IMPORT PROCEDURE GUIDE FOR ELECTRIC MOTORS

Electric motors look simple but create practical customs risk when declared generically as “motor”. Common issues include wrong HS Code between AC, DC, servo, stepper or multi-phase motors; overlooked energy labeling/minimum energy performance requirements; model mismatch between commercial documents and catalogue; failure to separate the motor from inverter, controller, encoder or gearbox; unclear new/used condition; or C/O (Certificate of Origin) with wrong form, origin criterion, description or HS code. The consequences may include customs channel escalation, additional catalogue/test report requests, denial of FTA duty, clearance delay, DEM/DET, post-clearance document exposure and delayed production-line installation. SCOPE OF APPLICATION

This guide applies to electric motors imported for manufacturing, factories, industrial lines, mechanical equipment, automation machinery or spare parts. Variants may include AC single-phase, AC multi-phase, DC, servo, stepper, spindle motors, motors with brake/encoder/detachable gearbox, cooling fan, or motors imported with machinery.

  • Do not merge inverters, servo drives, controllers or electrical cabinets into “electric motor” if documents separate them.
  • New, used, refurbished, samples, warranty, project, EPE/FDI goods may require different treatment.
  • Motors with communication modules, control software, encryption, battery, adapter, charger or accessories must be reviewed separately.
  • Motors inseparable from a complete machine may be classified with the machine/system rather than heading 8501.

CLASSIFICATION & TECHNICAL IDENTIFICATION

Identification starts from catalogue, datasheet and nameplate: function, AC/DC principle, phase, rated power, voltage, frequency, poles, RPM, duty, IP class, mounting type, accessories and condition. Generic naming may cause wrong HS, specialized policy, energy efficiency standard, used-equipment treatment and labeling.

HS CODE – DUTY – C/O

HS classification must be determined by function, operating principle, current type, rated power, phase, use and import configuration. A generic “motor” code should not be used because heading 8501 has multiple subheadings and duty rates.

Control principle: Goods name, quantity, model, serial, origin and technical specifications must match across commercial documents, catalogue, label, specialized dossier and customs declaration.

FAQ

Question Short answer
Does importing electric motors require a permit? Do not conclude generally. New standard motors usually focus on HS–tax–C/O, goods labeling and possible energy labeling if in scope. Used goods or motors with controllers/modules require separate review.
Is quality inspection/conformity certification required? Not absolute. Motors subject to energy labeling/MEPS require the relevant energy dossier/test report according to applicable rules.
Is Vietnamese supplementary labeling required? If goods circulate in Vietnam, review original/supplementary labeling under Decrees 43/2017 and 111/2021; nameplate should show model, power, voltage, origin and manufacturer.
Can C/O reduce duty? Potentially, if form, origin criterion, description, HS and direct transport meet the relevant FTA.
Are samples/warranty goods processed like commercial goods? Not always. Import purpose, quantity, value, warranty conditions and use/circulation must be reviewed.
What if the invoice model differs from catalogue? Correct documents or obtain manufacturer confirmation before ETA. Model mismatch can affect HS, C/O, energy policy and post-clearance dossier.
Can servo motors follow the same procedure as ordinary AC motors? Not automatically. Servo motors may come with driver/controller/encoder and require configuration, line-item and component policy review.
