IMPORT PROCEDURE GUIDE FOR SMART SPEAKER

A smart speaker is an audio device integrating loudspeaker units, microphones, Wi‑Fi/Bluetooth and voice-control or smart-home software. In customs clearance, the risk is rarely the commercial name alone; it is whether the device is technically a loudspeaker, a multi-speaker unit in one enclosure, or a data transmitting/receiving smart hub. If the invoice only states “speaker” or “smart device”, or if the radio module, frequency bands, adapter, battery, model and smart-hub functions are unclear, the shipment may face HS queries, conformity dossier requests, customs channel escalation, C/O issues and unplanned DEM/DET. Review must be based on the actual catalogue, datasheet, model and import purpose.

CLASSIFICATION & TECHNICAL IDENTIFICATION

Technical nature

A smart speaker normally includes loudspeaker units, microphone array, processor, memory, Wi‑Fi/Bluetooth, power adapter and firmware. The key question is whether its principal function is audio playback or data transmission/control.

Principal function

If the main function is sound reproduction and voice interaction, HS heading 8518 should be reviewed first. If the main function is a gateway/smart hub transmitting and receiving data, heading 8517 may need further review.

HS CODE – DUTY – C/O

For smart speakers, HS code should not be decided solely by the marketing name. The principal function, speaker structure and data-transmission functions must be reviewed. The table below is a reference for cost planning and must be checked against the tariff schedule effective on the declaration date.

FAQ – COMMON BUSINESS QUESTIONS

1. Does a smart speaker need an import license?

There is no universal answer. If it has Wi‑Fi/Bluetooth/Zigbee, ICT/telecom conformity and quality inspection obligations must be reviewed.

2. Should HS 8518 or 8517 be used?

Heading 8518 is usually reviewed first if the main function is loudspeaker/audio. Heading 8517 is only considered if the product is essentially a data gateway/smart hub.

3. What are the reference duties?

For 8518.21/8518.22 routes, MFN duty is referenced at 15% and VAT at 10%; normal duty may be referenced at 150% of MFN if no separate normal rate applies. Always check current tariff, VAT policy and C/O on the declaration date.

4. Is Vietnamese labeling required?

Yes if the goods are circulated in Vietnam. Label content must match model, origin, manufacturer/importer and mandatory specifications.

5. Are samples or warranty goods treated the same?

Customs declaration and policy review are still required. Commercial and specialized documents may differ depending on import purpose.

6. What if invoice says smart speaker but catalogue says smart hub?

Clarify before declaration. A different principal function may change HS, duty and specialized policy.
