IMPORT PROCEDURE FOR FOOD COLORANTS

Food colorants carry practical import risks at three points: HS classification, permitted food-additive status and import food-safety inspection. A generic description such as “food colour”, missing INS/E-number, incomplete COA or an incorrect declaration route may lead to document supplementation, delayed customs clearance, storage cost and production planning disruption. SCOPE OF APPLICATION

Single product only

This article applies only to food colorants used to add, restore or intensify color in food products. It does not automatically apply to sweeteners, preservatives, acidity regulators or anti-caking agents even when they are in the same website category.

Variants to review separately

Synthetic colors, natural colors, color lakes, blended colorants, colorants with carriers, powder, liquid, R&D samples, commercial shipments and factory/EPE imports may require different HS and compliance treatment.

No blanket conclusion

If the item is a mixed additive with a new function, an additive outside the permitted list, or intended for a food category not covered by the permitted conditions, product registration or sectoral consultation may be required.

Data to lock before ETA

Color name, INS/E-number, CAS number if any, carrier, active color content, packing specification, manufacturer, origin, quality standard and batch-specific COA.

CLASSIFICATION & TECHNICAL IDENTIFICATION

For imported food colorants, the commercial name on the invoice is not enough. The product may be a pure synthetic colorant, a natural extract, a color lake, a blend of several colorants or a preparation with a carrier. Each case may lead to different HS code, food-safety dossier and use conditions.

HS CODE – DUTY – C/O

HS code depends on chemical nature, source, preparation form and actual use. The description “food colour” alone should not be used to finalize classification. Chapter 32 notes, COA and composition should be reviewed before declaration.

FAQ

Question Answer
Does importing food colorant require a permit? Do not make a blanket conclusion. Review whether the additive is permitted, mixed with a new function or outside the permitted list; then determine self-declaration, product registration or another specialized dossier.
Is import food-safety inspection required? It may be required if the HS code/product falls within the Ministry of Health import inspection list. Review Circular 15/2024 and actual documents.
Is self-declaration required? Permitted food additives generally need a declaration dossier before circulation, but the route depends on product nature and function.
Can HS 3204.19.00 be used for all food colorants? No. It is a main route for many other synthetic colorants; natural colors and color lakes require separate review.
Can C/O reduce duty? Yes, if the C/O form, origin criterion, goods description and accepted HS code are valid.
What if invoice and COA use different names? Request document correction or prepare a cross-reference table between trade name, technical name and INS code before declaration.
