IMPORT PROCEDURES FOR TINT
Imported tint must first be identified as lip tint/lip stain for lips, or as a multi-use tint for cheek/face. A generic item name “tint” on the invoice may lead to an incorrect HS Code, cosmetic notification, label review and tax treatment.
This guide provides a pre-ETA E2E checklist covering product classification, duty, C/O, cosmetic product notification, labelling, customs documents and decision points that may hold the shipment.
QUICK FACT SUMMARY
| Item | Review point | Operational note |
|---|---|---|
| Product | Tint as a color cosmetic; focus on lip tint/lip stain for lips. | Do not automatically apply this guide to cheek tint, face tint, pigments, testers or treatment products. |
| Reference HS | 3304.10.00 – lip make-up preparations. Face/cheek or tinted skin-care items must be reviewed under 3304.99.xx or another appropriate code. | HS must follow the main use shown on label, notification, catalogue and instructions. |
| Duty | For 3304.10.00: MFN 20%; ordinary duty reference 30%; planning VAT 10%, with 8% considered only if the current VAT reduction policy allows. | A valid C/O may reduce import duty under the relevant FTA/Form; do not assume 0%. |
| Specialized control | A cosmetic product notification receipt number is required; documents should align with Circular 06/2011/TT-BYT and Circular 34/2025/TT-BYT. | This is not simply an “import licence”; it is cosmetic notification and post-market compliance. |
| Label | Original/Vietnamese label should match product name, brand, shade, quantity, ingredients, lot, expiry, origin and responsible organization. | Invoice – Packing List – label – notification must be aligned. |
SCOPE OF APPLICATION
In-scope cases
- Lip tint, lip stain, liquid lip tint, gel/water/cream tint for lips.
- Retail packed products with brand, shade, volume/weight and original label.
- New goods, 100%, imported for trading/market circulation.
- Make-up and color claims, without therapeutic or medical claims.
Cases to separate
- Cheek tint, face tint or multi-use tint not primarily for lips.
- Lip treatment products claiming to heal, treat inflammation or repair cracked lips.
- Samples, laboratory testing goods, testers, pigments or bulk liquid.
- Sets containing lipstick, blush, eyeliner, mascara or skin-care products.
CLASSIFICATION & TECHNICAL IDENTIFICATION
Tint should be identified by main function, area of application, product form and claims. The wording “tint” alone is not sufficient for HS classification or cosmetic notification review.
| Criterion | Documents to check | Risk if described incorrectly | Suggested goods description |
|---|---|---|---|
| Application area | Label, artwork, catalogue, instructions. | Confusing lip tint with face/cheek tint. | “Lip tint, cosmetic make-up for lips, shade…, brand…, capacity…” |
| Formula and ingredients | Formula, INCI ingredient list, CFS/LOA. | Mismatch with notification or restricted ingredients concern. | Prepare INCI ingredient list and notification documents. |
| Claims | Label, website, brochure, advertising material. | Therapeutic claims may exceed cosmetic scope. | Avoid treatment/medical wording unless legally supported. |
| Shade/SKU | Shade list, model list, Packing List. | Mismatch between notification and commercial documents. | State shade/SKU where shown on label/documents. |
| DG risk | SDS/MSDS, flash point, solvent content. | Carrier may request additional documents. | Prepare SDS for alcohol/solvent-containing products. |
HS CODE – DUTY – C/O
HS for tint should be determined from main use, application area, claims, finished-product status, cosmetic notification and label, not from trade name alone.
Lip tint / lip stain
Cheek / face / multi-use tint
Tinted balm / lip care with color
Packaging/applicator imported separately
HS – risk – document matrix
| Reference HS | Condition | Risk if wrong | Documents to check |
|---|---|---|---|
| 3304.10.00 | Lip make-up preparation: lip tint/lip stain/lip color. | Wrong duty or notification explanation. | Label, notification, catalogue, ingredient list, shade list. |
| 3304.99.xx | Other face/skin make-up or skin-care preparations. | Misclassification if product is cheek/face tint. | Application area, claims, instructions. |
| Material-based codes | Packaging, applicators or gifts imported separately. | Wrongly combining accessories with cosmetic products. | Packing List, product images, line-item descriptions. |
C/O and FTA review
| Origin route | C/O or origin document | Preferential duty | Conditions | Risk |
|---|---|---|---|---|
| ASEAN | Form D / ATIGA origin document | Check ATIGA tariff at declaration time. | Origin criterion, direct transport, correct description and HS. | Wrong form or third-party invoice handling. |
| China | Form E or RCEP | Check ACFTA/RCEP tariff schedule by year. | Review WO/RVC/CTH/CTSH and actual production origin. | Simple packing may not qualify as originating. |
| Korea/Japan | AKFTA, VKFTA, VJEPA, AJCEP, RCEP | Check each FTA schedule. | Manufacturer, invoice, transport route and origin criterion. | Mismatch between C/O and invoice. |
| EU/UK/CPTPP | EVFTA, UKVFTA, CPTPP | Check relevant special preferential tariff. | Self-certification where allowed and document retention. | Insufficient proof during post-clearance audit. |

FAQ – COMMON BUSINESS QUESTIONS
1. Does imported tint need an import licence?
Review the cosmetic product notification receipt number. It should not be loosely called an import licence when the actual requirement is cosmetic notification.
2. What is the main HS for tint?
For lip tint/lip stain, the reference HS is 3304.10.00. Face or cheek tint must be reviewed separately.
3. Is VAT 10% or 8%?
Use 10% for planning. Apply 8% only if the current VAT reduction policy allows at declaration time.
4. Can C/O reduce import duty?
Possibly, if the C/O form, origin criterion, goods description and transport route are valid.
5. Is alcohol-containing tint dangerous goods?
No conclusion should be made without SDS/MSDS. Check flash point, volume and carrier requirements.
6. Can one notification cover multiple shades?
Check how shades are declared. Do not combine items if product name, shade, formula or label is not aligned.
