IMPORT PROCEDURES FOR VOIP GATEWAY INTO VIETNAM
A VoIP gateway is often declared generically as “network equipment” or “gateway”, while the actual model may include FXS/FXO ports, SIP trunking, Ethernet, PoE power, Wi‑Fi/4G modules or voice encryption features. A small inconsistency between commodity description, catalogue, HS code, C/O and conformity dossier may trigger customs queries, additional documents or clearance delay.
This article provides an E2E (End-to-End) control map before ETA (Estimated Time of Arrival): technical identification, HS code, duty, C/O, specialized policy, customs dossier, clearance decision points and pre-ETA risk checklist.
QUICK FACTS

HS code, tax and specialized policy information is for operational reference. Importers should verify the applicable tariff, Group-2 product list, technical documents and effective regulations at the import date.
SCOPE OF APPLICATION
This article applies only to VoIP gateway: a device converting and transmitting voice over IP, normally connecting analog telephones, PBX, SIP server, PSTN or LAN/WAN networks.
Covered models
- Analog VoIP gateway with FXS/FXO ports.
- Media gateway / SIP gateway for IP PBX systems.
- VoIP gateway with Ethernet, E1/T1 or SIP/RTP protocols.
- New goods imported for trading, projects, offices, factories, hotels or call centers.
Not automatically covered
- IP phone, conference phone, DECT terminal.
- Router, firewall, switch, PBX server or dedicated encryption equipment.
- Used/refurbished goods, warranty goods, samples or temporary imports.
- Models with Wi‑Fi/4G/5G, DECT module or VPN/IPSec/SRTP features require separate review.
Principle: Review catalogue, datasheet, model and actual import purpose. Do not merge IP phone, VoIP gateway, conference phone and DECT terminal into one HS/policy conclusion.
CLASSIFICATION & TECHNICAL IDENTIFICATION
The main function must be identified as reception, conversion and transmission of voice/data between IP networks and telephone/PBX systems. Generic descriptions such as “gateway” or “network equipment” are usually insufficient.
| Checkpoint | Document to compare | Risk if wrongly described | Suggested declaration wording |
|---|---|---|---|
| Main function | Catalogue, datasheet, user manual | Confusion with router, PBX, switch or IP phone; wrong HS code. | VoIP gateway for IP voice signal conversion, model…, brand new. |
| Ports | Port photo, FXS/FXO/E1/T1/Ethernet specs | Insufficient evidence of voice gateway nature. | State number of FXS/FXO/Ethernet ports where possible. |
| Protocol and software | Datasheet, firmware notes | Missing SIP, RTP/SRTP, TLS or VPN review. | Mention SIP/RTP only if it is a real key feature. |
| Wireless module | Wi‑Fi/Bluetooth/4G/DECT specs | Missing frequency and conformity review. | State whether wireless module is integrated. |
| Goods condition | Invoice, packing list, photos, contract | Used/refurbished goods may have different import policy. | Brand-new 100% or actual condition. |
HS CODE – DUTY – C/O
HS classification should be based on function, configuration and operating principle, not commercial name only. Wrong HS may lead to incorrect tax, C/O treatment and specialized policy.
1. HS orientation
| Reference HS code | Applicable condition | Risk if misapplied | Documents to review |
|---|---|---|---|
| 8517.62.59 Preferred reference for ordinary VoIP gateway | Other transmission apparatus incorporating reception apparatus, receiving/converting/transmitting voice or data over IP; normally with SIP, RTP, FXS/FXO/Ethernet. | May be incorrect if the product is an ADP-only gateway/adaptor or telephonic switching apparatus. | Catalogue, connection diagram, port specs, protocol list, label photo. |
| 8517.62.43 | Gateway/adaptor, bridge, router or similar apparatus designed only for connection to ADP machines of heading 84.71. | May not fit devices with PSTN/PBX voice conversion nature. | Datasheet and LAN/WAN connection diagram. |
| 8517.62.30 | Telephonic or telegraphic switching apparatus, where the model acts mainly as switching/PBX equipment. | Misclassification may affect C/O and policy treatment. | Switching function, call routing matrix. |
| 8517.62.69 / 8517.62.99 | Other transmission/other apparatus if actual configuration does not match above groups. | Customs may request explanation when description is too generic. | Detailed catalogue and classification reference if available. |
| 8517.70 / 8517.79 | Parts only, not complete VoIP gateway. | Using parts code for a complete device may be rejected. | Invoice and goods condition. |
2. Proposed tax table
| Tax item | Reference rate | Condition | Control note |
|---|---|---|---|
| MFN import duty | 0% for HS 8517.62.59 and many related 8517.62 codes | Subject to MFN eligibility and correct HS classification. | Check Decree 26/2023/ND-CP and tariff at declaration date. |
| Ordinary import duty | 5% reference for 8517.62.59 | Where MFN is not applicable or as provided by tax law. | Check Decision 15/2023/QD-TTg and updated tariff. |
| Import VAT | 10% reference | If the goods are not subject to non-taxable, 0% or 5% VAT treatment. | Check VAT Law 2024 and implementing guidance. |
| FTA preferential duty | May be 0% if applicable FTA tariff is 0% | Valid C/O, correct form, origin criterion, description and HS code. | Check Form E, D, AK, AJ, VJ, CPTPP, EVFTA, RCEP etc. |
3. Pre-check for C/O
Must not materially conflict with customs declaration.
Avoid overly generic “network device”.
Check CTC/RVC/WO/PE under the relevant FTA.
Control B/L, third-party invoice and transshipment.
APPLICABLE SPECIALIZED POLICIES
VoIP gateway may trigger telecom/ICT specialized management depending on model and functions. Do not state “no permit required” before checking catalogue, datasheet, wireless module, security function and final HS code.
| Scenario | Potential policy | Dossier to check | Responsible portal/agency | Recommended timing | Risk note |
|---|---|---|---|---|---|

FAQ
Does VoIP gateway need an import licence?
Do not conclude absolutely. Review model, HS, wireless function, encryption and Group-2 list.
Is conformity required?
It may be required if the product matches the HS and description in the ICT/telecom list.
Is HS 8517.62.59 always applicable?
No. It is a preferred reference for many VoIP gateways, but must be compared with 8517.62.43, 8517.62.30 or other codes.
Can C/O reduce duty?
Yes, if the FTA tariff is lower and the C/O is valid. If MFN is already 0%, C/O may still be useful for origin proof.
Are samples/warranty goods the same?
Not always. Tax treatment, customs regime and specialized documents may differ.
What if invoice says “gateway” but catalogue says “VoIP gateway”?
Correct documents before declaration to avoid customs queries and C/O issues.
