IMPORT PROCEDURE FOR FOOD COLORANTS
Food colorants carry practical import risks at three points: HS classification, permitted food-additive status and import food-safety inspection. A generic description such as “food colour”, missing INS/E-number, incomplete COA or an incorrect declaration route may lead to document supplementation, delayed customs clearance, storage cost and production planning disruption. This article provides an E2E (End-to-End) control map covering HS code, duties, C/O, food-additive policy, customs documents, clearance decision points and pre-ETA risk checks.
QUICK FACTS
| Item | Operational checkpoint |
|---|---|
| Product scope | Food colorants used as food additives; confirm color name, INS/E-number where available, powder/liquid/lake form, and whether natural or synthetic. |
| HS codes to review | Main route: 3204.19.00 for other synthetic organic colorants; backup: 3203.00.10 for animal/vegetable-origin coloring matter; 3205.00.00 for color lakes/lake pigments. |
| Proposed duty | For HS 3204.19.00: ordinary import duty 5%, MFN 0%, VAT 8% based on the tariff data reviewed; FTA rate may be 0% with valid C/O. Recheck the tariff and VAT policy at the customs declaration date. |
| Core policy | Self-declaration may apply where the additive is permitted and used within the allowed scope; product registration may apply to mixed additives with new functions or additives outside the permitted list. |
| Food-safety inspection | May be subject to state inspection on imported food safety under the Ministry of Health list; review by HS code, composition and intended use. |
| Key dossier | Invoice, Packing List, B/L/AWB, C/O, COA, specification, MSDS/SDS if any, original label, product self-declaration/registration dossier, technical sheet. |
Legal note
Do not conclude that only self-declaration is required, or that no specialized dossier is needed, until the color code, composition, function, intended use level, original label and technical dossier have been reviewed. Review actual catalogue, specification, COA, label, product code and import purpose.
SCOPE OF APPLICATION
This article applies only to food colorants used to add, restore or intensify color in food products. It does not automatically apply to sweeteners, preservatives, acidity regulators or anti-caking agents even when they are in the same website category.
Synthetic colors, natural colors, color lakes, blended colorants, colorants with carriers, powder, liquid, R&D samples, commercial shipments and factory/EPE imports may require different HS and compliance treatment.
If the item is a mixed additive with a new function, an additive outside the permitted list, or intended for a food category not covered by the permitted conditions, product registration or sectoral consultation may be required.
Color name, INS/E-number, CAS number if any, carrier, active color content, packing specification, manufacturer, origin, quality standard and batch-specific COA.
CLASSIFICATION & TECHNICAL IDENTIFICATION
For imported food colorants, the commercial name on the invoice is not enough. The product may be a pure synthetic colorant, a natural extract, a color lake, a blend of several colorants or a preparation with a carrier. Each case may lead to different HS code, food-safety dossier and use conditions.
TECHNICAL IDENTIFICATION CRITERIA
| Checklist item | Document to compare | Risk if misdescribed | Suggested goods description |
|---|---|---|---|
| Color origin | Specification, COA, composition, CAS/INS | Wrong 3203/3204/3205 classification and wrong policy. | Synthetic/natural food colorant, color name, INS/E-number, powder/liquid form. |
| Product form | Catalogue, product photo, original label | Color lake or carrier-based preparation may not share the same code as a single colorant. | Food colorant/color lake, form…, used as food additive, brand new. |
| Blend composition | Ingredient list, formulation statement | May be treated as a mixed additive or new-function additive. | Colorant blend containing…, for food use according to manufacturer instruction. |
| Quality standard | COA, test report, QCVN/Codex/JECFA where applicable | Cannot prove safety, purity or heavy-metal compliance. | Include batch number, MFG/EXP and applicable standard. |
| Label and use | Original label, user instruction, SDS/MSDS if any | Wrong supplementary label or wrong use scope. | Food additive – colorant, used in food manufacturing, not for direct retail if applicable. |
HS CODE – DUTY – C/O
HS code depends on chemical nature, source, preparation form and actual use. The description “food colour” alone should not be used to finalize classification. Chapter 32 notes, COA and composition should be reviewed before declaration.
HS CODES TO CROSS-CHECK
| HS code | When applicable | Risk of wrong use | Documents to check |
|---|---|---|---|
| 3204.19.00 | Other synthetic organic coloring matter, including certain mixtures of related subheadings. | May be rejected if the product is natural color or color lake. | COA, composition, CAS/INS, specification, catalogue. |
| 3203.00.10 | Coloring matter of vegetable or animal origin and preparations based thereon. | Wrong if the item is synthetic or a carrier-based preparation. | Extraction source, composition evidence, COA. |
| 3205.00.00 | Color lakes and preparations based on color lakes. | Wrong if declared as ordinary synthetic colorant. | Technical sheet, lake pigment name, base composition, COA. |
| Other codes to review | Where the product is a specific mixed food preparation/additive preparation. | Wrong chapter leads to wrong duty and compliance route. | Formula, intended use, nature of goods and classification rationale. |
PROPOSED DUTY TABLE
| Proposed HS code | Ordinary import duty | MFN duty | VAT | Preferential FTA duty with C/O | Application note |
|---|---|---|---|---|---|
| 3204.19.00 | 5% | 0% | 8% | May be 0% if C/O and FTA conditions are met | Main route for many other synthetic organic colorants; verify tariff and VAT policy at declaration date. |
| 3203.00.10 | 7.5% | 5% | 8% | May be 0% with valid C/O | Use only where the product is animal/vegetable-origin coloring matter for the food or beverage industry. |
| 3205.00.00 | 5% | 0% | 8% | May be 0% with valid C/O | Use where the product is a colour lake/lake pigment; do not apply to ordinary synthetic colorants. |
C/O must match goods description, HS code, origin, invoice and transport documents. A wrong form, origin criterion or inconsistent description may prevent preferential duty treatment.

FAQ
| Question | Answer |
|---|---|
| Does importing food colorant require a permit? | Do not make a blanket conclusion. Review whether the additive is permitted, mixed with a new function or outside the permitted list; then determine self-declaration, product registration or another specialized dossier. |
| Is import food-safety inspection required? | It may be required if the HS code/product falls within the Ministry of Health import inspection list. Review Circular 15/2024 and actual documents. |
| Is self-declaration required? | Permitted food additives generally need a declaration dossier before circulation, but the route depends on product nature and function. |
| Can HS 3204.19.00 be used for all food colorants? | No. It is a main route for many other synthetic colorants; natural colors and color lakes require separate review. |
| Can C/O reduce duty? | Yes, if the C/O form, origin criterion, goods description and accepted HS code are valid. |
| What if invoice and COA use different names? | Request document correction or prepare a cross-reference table between trade name, technical name and INS code before declaration. |
