Import Procedures for Mobile Security

Mobile Security is a high-risk compliance item if the shipment is declared only as a generic “network device” or “security device”. An incorrect HS code, missing import licence for network information security products, inconsistent model information across invoice – packing list – catalogue, or undisclosed encryption functions may trigger additional document requests, physical inspection, denial of C/O preferential duty and DEM/DET cost exposure. This article provides an E2E (End-to-End) review map before ETA: HS code, duty, C/O, specialised policy, customs dossier and risks to block before arrival.

Review group Recommended content Operational note
Commodity name Mobile Security / mobile device protection appliance / endpoint protection gateway Do not use a generic “network device” description if the catalogue shows security functions.
Reference HS codes 8517.62.49 or 8517.62.43; additionally review 8471.30.90 / 8471.41.90 / 8471.49.90 depending on construction Final classification depends on catalogue, datasheet, CPU, network interfaces, data transmission mechanism and security functions.
Reference taxes MFN import duty: 0%; ordinary import duty: 5%; VAT: 10% Verify the tariff schedule at customs declaration date and the actual country of origin.
Specialised policy May fall under import licensing for network information security products Especially when the model supports anti-attack, intrusion prevention, network security monitoring, testing or assessment.
C/O Special preferential duty may apply with valid C/O and origin compliance C/O form, HS code, commodity description and invoice details must be consistent.
Legal note: This article applies to physical goods. If “Mobile Security” is only a software licence, subscription or activation key with no tangible imported goods, the enterprise should handle it under the relevant commercial, tax and service documentation. Review by catalogue, datasheet, model and actual import purpose is required.

SCOPE OF APPLICATION

Applicable product

This article applies only to Mobile Security in the form of an appliance or gateway used to protect mobile devices, endpoints or mobile-originated traffic within an enterprise system.

Mobile SecurityEndpoint protection gatewaySecurity appliance

No automatic extension

Do not apply this conclusion automatically to PC/server protection appliances, WAF, firewall, NAC, IPS/IDS, UTM, DDoS appliances or pure security software if model, configuration and main function differ.

New goods, used goods, refurbished goods, samples, warranty replacements, project shipments, EPE/FDI/factory imports, or goods bundled with licences, encryption modules, Wi‑Fi/Bluetooth/4G/5G, battery, adapter or charger must be reviewed separately.

CLASSIFICATION & TECHNICAL IDENTIFICATION

The core point is to prove whether the imported Mobile Security item is physical hardware, an independently operating appliance, or a functional unit of a security system, rather than a software-only licence. Technical documents should state how the device receives data, analyses traffic, prevents intrusion, monitors endpoints, enforces security policies, connects to LAN/WAN, or integrates with mobile device management.

Criterion to check Documents to compare Risk if wrongly described Suggested declaration wording
Complete device or software licence Catalogue, datasheet, invoice, product photos, packing list Wrong treatment between tangible goods and software/service Mobile Security appliance, model…, for mobile device protection
Network security function Datasheet, admin guide, security feature list Missing import licence for network information security products State anti-attack, monitoring or security assessment function where applicable
Data transmission interfaces Port list, Ethernet/WAN/LAN, wireless module Wrong HS classification between Chapter 84.71 and 85.17 Device for reception, conversion and transmission/regeneration of data in an enterprise network
Encryption/VPN/data protection Encryption specification, VPN protocol, cryptographic module note Unprepared civil cryptography review Describe encryption function accurately if it is principal or embedded
Model, serial and accessories Model list, serial list, original label, PO/contract Document inconsistency during customs review or C/O check Keep model/serial consistent across all documents

HS CODE – DUTY – C/O

HS classification should not be based on the commercial name alone. The enterprise must identify the technical nature: automatic data processing equipment, network data transmission/reception equipment, or endpoint security appliance. The following HS codes are references for review and do not replace official customs classification.

Reference HS code Application condition Risk if misapplied Documents to compare
8517.62.49 Other network data reception, conversion, transmission or processing equipment with security functions Incorrect policy if the actual goods fall under 84.71 or 8517.62.43 Catalogue, network diagram, security datasheet
8517.62.43 Controller/adaptor, gateway, bridge, router or similar equipment designed only for connection to ADP machines of heading 84.71 Broad description may trigger a function explanation request Datasheet, topology, interface description
8471.30.90 / 8471.41.90 / 8471.49.90 Goods essentially classified as automatic data processing machines or systems Confusion between network security appliance and ADP machine CPU, OS, storage, form factor, user manual
Tax item Reference rate Application condition Check point
MFN import duty 0% for the reference codes above Where the goods qualify for MFN tariff treatment Verify tariff at declaration date
Ordinary import duty 5% reference Where preferential or special preferential treatment is not available Check Decision 15/2023/QD-TTg and current tariff
VAT 10% reference Unless the goods fall under 0%, 5% or non-taxable categories Check VAT law and any temporary reduction policy
Special preferential duty May be 0% depending on FTA and HS code Valid C/O, correct origin criterion and consistent description Match C/O with invoice, packing list, B/L/AWB and declaration

C/O checklist: verify C/O form, exporting country, origin criterion, HS code, commodity description, invoice number, third-party invoicing if any, direct consignment and submission deadline.

FAQ

Does Mobile Security require an import licence?

It may require an import licence if the model falls under the list of network information security products and performs anti-attack, monitoring, intrusion prevention or security assessment functions.

Is conformity assessment required?

Only after reviewing HS code, description and ICT/telecom functions. Wireless modules may trigger applicable QCVN requirements.

Is Vietnamese sub-labelling required?

Yes, where the imported goods are circulated in Viet Nam and subject to labelling rules. The sub-label must match the original label and import dossier.

Can C/O reduce import duty?

Possibly, if the HS code is covered by an FTA and the C/O is valid. Wrong form, origin criterion or description may lead to rejection.

Are samples or warranty goods treated the same as commercial goods?

Do not assume so. Import purpose, declaration type, value, licence and circulation conditions must be reviewed separately.

What if invoice model differs from catalogue?

Ask the supplier to amend the documents or provide equivalence evidence before declaration. Do not leave the mismatch until arrival.
