safety if applicable

Prepare plant quarantine and imported food safety dossiers in advance to avoid storage costs after ETA.

Submit customs declaration

Green channel: conditional system clearance. Yellow: documentary check. Red: documentary and physical inspection. Common questions include HS, value, C/O, quarantine, food safety and goods description.

Clearance, delivery and post-clearance file

Take delivery, apply sub-labels if needed, complete quarantine/food safety results, archive shipment files and prepare for post-clearance audit.

FAQ

1. Do cereals require an import permit?

Do not conclude generally. Raw cereals may not require a standalone import permit, but plant quarantine, food safety and labeling must still be reviewed.

2. Is plant quarantine required?

Likely, if the grain is a regulated plant article. Review Circular 14/2024/TT-BNNPTNT and the actual dossier.

3. Is product self-declaration required?

Do not conclude generally. Raw cereals imported as ingredients normally require quarantine and food safety review; declaration/self-declaration is only triggered where goods are packaged, processed, processed pre-packaged food or subject to Decree 15/2018 based on the actual dossier.

4. Can C/O reduce duty?

Possibly. It depends on FTA, origin, HS code, origin criterion and direct transport rule.

5. Do corn and rice have the same duty?

No. Corn heading 1005 has different rates; rice heading 1006 often has higher MFN rates in many lines.

6. Are samples handled like commercial shipments?

Samples may still require quarantine, food safety or explanatory documents depending on type, quantity and purpose.

7. What if invoice says “mixed grains”?

Ask the supplier to separate ingredients, ratios, cereal types and processing status. Mixed products may move to another chapter.

8. Is Vietnamese sub-label required?

If goods are circulated in Vietnam, especially retail-packed goods, review Decree 43/2017 and Decree 111/2021.
