Businesses may use it as a pre-ETA checklist to lock the dossier, estimate landed cost, determine whether a quota licence is required and identify clearance hold points.

Legal note

This English version is an operational reference translation and is not an official legal translation. Businesses should cross-check the Vietnamese legal text and actual shipment dossier before applying.

CLASSIFICATION & PRODUCT IDENTIFICATION

Product nature

Identify species, fresh/preserved/cooked condition, in-shell status, non-embryonated status, purpose of import and storage condition.

Key risk

A generic name such as “eggs” may lead to wrong HS, quota, quarantine, food safety, C/O and labeling treatment.

TECHNICAL IDENTIFICATION CRITERIA

Criteria Document to check Risk if described wrongly Suggested customs description
Species Invoice, label, Health Certificate Wrong HS/quota Chicken/duck/other poultry eggs in shell
Condition Label, process evidence Wrong HS/policy Fresh/preserved/cooked eggs in shell
Purpose Contract, production plan Wrong quota/licensing basis For food/raw material as per dossier
Label and shelf-life Original label, auxiliary label Post-clearance issue Keep label consistent with documents

HS CODE – DUTY – C/O

HS classification for eggs must be based on species, fertilised/non-fertilised status, end-use, condition (fresh/preserved/cooked) and whether the shipment is subject to tariff quota control. Do not finalise duty only from the commercial name “eggs”.

HS REFERENCE TABLE

Indicative HS code Product condition Dossier point to verify Risk if misclassified
0407.11.10 / 0407.11.90 Fertilised chicken eggs for incubation Incubation/breeding purpose, Health Certificate, breeding dossier if applicable May be confused with commercial eggs and lead to wrong quota/duty treatment
0407.19.11 / 0407.19.19 / 0407.19.91 / 0407.19.99 Other fertilised eggs for incubation Species, incubation purpose and quarantine documents Insufficient description may trigger classification explanation
0407.21.00 Fresh in-shell chicken eggs, commercial non-fertilised eggs Species, non-fertilised status, in-shell condition and end-use Wrong duty/quota treatment if confused with hatching eggs
0407.29.10 / 0407.29.90 Fresh in-shell duck/muscovy duck eggs or other fresh eggs Species, label, invoice and Health Certificate Wrong code if species is not supported
0407.90.10 / 0407.90.20 / 0407.90.90 Other in-shell eggs, preserved or cooked Preservation/cooking method, label and product description Confusion with fresh eggs may affect HS, duty and food-safety review

DETAILED DUTY TABLE BY HS CODE

HS code group Goods description MFN preferential duty Out-of-quota duty Ordinary import duty VAT FTA/C/O treatment
0407.11.10, 0407.11.90, 0407.19.11, 0407.19.19, 0407.19.91, 0407.19.99 Fertilised eggs for incubation 0% MFN if the dossier supports the classification Not the same as the 2026 quota for commercial non-fertilised eggs; quarantine/breeding control must still be reviewed For MFN 0% lines, do not mechanically apply the 150% rule; review Decision 15/2023/QD-TTg and the applicable ordinary tariff at declaration date Not subject to VAT if unprocessed/only normally handled; review if product nature differs Limited duty benefit if MFN is already 0%, but C/O may support origin compliance
0407.21.00 Commercial non-fertilised chicken eggs, fresh/in-shell where applicable 40% in quota/MFN 80% if outside quota or without valid quota licence If MFN/FTA is not available and no separate ordinary rate is listed, the working rule is 150% of MFN; for MFN 40%, the planning figure is 60%. Quota goods must also be checked against the 80% out-of-quota rate. Not subject to VAT if unprocessed/only normally handled; 10% may apply if processed/mixed into another product FTA rate depends on valid C/O, origin criteria and direct transport; quota requirements still need review
0407.29.10 / 0407.29.90 Commercial non-fertilised duck/muscovy duck eggs or other fresh eggs 40% 80% Planning figure under the 150% MFN rule: 60%, but this does not replace the 80% out-of-quota rate for quota-controlled goods. Not subject to VAT if the product remains an unprocessed livestock product Review C/O form, HS description, origin criterion and transport route
0407.90.10 / 0407.90.20 / 0407.90.90 Other in-shell eggs, preserved or cooked 40% 80% if quota-controlled and imported outside quota Planning figure under the 150% MFN rule: 60%; verify against the current ordinary tariff and country of export. Not subject to VAT if only normally preserved; review 10% if processed into another product Preferential rate depends on the relevant FTA schedule and a valid C/O

Duty note: The figures 0%, 40%, 80%, 60% and 10% are for dossier review and landed-cost planning. The final declaration must follow the tariff schedule, quota licence, C/O and goods condition at the time of customs registration.

FAQ

Does importing eggs require a licence?

Do not assume no licence. Poultry eggs under the 2026 tariff quota require review of quota/licensing rules.

Is animal quarantine required?

Likely yes depending on the dossier; check Health Certificate and quarantine registration.

Is 0407.21.00 always correct?

No. It usually covers fresh chicken eggs; other species/status may fall under other 04.07 lines.

What is the VAT treatment?

Unprocessed/normally sơ chế livestock products at import may be non-VAT taxable; processed products need separate review.

Can C/O reduce duty?

Possibly, if C/O and quota conditions are met.

What should be locked before ETA?

HS, quota/licence, Health Certificate, food safety, C/O, label and cold-chain evidence.
