IMPORT PROCEDURE GUIDE FOR FLAVORED MILK

Flavored milk may look like a simple FMCG item, but import clearance depends on three sensitive layers: HS classification, food safety/quarantine and product name – nutrition labelling. Misclassifying it as plain liquid milk, a sterilized milk-containing beverage, a nutritional product or an infant/special dietary product may lead to additional dossier requests, loss of C/O preference, delayed clearance and DEM/DET cost. CLASSIFICATION & TECHNICAL IDENTIFICATION

The key is not the commercial name but the product nature: milk ratio, milk source, sugar/sweetener, flavouring/cocoa, UHT/sterilized/pasteurized process, ready-to-drink status, target users and label claims.

There is no single HS code for all flavored milk. Classification must follow ingredients, usage form, processing method and label presentation. The following is an initial review matrix; confirm against the tariff and actual documents at declaration date.

FAQ

Does flavored milk require an import licence?

Do not conclude absolutely. Usually, food safety, product declaration, labelling and quarantine review may apply; any separate licence depends on formula, claims and actual documents.

Is HS 2202.99.10 always used?

No. It is the main route only for sterilized milk-containing beverages with flavour, ready to drink. Plain milk or milk preparations may be classified differently.

Is product declaration required?

Most retail flavored milk products require product declaration under Decree 15/2018/ND-CP. Special claims or target users may require registered declaration.

Can C/O reduce duty?

Yes, potentially. For HS codes with high MFN duty such as 2202.99.10, a valid C/O can materially affect landed cost.
